Meeting opened at 7:07 pm. 2. Donation of Land on Pratt Street: Mr. Healey said this is a parcel (parcel 030-011, book and page number 1602/479) on Pratt Street, which Nelia Phillips would like to donate as soon as feasible to the Town of Mansfield, to be put under the care and control of the Conservation Commission to protect the parcel as conservation land in perpetuity. Ms. Gonyer said this is a very wet lot along Pratt Street that abuts town -owned land, Map 30, Parcel 10. She said this is a good piece of property for the Commission to accept as a donation. Ms. Simms asked if Ms. Gonyer had reviewed the property. Ms. Gonyer said no but once accepted she will go out and assess the property. There were no public comments. Ms. Simms made the motion for the Conservation Commission to accept the land, parcel 030-011, book 1602, page 479, for conservation restriction with the stipulation a site visit is done and it is found to be environmentally adequate and with a clean title. Mr. Marcheselli seconded the motion. Motion passed 6-0-0. Hearing ended at 7:17 pm. 3. Certificate of Compliance: Roy W. Pastor, 98 South Street. DEP SE 211-437 The Notice of Intent was filed in August 1993 for a proposed dwelling, grading, utilities, and septic within 100 feet of Bordering Vegetated Wetland. Because this was a transfer of title, Ms. Gonyer wrote a letter so the closing for the property could go forward, with the understanding the applicant would apply for the Certificate of Compliance. A memorandum was received from Michael Trowbridge, Hutchins -Trowbridge Associates, Inc., stating the site is substantially in compliance and an as -built was submitted. Ms. Gonyer recommended a full Certificate of Compliance be issued. Mr. Roth made the motion to issue a full Certificate of Compliance to Roy A. Pastor, 98 South Street, Map 1-189, Parcel 4. Mr. Rieth seconded the motion. Motion passed 6-0-0. Hearing ended at 7:20 pm. 4. Request for Extension of Order of Conditions: Homan Sengaba, 8 Jewell Street. DEP SE 211-0951 The Notice of Intent was filed to raze an existing house and construct a new single-family dwelling with landscaping within 100 feet of a Bordering Vegetated Wetland. Ms. Gonyer said Mr. Sengaba requested that the Order be extended for three more years. She will need to follow up with this site to make sure everything is stable for the winter and in the spring Mr. Sengaba will have to seed the area immediately. She said the siltation control is still in place and in good condition. There were no public comments. Mr. Roth made the motion to grant the extension of the Order of Conditions to Homan Sengaba, 8 Jewell Street, DEP SE 211-0951, for 3 years to January 2022. Mr. Marcheselli seconded the motion. Motion passed 6-0-0. Hearing ended at 7:27 pm. 5. Request for Extension of Order of Conditions: Hemze Sengaba, 140 Williams Street, DEP SE 211-0952. The Notice of Intent was filed to construct a new single-family dwelling within 100 feet of a Bordering Vegetated Wetland. Ms. Gonyer said the landscaping and final grading need to be done on this property. There were no public comments. Mr. Marcheselli made the motion to extend the Order of Conditions for Hemze Sengaba, 140 Williams Street, DEP SE 211-0952, to January 2022. Mr. Gallagher seconded the motion. Motion passed 6-0-0. Hearing ended at 7:30 pm. 6. Notice of Intent: David and Amy Walsh, 1781 West Street, Map 2, Parcel 362. DEP SE 211-978: The Notice of Intent was filed to raze an existing single-family dwelling and reconstruct a new single-family dwelling within 100 feet of the Inland Bank of Greenwood Lake. Craig Cygawnoski, RIM Engineering Co., Inc., homeowners David and Amy Walsh, Dennis Colwell and Christopher Drinan of Colwell Architects, Inc. were present. Mr. Cygawnoski explained the existing house at 1781 West Street is on Greenwood Lake and is part of the Clark Shore Condominium Association. He said the house, which was built in the 1980s, will be removed and a new single-family house will be built. He said the existing deck is within the 25 -foot No Touch Area at the shore line so the new house, which will be located 36 feet from the concrete wall, will be moved forward ten feet. The existing improvements along the lake including the dock, stone walls, and dry dock, with nothing new proposed at the shore line; an existing shed will remain. He said because the new house will be less than 25 -feet from the property line, the Applicant will be going to the Zoning Board of Appeals November 27`h. Mr. Cygawnoski said a Request for Determination of Applicability was filed to upgrade the septic system last year. Ms. Gonyer said