Present: Michael Healey, Chairman; Aaron Roth; Matthew Rieth; AGallagher; David Hobaica; Diane
Simms; Katelyn Gonyer, Conservation and Environmental Planner .;,
1. Call to Order at 7:10 pm.
2. Request for Certificate of Compliance: Mansfield Municipal Airport, 265 Fruit Street, Map 34 and 36, Parcels
34-115, 415, 130; 36-148, 15, 16. DEP SE 211-0923
Ms. Gonyer said the Order of Conditions, issued October 23, 2014, has expired. She explained they have gone
through all three phases of cutting but there were issues in the upland area along Tracy Circle, but outside the
100 -foot buffer area. She said the ground water is high and she has worked with Steven Riberdy, GZA
Geoenvironmental, Inc., regarding actions to fix the problems and bring the elevations back up to eliminate
any flooding.
Ms. Gonyer agreed to issue a Partial Certificate of Compliance so the on-going conditions can be followed up
with the already written invasive species plan, which will be monitored for 2-3 growing seasons. Ms. Gonyer
said, because the Order of Conditions has expired, the invasive species management cannot be done without a
current Order; she said the other option would be for the Airport to file a Request for Determination of
Applicability for the Invasive Species Management Plan. She said if the partial Certificate of Compliance is not
issued, the Airport would have to file a Notice of Intent because the Order has expired.
Ms. Simms asked if the mitigation has been done and, if not, when will it be done. Ms. Gonyer said the
mitigation has not been done. Mr. Roth asked if the Tracy Circle residents have approved this plan of action.
Ms. Gonyer said she has not reached out to the residents, but will be involved with watching the progress. She
recommended the partial Certificate of Compliance be issued for just the cutting; she noted the Airport can
work on the on-going conditions under the partial Certificate of Compliance.
There were no public comments.
Mr. Roth made the motion to issue a partial Certificate of Compliance to Mansfield Municipal Airport, 265 Fruit
Street, Map 34 and 36, Parcels 34-115, 415, 130; 36-148, 15, 16, DEP SE 211-0923, with the following on-going
conditions:
• Restore compacted soil areas in Buffer Zone to Wetland B;
• Monitor and report wetland re -growth in all cut wetlands;
• Prepare and submit final Amended Vegetation Management Plan (VMP) post construction;
• Remove sediment logs and
• Implement Invasive Species Control and Management Plan (ISCMP) and monitor effectiveness.
Mr. Rieth seconded the motion.
Motion passed 6-0-0.
Hearing ended at 7:31 pm.
3. Request for Determination of Applicability: Benjamin & Kristen Read, 6 Dario Way, Map 04, Parcel 115.
Proposed addition and grading within 100 feet of Inland Bank of Greenwood Lake and Bordering Vegetated
Wetland.
Paullodice, Jodice & Sons Inc., and homeowner Kristen Read were present.
Ms. Gonyer explained this is one of two houses on a small lot on Dario Way and a 24'x24' addition was
approved January 13, 2014. She said the property is relatively flat and the lawn area has been allowed to
vegetate naturally. Mr. Jodice said the homeowner will be adding an 18'x22' addition to the 2014 addition.
Mr. Roth asked about roof runoff from the new addition and the foundation. Mr. Jodice said there are gutters
on the existing addition, which will be moved over and connected to the existing drywell. He said there will be
a 4' foundation/crawl space.
Mr. Hobaica asked if there would be any stockpiling of excess fill. Mr. Jodice said any fill will be removed from
the site; he noted there will be no additional fill added to the site.
Ms. Gonyer suggested the siltation control be continued/extended to the existing deck and to the front of the
existing addition; the plan, "Conservation Plan 6 Dario Way" dated July 16, 2018, was revised at the hearing to
show the extended siltation control.
Ms. Simms asked about the low bush blueberry to be planted close to the 25 -foot area and if fertilizer would
be used. Ms. Gonyer said she asked for the plantings to help build up the shrub layer at the edge of the 25 -
foot area and a special condition would be added to the Determination that no fertilizer is to be used in this
area.
There were no public comments.
