Effluent Recharge Sites • CDM is conducting a site assessment of the Reilly Property. Recent site walk conducted with owners. No surprises to date. • Reilly's attorney forwarded some comments on the site acquisition agreement and Mansfield responded back. David Young spoke with Francis Reilly during site walk to help resolve some items such as treed buffer distance, placement of monitoring wells etc. • Giblin property (Martha Dion's daughter) is now up for sale. 2. Community Updates • Mansfield —Town meeting recently passed article for additional funding needed to acquire Reilly property via SRF Loan Program. • Foxborough—Nothing new with Patriots discussions. Representative Barrows said that Chestnut Green developer is interested in abandoning their wastewater plant and tying into the Foxborough sewer system at 25,000 gpd. • Norton — Norton is planning a special town meeting for first week in October. Their FinCom would like a firm agreement to purchase Reilly Property in mid August in order to place an article to acquire the property on the town meeting warrant. Nothing new with Wheaton until all costs are defined. 3. Discussion on Preliminary Draft of Regional District Agreement (3- 23 -11) • Main topic of discussion was proposed Norton PILOT. • Jay Barrows noted that all sides are very close to an agreement and we need to resolve this one issue. Appears to be conceptual support for PILOT but at a reasonable price. He has heard from Mansfield FinCom that they are skeptical about it and won't support $300K value. Also noted Mansfield is giving up Title 5 flow issue for actually flows which gives Foxborough and Norton in essence free flow capacity. • Bill Ross indicated that his conversations with Mansfield selectmen indicate no support for a $300K PILOT but likely support is no more than $200K. • Diane McElligott believes that Norton has always put forth a request for a $200K net value as they originally requested it be paid as a credit to their bill. Emphasized that Norton has not changed their request. • Brad Bramhall and Bob Kimball re- iterated their support for the Norton W &S Commissioners position. • Diane McElligott put forth the concept of trying to phase the PILOT and the construction of the expansion. • David Young noted the costs to date are for a one time expansion and that real savings where in economy of scale for the 1.5 mgd expansion scenario. • Fran Yanuskiewicz noted there isn't a lot of experience out there with similar PILOTS. He knows Salem received one from the SESD but doesn't know how much. I-Ie believes the PILOT memo of January 10, 2011 clearly gives the reasoning for the $200K net to Norton request. • Bill Euerle remembers the discussion about the $200K credit to Norton but Foxborough folks were confused about whether it was gross or net value since discussion was more about how a credit could or could not be issued. • Bob Kimball said he understood the PILOT to be a means to offset loss to Norton for taking valuable lands away from their potential industrial park expansion. • Bill Ross indicated this is a major issue and could stop the District from going forward since Special Legislation only authorized ability to create; it did not actually create it. • Bob Kimball stated that without a formal district agreement the Norton Selectmen would not support a land taking article for the Reilly property. So that more or less sets a schedule to finalize the agreement. • David Young urged everyone to step back and consider the real difference in cost being discussed between the $200K gross and $200K net which is $300K gross (paid by all three communities). He summarized the following: • Percentage to be paid is from expansion capacity which means Mansfield (44 %), Foxborough (23 %) and Norton (33 %). • A $200K payment thus means each community pays: Mansfield ($88K), Foxborough ($46K) and Norton ($66). • A $300K payment thus means each community pays: Mansfield ($132K), Foxborough ($69K) and Norton ($99) • Difference to each community is: Mansfield ($44K), Foxborough ($23K) and Norton ($33K) • Need to really consider when discussing millions in commitment for this program whether those deltas are worth deadlocking over. • Suggested going with $200K PILOT but starting first fiscal year of substantial completion of first infiltration basin instead of trying to phase. PILOT would be indexed from that point. 4. Schedule to Complete Agreement • Must resolve Norton PILOT first. David Young indicated that past meeting minutes would be worked on and some available at next meeting. Future Meetings: July 7t" and 14th at 6 pm.