because of the steep slope on the left of the property down to the water, as part of this project there should be drains place by the water edge or terracing to slow down any the runoff. Mr. Cygawnoski said because the septic tank is located in this area, the terracing would have to be up at the front line of the house. Mr. Healey said when the existing house is removed, it would provide an opportunity to do some maintenance on the retaining wall and flatten out the grade. Mr. Roth asked where any materials would be staged. Mr. Cygawnoski said the staging could be located in the existing gravel driveway area and on the property next door. Mr. Marcheselli asked how much more impervious area would be added to the site. Mr. Cygawnoski said the new house will have almost the same footprint as the existing house, with a larger deck and the driveway will remain gravel. Christopher Drinan said the existing house is 1,600 square feet but the new house will be approximately 3,200 square feet with a second floor and there will be a new garage so there would be an increase of 700+ square feet. Mr. Roth said there is a treed island shown as an existing condition but it appears to have been removed; he asked if there would be any other clearing of vegetation or trees. Mr. Cygawnoski said there are a few pine trees within 10-12 feet of the house on the left side of the property that will be removed. Ms. Gonyer asked if there would be any landscaping, hardscaping, walkways or patios, etc., that are not shown on the plan. Mr. Drinan said there would be a walkout basement but the idea is to have this be a grassed area. Mr. Walsh said his intention is to put a catch basin in the driveway area to provide some recharge. Ms. Gonyer said this should be shown on the plan. Mr. Healey asked if the area where the septic tank and the 1,000 gallon pump chamber are located will be regraded to cut down the slope. Mr. Cygawnoski said the slope could be lowered over the tank but could not be raised because it is three feet below grade. Dennis Colwell said this is a small lake community and the slope is utilized not only by the owner of the property but by other neighbors to launch their boats, so it would be advantageous to not disrupt the slope. Mr. Colwell said what the owner is planning to do with the road at the top of the property will make a huge difference with the water issue. Mr. Walsh said the boats are launched in the spring time and removed in the fall. Mr. Healey again said the Applicant should give some consideration to the retaining wall maintenance. Ms. Gonyer said if the Applicant decides to do this work at a later time or anything changes with the footings, foundation, or slabs, he can do an amendment to the Order by contact the Conservation Department. There were no public comments. Mr. Marcheselli made the motion to issue an Order of Condition to David and Amy Walsh, 1781 West Street, Map 2, Parcel 362, DEP SE 211-0978 with the following Special Conditions under the Mansfield Wetland Protection By - Law Chapter 220: 1. No work can be started until the Order of Conditions has been recorded with the Bristol County Registry of Deeds and the receipt of the Order is returned to the Commission filled in by the Registry; 2. All work must conform to the plans dated 11-28-2018, referenced as "the plan of record" in this Order; 3. All limits of work and erosion controls shall be installed prior to any construction, clearing, or excavation. The erosion controls shall consist of a 8" diameter biodegradable mulch -filled silt sock with wooden stakes every 10 feet on each sides of sock or equivalent (do not pierce silt sock with stakes). In addition to the silt sock, trenched -in silt fence may be required depending on the specific site conditions. See the Conservation Agent (Agent) for specific erosion control design standards. The Applicant shall notify the Agent when any such devices or measures are installed so that a site visit can be conducted prior to the commencement of work; 4. The Commission reserves the right to require additional mitigation or erosion control devices or measures if mitigation or erosion control devices are not adequately installed or maintained on site; 5. The Applicant shall ensure that all demarcation (i.e. limits of work) and erosion control devices will remain in place and be maintained throughout the construction process and until all disturbed areas are stabilized. Stabilization shall be achieved once a complete vegetative cover is reached. Seeded areas shall be covered with a suitable protective cover to allow the seed to germinated and become established. All side slopes