Community Updates • Mansfield — Lee Azinheira noted that he still has not heard from Easton regarding any wastewater flow commitment. He also noted the Board of Selectmen voted to have him replace Town Manager John D'Agostino as the IMA town representative. • Foxboro — Phil Henderson noted discussions have restarted with the Patriots representatives but nothing new to report yet. Also town meeting is coming up and they expect to have an article that would create a wastewater district in town. Foxboro Water & Sewer Commission has a new member — Mike Stanton. • Norton — Diane McElligott indicated the town has had no new discussions with Wheaton College. Reps Barrows and Poirier did meet with Wheaton officials today just to get a status update. All parties remain interested in joining the regional facility. Also still waiting for DEP letter on Wheaton discharge permit. 2. Potential Funding • Jay Barrows discussed the Housing and Economic Development Funding application. Nothing new to report. Rep Barrows is trying to set up a meeting with that agency. 3. Mansfield - Foxborough- Norton District Legislation • Lee Azinheira had distributed copies of the most recent versions of the Draft Special Legislation and Agreement. Attorney Doug Wilkins from Anderson & Kreiger LLP reviewed his thoughts and comments on the Legislation. He emphasized keeping the language flexible when appropriate and using the previous Mattapoisett District model since that had already been vetted through the legislature. Details should go in the Agreement. • Much of the discussion centered around whether to incorporate other state law language into this Legislation or reference it as currently written and perhaps append appropriate sections to the Agreement. Also the issue of whether the District should have eminent domain powers in the other communities or beyond was discussed. Most agreed purchase was preference but eminent domain may be necessary but only with approval of member from that community. Also District may purchase land in nonmember communities with approval from governing body in that community. • Need Attorney Wilkins to review previous town meeting articles and determine if the Legislation and Agreement need to go back to town meeting for approvals in each community. 4. Other Items • IMA Meeting Minutes of April 13th were approved. 5. Action Items • IMA Members to submit comments on Draft District Agreement to Lee Azinheira prior to next meeting. • Lee Azinheira to review potential funding sources and firms for conducting land appraisals Future Meetings: Monday, May 18th at 6 pm.