Mr. Hobaica made the motion to issue a Negative Determination for reason #3, work will not impact the
resource area, to Benjamin & Kristen Read, 6 Dario Way, Map 04, Parcel 115, to include the following Special
Conditions:
• Owner is to plant five (5) low bush blueberry as specified on the plan "Conservation Plan 6 Dario Way
dated July 16, 2018: no fertilizer will be used in this area;
• The limit of work is to be extended as revised at the August 27, 2018 hearing.
Mr. Rieth seconded the motion.
Motion passed 6-0-0.
Hearing ended at 7:42 pm.
4. Request for Determination of Applicability: Brian Harvey, 71 Deer Path Lane, Map 34, Lot 321.
Proposed in -ground pool with patio and fence within 100 feet of Bordering Vegetated Wetland.
Mr. Hobaica recused himself.
Tara Sullivan, Easton Pool and Spa, and homeowner Brian Harvey were present.
Ms. Sullivan explained they are building an 18'x23' in -ground pool, which will be located between the 100- and
50 -foot buffer.
ig
Because the pool is close to the Bordering Vegetated Wetland, Ms. Simms asked that frog -logs be added to the
pool; the number of frog -logs to be determined by the size of the pool. She asked about the discharge
method. Ms. Sullivan said a cartridge filtration system will be used so there will be no discharge from the pool.
Mr. Healey asked about the area between the fence and the pool and if the existing tree line would be
affected. Ms. Sullivan said this area would be lawn and the tree line would not change. He asked what type of
paver or apron would be used and if there are any drains for stormwater. Ms. Sullivan said the apron will be
stamped concrete, approximately 1,200 square feet, which will include the patio close to the house and there
are settling vaults to make the area more permeable. Mr. Healey asked about the maintenance for the vaults.
Ms. Sullivan said no maintenance would be required. Mr. Healey asked if it was necessary to drain the pool
how this would be done. Ms. Sullivan said the pool water is drawn down to a maximum of 6" below the
skimmers for the winter and if the pool needed to be drained the water would be de -chlorinated and the
water would be discharged toward the street. Mr. Healey noted there would be little change to the
topography with the installation of the pool.
Ms. Simms asked where the pool would be drained. Ms. Sullivan said the filtration system would be on the left
side of the house so if the pool were to be drained, the water would be discharged to the front of the house on
the existing lawn area. Ms. Sullivan said there would be a 2" retaining wall with plantings by the patio area.
There were no public comments.
Mr. Rieth made the motion to issue a Negative Determination for reason #3, work will not impact the resource
area, to Brian Harvey, 71 Deer Path Lane, Map 34, Lot 321, for a proposed in -ground pool with patio and fence
within 100 feet of Bordering Vegetated Wetland, plan "Proposed In -Ground Pool at Hse. No. 71 Deer Path Lane
in Mansfield, MA" dated July 23, 2018, with the following Special Conditions:
• Agent is to inspect the limit of work prior to the start of work;
• A cartridge filtration system shall be used;
• Any discharge from the pool will be to the front of the house;
• Frog -logs to be installed after the pool is complete.
Ms. Simms seconded the motion.
Motion passed 5-0-1 (Hobaica abstained)
Hearing ended at 7:53 pm.
5. Notice of Intent: Crugnale Properties, LLC, 10 & 30 Reservoir Street, Map 36, Lot 1 & 2. DEP SE 211-0976
Redevelopment of existing site to include a portion of a new building, parking and associated grading within
100 feet of Bordering Vegetated Wetland and the 200 -feet Riverfront Area.
Robert Rego, River Hawk Environmental, LLC, on behalf of Marco Crugnale, Crugnale Properties, LLC, explained
this property is located on the northerly side of Reservoir Street, bound by Route 140/South Main Street, and
to the north by Route 495. He said currently the property is the site of an old soccer bubble with only the
foundation remaining, a small structure, parking areas and a cell phone tower. There is an existing perennial
stream that runs along the easterly portion of the property, a Bordering Vegetated Wetland, a small Isolated
Land Subject to Flooding (ILSF) and the 200 -foot Riverfront Area. Mr. Rego said the wetland resource areas
were flagged by Brad Holmes of Environmental Consulting and Restoration.
