12~ . Notice of Intent: Maura Borah, 10 MiIIstone'COtlrt ~#211-0806
The Notice of Intent was filed for the installation of an 18x36 in-ground gunite pool with
concrete decking and fencing. Jane Cote of Star Pools and Mr. James Borah were present.
Michele and Cindy performed a site walk February 4, 2008. The pool, decking and fencing will
be located within the grassed area of the side yard, 10 ft. off the back left corner of the house.
The hay bale/silt fence line will be located on the 25 ft. line.
The distance between the closest project disturbance and the associated resource is 25 ft.
2 or 3 White Pine Trees outside of the 25 ft may have to be removed. Mr. Borah was told he
could remove the 2 trees near the pool site but any further cutting will have to be approved by
Conservation.
There is a potential vernal pool located within the wetlands behind the house. Mr Borah
believes the wetlands are only partially on his property. Cindy would like the vernal pool
certified and Mr. Borah gave permission to Michele to do the certification in the spring. Mr.
Borah said he would have the land surveyed before the pool is installed to determine who owns
the property the vernal pool is on.
Jane Cote told the Commission a closed system will be used for the filtration system - no back
washing will be necessary.
Cindy made the motion to accepted the plan for the installation of a pool at 10 Millstone Court
as presented, dated 12-8-2007, and to issue an Order of Conditions with the following additional
conditions; the vernal pool will be certified in April, Mayor June by Michele; applicant has
permission to remove two (2) trees near pool site-if more trees need to be removed, applicant
must come before the board for approval; staked hay bales with silt fencing must be certified by
Michele before any work starts.
Carole seconded.
Passed 4-0.
Hearing ended 7:12 pm.

Hearing continued from January 22, 2008. The Notice of Intent was filed for the construction of
a single-family house partially within the 100 ft. buffer of a BVW
Peter Clark, the landowner, was present.
A revised plan, prepared by GPR Southwest LLC, was submitted February 4, 2008. The house
has been moved as requested by the Commission and drywells have been added to the plan.
Peter told the Commission that the house lot has been renumbered to 890 Maple Street. The
house has been moved further away from the wetland line and the septic tank has been
relocated but not the leach field (Scott Leite approved).
Because this project falls in an Area of Critical Environmental Concern (ACEC), the Canoe River
Aquifer, Cindy would like to make sure everything is done to protect the town's drinking water.
Because it is within a resource area, Carole would like a restriction placed on the deed to
prevent further disturbance of the area. The Deed Restriction will let future owners know what
part of the land they can and cannot use. Peter wanted to know if the restriction is within the
50 ft. or 50 ft. to the 100 ft. line. The Commission told him the restriction would be from the
wetland line to the 50 ft. line. Peter asked Michele for help in wording the Deed Restriction.
A silt fence/hay bale line will be installed, outside of the 50 ft. buffer zone as noted on the plan.
Paul made the motion to accept the plan as drawn for 890 Maple Street (formerly 880 Maple
Street), revised on January 31, 2008 and to issue an Order of Conditions with the following
conditions: a Conservation Restriction be placed on the deed - restrictions to include no
motorized vehicles, no structures such as additions, sheds, fences, pools, tree houses, swing
sets or temporary structure from the 50 ft. no touch area to the wetland line; the DEP file #211-
0805 will be referenced on the Deed Restriction; no trees, brush or vegetation can be removed;
tree pruning of a safety nature only will be allowed with the approval of the Conservation Agent;
no synthetic herbicides, pesticides, fungicides or fertilizers, can be used, only organic products;
Signage will be placed on the 50 ft. no touch line, on 50 ft. centers on metal posts (not on
trees) to read "Environmentally Sensitive Area-Do Not Disturb"; two (2) roof drains with dry
wells will be installed; staked hay bales with silt fencing to be installed and certified by Michele.
The siltation fence can be removed when the vegetation has been reestablished and the
Certificate of Compliance has been issued. The hay bales should be spread to deteriorate
naturally.
Cindy seconded.

Hearing ended at 7:30 pm.