greater than 3:1 (but less than 2:1) are to be covered with jute mesh and seeded. At no point shall erosion occur resulting in sediment entering the wetland areas. If erosion occurs, the Agent is to be contacted to review the extent of the erosion and determine follow-up actions; 6. All roof runoff is to be directed in drywells or equivalent drainage components approved by the Commission. The Commission or its agent shall review the locations of the drywells; 7. The Conservation Commission or its agent is to be notified of the starting date of the work prior to its commencement; 8. Prior to the commencement of work, a pre -construction meet shall be held with the Agent, the Engineer and/or Representative, and the General Contractor to review the Order of Conditions, scope of work and construction sequencing; 9. The Applicant shall be responsible to ensure that all contractors on site during the construction have received and reviewed the Order of Conditions and all plans of record; 10. The Certificate of Compliance shall be requested in writing upon completion of the project. At the same time, the applicant or any successor shall, upon completion of the project; submit an as -built plan and letter signed by a professional engineer, certifying that the work has been done in accordance with the approved plan; 11. Any modifications or revisions to the plan(s) referenced in this Order must be submitted to the Commission for review. For single family lots, this Order is for the structures shown on the plan of record only. Any additional structures including, but not limited to, decks, patios, sheds, pools, walkways and/or any hardscape features must be reviewed by the Commission. If, after their review, the Commission finds that the changes are not significant enough (minor modifications) to warrant an Amended Order or new Notice of Intent, then the revised plans shall be considered the new plan of record. If the changes are significant enough to warrant an Amended Order or new Notice of Intent, then the applicant is required to file accordingly; 12. No synthetic fertilizer, herbicides, pesticides or fungicides can be used; only organic products may be used; 13. Dumping of lawn clippings and/or yard debris into wetland and/or 25 -foot No Disturb Zone is prohibited. Storage is prohibited in these areas as well; 14. Provide the general location of the drywell on the gravel driveway. 15. Applicant may repair west side of existing concrete wall/patio by hand. Please contact Agent prior to repair. Mr. Rieth seconded the motion. Motion passed 6-0-0. Hearing ended at 7:53 pm. 7. Notice of Intent: Matthew and Jessica Boudreau, 135 York Road, Map 2, Parcel 200. DEP SE 211-0979 The Notice of Intent was filed for the stabilization of a steep bank that supports an existing in -ground pool and patio within 100 feet of a Bordering Vegetated Wetland. Craig Cygawnoski, RIM Engineering Co., Inc. and homeowners Matthew and Jessica Boudreau were present. Mr. Cygawnoski explained Mr. and Mrs. Boudreau purchased the house with an existing in -ground pool that was built on a steep slope that drops into the wetland that runs down to the Wading River, located approximately 300 feet behind their property. He said over the past several years the vegetation and soil in the southeast corner of the pool has been eroding away and RIM Engineering Co. was hired for the site work but Richard Dempsey, a structural engineer with Dempsey Group, Inc., designed a plan using helical piles to retain the earth. Ms. Gonyer said she was originally called for a landscaping question but, while on site, she noticed that the back corner of the pool had shifted. She said she was familiar with the helical piles and this work absolutely needs to be done. Mr. Marcheselli asked what type of machinery would be used. Mr. Healey said his concern is this is a classic slope failure and asked about the depth and torque rating of each pile. Richard Dempsey was called and the Commission talked with him about the technology and the installation of the helical piles. Ms. Simms questioned how the work would be staged. Ms. Gonyer said this project would have to have a lot of conditions but this work is not as invasive in application and does not appear there would be any adverse impacts to the wetland. Mr. Healey said he likes the technology but would like to see the site. Ms. Gonyer said she will set up a site visit with Mr. Dempsey She and recommended that the hearing be continued to the December meeting to make sure all questions are addressed at the site visit and then come back with answers, more details about the project and potential special