Discussions:
The following is a brief summary of discussions:
1. Community Updates
Jay Barrows asked a representative from each community to provide an update on the
wastewater program status as a means to inform DEP.
• Mansfield — Lee Azinheira and David Young discussed that Mansfield will be
requesting 450,000 gpd. Recommendation being presented to Board of Selectmen
as Sewer Commissioners on February 25`h. Mansfield has not heard from Easton
responding to letter regarding flow commitment request sent first of year.
• Foxboro — Phil Henderson indicated there is no change in their request for
300,000 gpd. Dan Murphy has taken over negotiations between Foxboro and
Patriots officials.
• Norton — Diane McElligott and Duane Knapp indicated that Norton will still be
requesting 500,000 gpd. There have been no new discussions with Wheaton
College.
In summary, the flows add to about 1.25 mgd. This flow will require the use of both
effluent recharge sites evaluated in Norton.
2. MFN District Legislation
Doug Wilkins from Anderson & Kreiger LLP attended the meeting and reviewed
overall parameters for developing the Mansfield-Foxborough-Norton Wastewater
District (MFNWD) special legislation. All agreed that following Chap 40N was
the best approach and that the recent Mattapoisett water district legislation was a
good model to start from. There are several items that will need discussion after
the draft is distributed (such as who has eminent domain powers). He intends to
have a draft before the next meeting to begin the process.
Mr. Wilkins requested a copy of the certified town meeting votes to pursue the
wastewater district be sent to him for his record.
3. Other Items
• Jay Barrows noted he continues to seek funds to help move this project and has
been staying in touch with Barney Frank's Office and Greg Bielecki from the
Governors economic development group.
• No news to report on the status of the Draft Wheaton NPDES permit and DEP
response on process to move that permit to the Mansfield WPCF. Jack Hamm is
working on the response. Dave Young indicated that Mr. Hamm said the permit
transfer will need to go through a public notice and hearing process based on a
request ultimately from Mansfield to move the Wheaton permit to their facility.
Will take longer than first thought but is doable. Also the letter should address the
flow versus mass loading issue.
• Appraisals would need to be done on the Reilly property (15.4 acres as a
minimum) before negotiations could occur. Likely to need minimum of two
appraisals. Lee Azinheira continues to evaluate the WPCF budget to see if any
funding sources are available. He will also try to obtain estimates for the work
and names of firms that could be used.
• Mansfield may submit a town meeting article as a place holder in case funds are
needed to hire the attorney for drafting the District Special Legislation, to conduct
land appraisals or to complete the CWMP/EIR.
• David Young handed out and reviewed a revised project schedule (dated February
17, 2009) for all to review and discuss.
• Some discussion about recent tax bill Norton sent to the Mansfield WPCF. Bill
needs to be based on land value only. Mansfield response pending and each
community is likely to pay their share of some value to be settled upon.
• Minutes of January 22, 2009 IMA Meeting were accepted (with corrected date).
4. Action Items
Norton to provide connection fee cost report to Lee Azinheira (from previous
meeting).
Lee Azinheira to review potential funding sources and firms for conducting land
appraisals
Communities to review Spring Town Meeting article submissions.
