3. Communications
a. Letter from Pam Gagnon of Attleboro: As a health care provider, she is concerned about Town Hall
bathroom faucets; the water runs 5 seconds or less in the bathrooms, not allowing sufficient time to
thoroughly wash your hands. Scott checked each fixture and agreed with Ms. Gagnon. He sent a
letter to Ms. Gagnon letting her know he agreed with her that proper hand washing is important
especially during the flu season and that a memo has been sent to the DPW requesting that the
timers be re-set. A memo also will go to the Town Manager.
b. HealthCare Options, Inc. - A letter from HealthCare Options, regarding an increase in the contract
for the July 1, 2008 though June 30, 2009 fiscal year. HealthCare Options is requesting an increase
of 5%, or $1,043, increasing the annual contract rate from $20,876 to $21,919. Ray would like an
explanation regarding the increase; what costs are increasing, is it staff?
4. Nick Mirrione, Mirrione Realty -7:15 pm.
Mr. Mirrione, an Easton developer, came before the Board to discuss a proposed 28-cottage housing
development. The cottages would be less than 1,000 sq. ft., with one or two bedrooms and detached one-
car garages. There would be no basements or attics, and the second floor or "half story" would be built
with a pitched roof. There will be 7 cottages with a small yard per acre. Common areas would be owned
and maintained by condo-style associations.
The cottages would use a shared septic system if a municipal sewer system were not available.
He feels this type of development provides a very safe, secure environment for a segment of the housing
market that has not been addressed. The developments are designed for young, single or married
professionals without children, empty nesters or first time buyers. He told the Board this type of
development has been very successful in Washington State. He believes there is a market for this type of
housing in this area.
He asked if the Board would grant a waiver for this project, allowing the use of a shared septic
system if he is unable to tie into the municipal sewer system. (The project will fall under the new regulation
passed by the Board of Health to no longer allow shared septic systems in the Town of Mansfield) Mr.
Mirrione told the Board the systems are good when done right. He told the Board there would be
safeguards in place to insure the funds would be there for the up keep of the shared septic system. The
money would come from condo fees.
If he isn't granted a waiver he will try for approval of the project under the state affordable housing law,
40B, allowing him to bypass local zoning laws.
Catherine wondered what the maintenance/repair costs would be thirty years from now; would there be
enough money in the reserve fund for the increase? Nancy is concerned about who would make sure the
safeguards are in place. What would happen if an owner decided to have children?
Joe is concerned about land preservation and feels it is in the Town of Mansfield's best interest to deny
Mr. Mirrione's request for a waiver for this project. "If we grant the waiver for this project, more people will
want the same consideration." Mike agreed and feels "we took our time when considering the change to
the regulation to ban the shared systems." He expressed concerns about financing the systems and who
would be administering the reserved funds.
Ray personally is concerned about space preservation and the congestion of the school systems.
Mr. Mirrione told the Board the cottages are small and can't be expanded; few people with children will
purchase the cottages or stay once they have children.
Scott is concerned about the financial aspects of the shared system; will the money be there, who would
oversee the reserve fund? What happens when there are changes in the regulations? Who would be
responsible for the inspection of the machinery, etc? The town spends a lot of time and money to get
people to do things necessary for the up keep of septic systems.
The Board told Mr. Mirrione they would not grant a waiver for this project at this time.
5. Health Agent's Report
a. 77-79 Oakland: David Santoro hearing for November 5, 2007 was continued to December 4, 2007
to give Mr. Santoro more time to complete the sewer hook-up for 77-79 Oakland Street. The work
should be completed in early December.
Ray feels in the future, to avoid a situation like 77-79 Oakland Street; a person should be given a
reasonable amount of time to complete the work. If it has not been completed in the time given, the
water would be shut off to the residence.
b. Paint Hardener: Scott has purchased the paint hardener for residents from Mansfield True
Value for $1.95 per packet.
c. Septic Pumping Truck Inspections: The septic trucks are inspected by the BOH when the permits
are renewed in December. Scott would like to eliminate the inspections. He feels it is probably not
necessary because the trucks are well maintained by the owners. He suggested inspecting trucks
for new permits only. Joe would like the truck inspections to continue. The Board agreed the
inspections should continue.