conditions. Mr. Healey said he did not have a problem with the technology but is concerned that it would exacerbate something and the applicant would have to come back with more of a problem. Mr. Gallagher made the motion to continue the hearing of Matthew and Jessica Boudreau, 135 York Road, Map 2, Parcel 200, DEP SE 211-0979, to December 17, 2018, Mr. Roth seconded the motion. Motion passed 6-0-0. Hearing ended at 8:40 pm. 8. Notice of Intent: Steve Ruzzo, 251 Branch Street, Map 34, Parcel 100. The Notice of Intent was filed on behalf of the applicant, Eco -Site, for the construction of a cell tower and associated access road within 100 feet of Bordering Vegetated Wetland and a potential Vernal Pool. Meredith Ellis, the Wetland and Ecology Project Manager from La Bella Associates, said she did the wetland delineation in the fall of 2017 and gave a brief overview of the project, which is for a proposed gravel access road and a monopole, tele -communication tower. She noted the wetland was delineated in 2011 and 2015 by another firm with site work done associated with an Order of Conditions for a solar project on the northern half of the property; she noted this work has been completed. She said there are proposed impacts for 0.40 acres of the upland area that is part of the 100 -foot wetland buffer but the project will be staying out of the 25 -foot No Touch Area, Ms. Gonyer asked if the location for the road and the tower were staked out. Ms. Ellis said when she was out on site last fall, there was a flagged or staked location where the center point of the proposed pad would be but since then, after meeting with the town and the Applicant, the location of the tower has been shifted from this location. She said last fall she went out to re -flag the wetland and confirm nothing had changed from the original delineation; she said the plan submitted tonight is with her GPS and her delineation, which did not differ from the original. Ms. Gonyer said she did not know how the Applicant can propose a cell tower in the 74,200 square feet of upland area or how the Commission can permit the project when another project has a conflicting recorded site plan. Ms. Ellis asked about the Certificate of Compliance for the solar project. Ms. Gonyer said the work has been completed and the Order of Conditions, issued in October 2015, has expired but, as part of that project, the entire area shown on the plan was to be preserved; she said there is an encumbrance on the property so when they apply for the Certificate of Compliance, she would recommend that an on-going condition be added to preserve this area in perpetuity. She said she would reach out to both the applicants of the solar field and the proposed cell tower for a staff -level meeting. She recommended the hearing be continued. Michelle Farley, 18 Lincoln Road, said her property is right next to where the cell tower will be going. She said when she bought her house, this area was a forest and then they clear-cut the area for the solar field, leaving part of it as preserved uplands. She said page 3 of the meeting minutes (August 17, 2015) stated Mr. Hobaica asked about the 1.7 acre upland area to the south of the site between the walking trails and the wetlands. James DeVellis, DeVellis Zrein, Inc., said the area will be preserved with the existing vegetation maintained for the duration of the solar project; in the minutes, it was noted the design life of the equipment is 25-40 years. Ms. Farley said this was stated to the town that this area was going to be preserved. Ms. Gonyer said right now she does not foresee this to be a viable project because it is conflicting with an existing Order. She said a staff -level site plan review with Planning and Engineering should be done. Mr. Gallagher said he does not see this project as being viable until the first project is closed out. Ms. Gonyer said the hearing could be continued or the Commission could deny the project, but if denied, the Applicant can go straight to DEP for an appeal, so she would recommend keeping the filing opened at this point. Mr. Marcheselli said if the Commission denies the project and the Applicant goes to DEP for an appeal, DEP can supersede the Commission and issue an Order. He said he would like to see some input from Town Counsel and agreed the hearing should be continued. Julia Camp, 14 Lincoln Road, said they were very concerned about the property because it already had the limitations of AUL and the upland area was to remain untouched. She said the Deer Path Lane neighborhood has water problems, with more water runoff and standing water in their backyards, due