ever issued for this property. He says they did receive a receipt from the Town Clerks office. He
explains the house has been up for about thirteen years and that the property is stabilized.
Mr. Healey explains he went to the house and everything was in good order. He said there was
no debris in the transition areas. He says based on what he saw he would recommend
approving the certificate of compliance. Mr. Scarpellini says that they need a Certificate of
Compliance when they sell the house and that's why he's here.

full foundation. Mr. Buckley says just posting. Mr. Healey suggests, as a condition, silt screening

IV' Notice of Intent
Feck Properties LLC 283 Gilbert Street Map 4 Parcel 23. Construction of single family home
with appurtenances within 100 feet of Bordering Vegetated Wetland. DEP SE 211-0982
Mr, Cygannoski introduces himself and states that Stan Feck is unavailable tonight. He says a few
months ago they went to the planning board and broke up the lot further. He says that Ms.
Gonyer approved the lines last year and that none of the flags have been changed. He
overviews the locations of the Vegetated Wetlands and Vernal Pools. He explains having two
drywells to handle to roof runoff. He provides septage details and explains the Town services
that would be required. Dr. Roth verifies that the vernal pools won't be separated; as they are
located in the back.
Mr. Healey asks if Feck Properties will maintain the property, including the stockpile area. Mr.
Cygannoski says it started as a single family house and created access across the wetlands. He
says he knows he'll need a variance for the additional lot to remain in the back. He says that Mr.
Feck wouldn't need to cut down any trees to stockpile in that area.
Mr. Healey asks who owns the property; as it's a little confusing with the plan showing it owned
by Feck Properties. Mr. Cygannoski says they did sell it to Donald Kinsman. Mr. Cygannoski says
they still need to submit to the National Heritage and that the limit of work will be limited by
the proposed lawn area. Dr. Roth asks how they stop runoff from the driveway to the wetland.
Mr. Cygannoski says it's graded to divert runoff.
Mr. Healey says, on the resource map, it shows a lot of vernal pools near the property. Mr.
Cygannoski says that no work will be done within 100 feet of the vernal pools. Mr. Healey
questions if it's 100 feet or 200 feet. Dr. Roth asks if they're certified pools or just speculation.
Mr. Cygannoski says he believes they're certified; as they've worked on this property for about
fifteen years.
2
Dr. Roth asks how much lawn they are creating. Mr. Cygannoski says about 16,900 square feet
with some of it being house and driveway. Dr. Roth asks if it will be gas heat. Mr. Cygannoski
says he believes so.
Mr. Healey asks if this is the full layout of the house. Mr. Cygannoski says yes. Mr. Healey asks if
the septic system will be gravity. Mr. Cygannoski says yes.
Mr. Healey fields for questions. There are none.
*Motion to issue an order of conditions for Feck Properties, LLC, 283 Gilbert Street,

work debris will be outside of the 100 foot border and the stockpile area shown in the
plan, they'll install a construction entrance shown in the plan, the agent will be

Continued Hearing 310 West Street
Mr. Healey says he went by that site a couple times but there has been no real activity. He says
he has some concerns with the property being an assault on the wetlands resource area. He
says he'd like to wait for someone to present.
He says that the wetlands are starting to regenerate. He says that the basement is wet and it'll
only be dry for a short time of the year. He says they were pumping water out of the basement
and putting it into a hole into the ground. He says that you'll start having lower surface level
waters because it's no different than installing a well. He says that this should be resolved. Ms.
loynes asks if it's still on a continual pump. Mr. Healey says no, that power as been shut off to
the property.
Mr. Healey says that the Commission should consider treating anything that comes forward in
the future as a new construction. He says the driveway is on the wetland side of the house and
the previous owner was accepting of moving the driveway to the other side.
Mr. Healey says they need to consider the wetlands protection act when moving forward with
any decisions on this property. Ms. Joynes says that within the 25 foot buffer it would be
acceptable to build on any existing structures. Mr. Healey says that they attempted to install a
few more cement blocks but they didn't have a building permit. Mr. Healey says he believes that
end of Town is on sewer. Dr. Roth asks if the Commission knows the plan for this property. Mr.
Healey says not yet.
*Motion to adjourn at 8:00pm made by Mr. Loukos, 2nd by Dr. Roth. Vote 4-0 PASSED
