Discussions:
The following is a brief summary of discussions:
1. Minutes
• Minutes of 11 -21 -11 were approved (5 -0)
2. Effluent Recharge Sites
• Lee Azinheira reported that Mansfield Attorney Lou Ross and Norton Attorney
Joe Cove have been drafting a Purchase & Sale Agreement for the Reilly property
and have forwarded it to Reilly's attorney Marc Antine for comment. Lee will
follow -up as there has been minimal info back from Reilly's.
3. Discussion on Draft of Regional District Agreement (11- 21 -11)
• David Young had emailed an updated copy of the Agreement dated 11 -21 -11 to
all parties. He recently received several comments from the treatment plant staff
and they are being incorporated into the agreement. Most were technical
corrections.
• Leo Potter and Diane McElligott both had some questions about wording in r-I
Section 5.3.10. Discussion by all and agreement to add an example to help explain
a
penalty for a community being over their flow allocation. Also discussion about
Section 18.2.1 regarding pension liabilities moving over to District. Bill Ross
explained that District wouldn't be picking up anything communities aren't
already liable for now.
• David Young indicated that a revised draft agreement with suggested edits could
be available first week of December. Draft would be good enough for word
review even though some items would still need to be filled in such as property
descriptions etc.
• Fran Yanuskiewicz noted that information regarding moving the Wheaton
NPDES permit over to the existing WPCF would need to be added. Several
parties asked about status of Norton discussions with Wheaton. Minimal
discussions have occurred over the past year but several Norton representatives
are now plamring to be involved in those discussions.
• VOTE: Motion by Lee Azinheira to "submit Draft Agreement with edits
discussed tonight incorporated to attorneys for each community to review and
comment on ............. second by Leo Potter...... Approved 5 -0.
• Representative Barrows indicated that once he has an approved District
Agreement he can begin to have discussions with various state officials to seek
potential funding sources to help offset costs. Without the final agreement though
he hasn't been able to have these discussions because no one will commit funding
if they don't see a commitment by each community. He is optimistic some money
can be found.
4. Schedule to Complete District Agreement
• Goal will be to have attorney review comments by year (2011) end.
5. Other
Vonnie Reis indicated that Easton remains very interested in gaining 125,000 to
150,000 gpd of flow capacity via a Mansfield connection in order to address their
5- corners area. Lee Azinheira indicated Mansfield will need a firm commitment
from Easton prior to Mansfield signing the District Agreement or the desired flow
capacity may not be there. Vonnie will carry the message to Easton
representatives.
6. Next Meetings
• Attendees agree to hold December 19t" as a potential meeting date along with
January 9, 2012 as the next meeting at 6 pm in Mansfield Town Hall. Focus of
meeting will be to discuss attorney review comments.