to the work that was done on the solar site. She said they have expressed many concerns about this project and the impact on the surrounding area including the Rails -to -Trails and are also concerned about regular access to the site with a gravel road that will have a truck going through once a month for maintenance, because they cannot dig on this site because of prior problems. Robert Camp, 14 Lincoln Road, said the trucks will be going through twice a month and said he was concerned because this was supposed to be preserved uplands; he said he found it interesting that the Order of Conditions has not been closed out for the solar site. He said this site always looks very poor because they do not do any maintenance until someone complains to the town. He said all the things they said they were going to do have not happened. Mr. Roth made the motion to continue the hearing of Steve Ruzzo, 251 Branch Street, Map 34, Parcel 100, to the December 17, 2018 meeting. Mr. Marcheselli seconded the motion. Motion passed 6-0-0. Hearing ended at 9:14 pm. 9. Notice of Intent: Rod Rivera, 310 West Street, Map 11, Parcel 21. The Notice of Intent was filed for the proposed restoration of unpermitted alteration of Bordering Vegetated Wetland and Buffer Zone associated with an existing single-family dwelling. Craig Cygawnoski, RIM Engineering Co., Inc., Rod Rivera, the contractor for the property and property owner Nelson Alvarez, were present. Mr. Cygawnoski said RIM Engineering was only hired to create the as -built plan. Ms. Gonyer said at the last meeting she reported back to the Commission a violation at 310 West Street; she had been on site in late August and at that time there was a port -a -potty and a dumpster within 25-30 feet of a wetland. She went back on site at the beginning of September and found an extensive amount of clearing had been done within the boundaries of the wetland; at that time there was a substantial amount of chipping in the stream as well as all of the fronds from the mature weeping willow tree that had been cut down and the flow of the intermittent stream of Lyons Brook started to back up and flood the parcel. Also, she noticed two sump pumps in the existing house had been running constantly to remove water from the basement. She said once the electric department removed the meter from the house, the sump pumps were discontinued and now there is a substantial amount of water in the basement. She said work was stopped on the house and she requested the Applicant, contractor or representative hire an engineer; RIM was hired to survey the damage, which is the area of wood chips and debris that was dumped and they have put together the existing conditions and Brad Holmes, ECR, Environmental Consulting and Restoration, has put together a restoration plan, showing a tight line wrapped around the house with some plantings and 6,000 square -feet of wetland area and buffer zone to be restored. She said in the woods on the south western portion of the property, there was large scale dumping of trees and tree trunks. She said the existing paved driveway is well within the 25 -foot area and recommended the driveway, which is in poor condition, be re -located to the other side of the house. She also asked that a barrier be added to give a buffer strip, sectioning off the area and allowing the area to re -naturalize. Mr. Healey asked about the restoration plan. Ms. Gonyer said Brad Holmes submitted a restoration plan for the stream bed, Bordering Vegetated Wetland and Buffer Zone at the site by proposing the following activities: Clean and remove by hand all debris and brush and logs within the stream bed that is impeding the stream flow; remove brush, logs, etc. that have historically and recently been place into the wetland; this would involve labor supported by a small excavator with rubber tires to remove materials; all collected materials will be disposed off-site at a licensed facility; remove wood chip piles within the wetland and buffer zone; all collected materials must be disposed off-site at a licensed facility: Ms. Gonyer said the Commission should ask for a receipt; remove remaining sediment piles and drainage systems on the site within the wetland restoration area; any bare soils should be raked smooth and covered with loam if necessary and hand seeded with wetland seed mix; install post and rail fence that demarcates the buffer zone of the wetland area; Ms. Gonyer said this area is to be left undisturbed; create a six-foot wide native planting bed along the interior side of the post and rail fence; install erosion control along the limit of the proposed lawn