The Notice of Intent was filed for construction of a new single-family house within the 100 ft.
buffer of Greenwood Lake. The new home is replacing the existing house.
Leslie Holander, the property owner and Steve Nelson of Stephen R. Nelson Associates were
present.
The new home with an attached garage will be located where the existing home is now. The
old garage will be torn down. The sewage disposal system is being upgraded and the existing
cesspool will be pumped and crushed.
Cindy and Michele performed a site walk on February 4. 2008. The existing home is
approximately 70 ft. from the existing lake line and 36 ft. to the high water line. There are no
wetlands on the site. The proposed house will not be any closer to the lake than the existing
house. All new construction will be forward and to the right side of the property, outside the 25
ft. no disturb site. Michele would like drywells installed to prevent roof water from running into
the lake.
Christine Staples, Stephen Staples of 1787 West Street and Dave DeMelia, 1777 West Street,
Ms. Holander's neighbors, support the project.
A hay bale line with silt fence will be installed.
Paul made the motion to accept the plan, dated November 29,2007, for 1775 West Street as
drawn and to issue an Order of Conditions with the added conditions; the addition of two (2)
drywells-new plans to be submitted showing the drywells; staked hay bales with silt fence
should be installed along the 40 ft. line in the back of the house; siltation control should be
inspected and certified by Michele before construction begins. Erosion control should remain in
place until construction is completed and the area has been stabilized.
Cindy seconded.
Passed 4-0.
Hearing ended at 7:40 pm.
Cindy asked about the following past hearings:
Robert Meeks, 72 William Street, Appaloosa Estates: Cindy would like Michele to check the
culvert to make sure it is functioning properly. She also would like the silt fence redone; the
stakes are broken and the hay bales have fallen into the stream and should be replaced.
3
Michele will check with John Sullivan, Town Engineer, regarding the culvert. A 30-inch box
culvert was to be used. Instead a round culvert was used. The Commission was concerned
about the flow of water and the ability of wildlife to pass through the culvert. Michele will check
to make sure it is set properly, so wildlife is able to pass thru the culvert and the flow of water is
not impeded in any way.
Joe Mulkern needs a Conservation badge. Michele will take a picture and submit it to the Police
Department.
Cindy would like Michele to look at the Mass Highway tree cutting between Rte. 495 and the
Mansfield Crossing Mall on School Street.
Cindy asked for information about the Stanley Village project; she would like the Map and Lot
number. Michele told the Commission the project is outside the buffer of any resources. Carole
would like Michele to take a look at the property just to be sure there are no conservation
issues.
900 Maple Street - An Enforcement Order was issued to James Epstein on August 21, 2007.
Cindy wanted to know what has been done as far as this property is concerned? He was
supposed to come before the board last October or November. Paul asked the board to not
discuss 900 Maple Street unless James Epstein was notified of the meeting. Michele will contact
Mr. Epstein to invite him to the February 25th meeting.
Map 40-Parcel 92 Maple Street, Lester Epstein - Paul reminded the Commission the court date is
February 14, 2008 and Town Council is going to request Lester Epstein (Map 40/Parcel 92)
restore the vernal pool. When the paperwork is filed for the replication, the Commission will
request that Mr. Epstein certify the large vernal pool in the back of the property.
The 2 vacancies on the Commission have been posted.
Paul and Carole asked about Suzanne Estates: The site contains vernal pools and is a habitat
for the Blue-spotted Salamander, a state-listed rare species. Because the site contains several
breeding sites for the Blue-spotted Salamander, it is important that this common space remain
forested. A letter dated December 27,2004 from the Division of Fisheries & Wildlife requested
that a deed restriction or conservation restriction be placed on the forested back portions of lots
3 and 4 to insure that this portion of these lots remains forested in perpetuity to avoid a "take".
The Conservation Restriction draft for Suzanne Estates, page 2/item #10/2nd paragraph should
read [No use of motorized vehicles will be allowed under the Restriction]. The Conservation
Restriction draft was sent to Ralph Maloon, RIM Engineering, to make the correction on
February 6,2008.
1301 East Street - Ralph Maloon of RIM Engineering is preparing an as built and the request for
a Certificate of Compliance. The Commission had some concerns about the driveway and would
4
like Michele to look at the site. She will do a site visit as soon as the request has been
submitted.
Carole asked when the 50 ft. clarification would be done (a draft was done by Colin last
summer). Michele is going to write them into the regulations.
The Commission asked Michele to look into Conservation money in the General Fund to see if
the money can be transferred back to Conservation. Joe is also looking at different grants
available to the Town. He will get the necessary paperwork for the grants.
Joe asked Michele to check the Toyota site. Michele told him they were not starting the project
because of finances.
Best Buy, 31 Plymouth Street: On March 20, 2007, Michele sent a letter to Best Buy after
receiving a call regarding debris (trash, appliances) in the wetlands adjacent to the parking lot.
More trash has been dumped on the site recently. Michele has spoken to Robert Willard of Best
Buy; he told her they pick up the trash whenever they receive a complaint or see it. He told
Michele as soon as they get it cleared someone else dumps on the site. Best Buy is not
dumping on the site.
Cindy made the motion to accept the January 22, 2008 minutes as written.
Carole seconded.
