Guests: Ryan Kelley (27 Noonan Street), Natalie Fertitta (27 Noonan Street),
The meeting of the Mansfield Zoning Board of Appeals was called to order by Chair
Elisabeth Garber -Miller at 7:30pm.
Ryan P. Kelley and Natalie M. Fertitta for a Variance from Zoning By -Law Section 230-
4.2.A, Rear Yard Setback, for the construction of a deck with a 12.4 foot Rear Yard
setback where 30 feet is required at 27 Noonan Street (Assessor's Map 18, Parcel 36) in
the Residential 2 (R2) zone.
Ms. Garber -Miller appoints Mr. Maxwell to be the hearing member. Ms. Garber -Miller
asks the applicants if their address is on Noonan Street. Mr. Kelley says yes and then says
there are two requests. Ms. Garber -Miller says there's no side yard mentioned in the ad.
They discuss the language of the ad. She says they need to call the side yard a finding and
the back yard a variance. She queries the applicants for more information.
Mr. Kelley says they're looking to add a deck to the rear property. He says they were
required to do a site plan per the Building Inspector. He says that his neighbor near the
sideyard setback has no problems. He says he's planning on installing a six foot wall so
that sound won't carry. Ms. Garber -Miller says the back yard is pretty spacious and asks
about the empty lot they mentioned. Mr. Kelley says there is just a huge lot where one of
his neighbors stores boats and other large items.
Ms. Garber -Miller notes there are no abutters present. She fields for questions from the
Board. There are none.
Ms. Garber -Miller provides information on how the appeal process works and Mr.
Kelley's responsibilities therein.