area; stabilize and restore the yard of the site to include loam and seed with tall fescue lawn seed that will require less fertilization and irrigation. Included also is the re -location of the driveway to the western portion of the site; prepare and submit a restoration completion report with photographs, to be submitted to the Conservation Commission; include a schedule for the different types of trees to be planted, which are to be native, going from a shrub layer to trees; submit details of the composition of the field mixes and the cover mix. Ms. Gonyer said she is satisfied with the restoration plan and will do a very detailed special condition because she wants to make sure the wetland scientist is on site for all these actions and to make sure there are records of all these activities. As proposed, Ms. Gonyer said this is a decent plan as long as it is executed properly. Ms. Simms asked if there was a time frame associated with this plan. Ms. Gonyer said there will be and they will need to make sure, depending on what gets approved, that the site is over wintered, if plantings can be done now, a construction sequence of timing and when it will get done with follow-up and a wetland monitor on site at all times. She said the Commission can issue the Order pending the special conditions drafted by the agent. Mr. Healey asked what items on the restoration plan can be instituted now. Ms. Gonyer said maintenance of the stream bed, make sure the area is stabilized before winter and the areas that were disturbed be covered with jute netting. She said there also needs to be a time line of the work from Brad Holmes. Mr. Healey said the key things to do are stabilization before winter, improve the efficiency of the stream to minimize spring flood, put up erosion controls, install the fence and add 12" silt sock to the top of the bank and pull out the chips. Mr. Marcheselli said it would be best to start the work now; he noted it might be advantageous to work in frozen conditions. Ms. Gonyer said the Order of Conditions can be issued, citing the restoration plan, but would not release the Order until a construction sequence and time line has been received from Brad Holmes. Mr. Healey asked if the following could be done now; stabilize the area, install erosion control, remove debris in stream, pull back the wood chips where appropriate while keeping the area stabilized. Ms. Gonyer said she can put these actions under the Enforcement Order, Mr. Marcheselli suggested they move forward and issue the Order of Conditions. Ms. Simms asked how often would the environmental monitor report back as far as the progress on the plan Ms. Gonyer said during work it would be every time he is on site and then there would have to be on-going monitoring of the restored areas to make sure there is a 75% survival rate, which would be one of the conditions in the Order that you cannot apply for a Certificate of Compliance for 2-3 growing seasons to make sure everything restored takes. Ms. Simms asked if the property were to be sold, would the new homeowner need to comply with the Order. Ms. Gonyer said once it is recorded against the deed, you would not see a transfer until the Order is closed out or there is an agreement between the parties that they will take on all the conditions of the Order. Mr. Marcheselli motioned to issue the Order of Conditions to Rod Rivera, 310 West Street, Map 11, Parcel 21, pending the issuance of a DEP number, for the proposed restoration of unpermitted alteration of Bordering Vegetated Wetland and Buffer Zone associated with an existing single-family dwelling, with the restoration plan from Brad Holmes, ECR, Environmental Consulting and Restoration, LLC, dated November 9, 2018, with the following special conditions under the Mansfield Wetland Protection By -Law Chapter 220: 1. No work can be started until the Order of Conditions has been recorded with the Bristol County Registry of Deeds and the receipt of the Order is returned to the Commission filled in by the Registry; 2. All work must conform to the plans dated November 1, 2018 referenced as "the plan of record" in this Order; 3. All limits of work and erosion controls shall be installed prior to any construction, clearing, or excavation. The erosion controls shall consist of a 8" diameter biodegradable mulch-filled silt sock with wooden stakes every 10 feet on each sides of sock or equivalent (do not pierce silt sock with stakes). In addition to the silt sock, trenched-in silt fence may be required depending on the specific site conditions. See the Conservation Agent (Agent) for specific erosion control design standards.