Mr. Rego said the Applicant is proposing to re -develop the site with four (4) buildings to include a hotel along
the east side of the property which is in jurisdiction and three (3) additional buildings outside of the
Commission's jurisdiction, as well as associated parking areas. Mr. Rego noted access from the site would stay
the same. He said a small portion of the rear parking lot will extend into an area that is not already developed,
resulting in approximately 6,500 square feet of area that is in the Riverfront Area, which was not previously
pavement; Mr. Rego said this represents about 4.5% of Riverfront Area on the site, less that the 10% required
by the statute. He said currently the stormwater on site is collected from the parking lot by a series of catch
basins and is infiltrated into self -leaching catch basins. He said the Applicant is proposing to collect the
stormwater from the site and the buildings; the stormwater from the paved areas will be treated through
stormceptors prior to interaction to the infiltration areas
Mr. Rego said most of the work is outside the 100 -foot buffer zone and there are no Natural Heritage areas or
flood plain associated with any of the proposed work. He said there is enough parking to meet the zoning
requirement, with 258 spaces provided.
Mr. Healey asked if the three infiltration areas shown on the plan are strictly for the lot runoff or for the roof
runoff also. Mr. Rego said 100% of the stormwater from the parking lot and roofs will be infiltrated on site.
Mr. Rego said there are two overflow/outfall areas, one existing and one new, for events greater than a 10-100
year storm. Mr. Rego said the stormwater management plan has been submitted to Richard Alves, Town
Engineer, for review.
Ms. Gonyer said she has review the resource area delineations; she agreed with the A series of flags but
questioned the B series flags. She said in the Mansfield Wetland Protection By -Law [Section 2: Jurisdiction, 2.1
Areas Subject to Protection] states that any isolated wetland area larger than 5,000 square feet and/or any
area defined as Isolated Land Subject to Flooding under the Wetland Protection Act would require a 100 -foot
buffer. She said the area is flagged conservatively for a total of 3,165 square feet and at this time she is not
ready to dismiss this as a resource area because there could be a potential vernal pool; before anything is
called non -jurisdictional, she would like to meet with Brad Holmes to walk the line. Mr. Rego said he has
maintained a 100 -foot buffer in this area and the area will not be touch or fill. However, he said they are
proposing some minor work within the buffer zone but it is in an area that was previously disturbed under
existing conditions.
Ms. Gonyer said Richard Alves, Town Engineer, would have to review and approve the stormwater
management plan. She asked about the cell tower and the limit of work in this area; she suggested the limit of
work be pulled in. Mr. Rego said the cell tower will not be removed. Mr. Roth asked if there would be any
clearing on the site. Mr. Rego said approximately 6,000 square feet would be cleared by the cell tower for
work purposes.
There were no public comments.
Mr. Gallagher made the motion to continue the hearing for Crugnale Properties, LLC, 10 & 30 Reservoir Street,
Map 36, Lot 1 & 2, DEP SE 211-0976, for the redevelopment of existing site to include a portion of a new
building, parking and associated grading within 100 feet of Bordering Vegetated Wetland and the 200 -feet
Riverfront Area, so Richard Alves, Town Engineer, can review and approve the stormwater management plan
and the Agent can meet with Brad Holmes, Environmental Consulting and Restoration.
6. Request for Certificate of Compliance: Slav Kulik, 303 Branch Street, Map 34, Parcel 457. DEP SE 211-0946

Ms. Gonyer said at the July hearing the grass was not in, there was still re -grading to be done, the patio had
not been installed and the retaining wall was not finished. When she went out today the grass has come in and
a patio has been installed on the side of the house but the landscaping still needs to be done. She suggested
the hearing be continued until she hears from the engineer that everything is in compliance.
There were no public comments.
Mr. Gallagher made the motion to continue the hearing until the Agent hears from the engineer stating that
everything is in compliance. Mr. Hobaica seconded the motion. Motion passed 6-0-0.
Hearing ended at 8:30 pm.

Baron Estates Conservation Restriction: Ms. Gonyer said a Conservation Restriction was placed on a Mansfield
property for a subdivision in Easton, per order of Natural Heritage, because the Easton subdivision resulted in a
"take". She said it was accepted last year, but was never drafted or recorded. A new Conservation Restriction
has been written and is being reviewed by Town Counsel.
Update from Open Space and Recreation Committee: Ms. Gonyer said a new member has been appointed to
the Committee. Meeting dates are as follows: September 24`h, October 29`h, November 26`h, and December
