Discussion and Consideration of the Fales Site Mr. Walter Wilk came forward and provided a summary on behalf of the Downtown Committee and stated that the plan to create a parking lot on the remaining Fales Site was unanimously supported with the exception that Mr. Rhein asked for fencing around the dumpsters. Mr. Wilk provided history of the site explaining that originally the building was knocked down and it was intended to be sold to add money back to the tax rolls. He stated that many businesses Downtown stated that more parking is needed and with this plan the bike path will be widened in the area of Old Colony Way. It also provides defined and well -lit parking spaces and businesses will have additional parking and will help keep Downtown businesses here and attract new businesses. Mr. Wilk confirmed the plan is a compromise amongst all parties. Mr. Rick Alves then described the proposed plan which started on Court Street and ended on North Main Street which included the removal of trees on Old Colony way for the widening of the road. Mr. Alves explained there would be a ten foot wide shared use path and two eleven foot travel lanes with parking on each side of the roadway. The remaining undeveloped property at the Fales Site it would have twenty six parking spaces with green space surrounding it. The Grainmill residents would then park in this lot and free up spaces for businesses and make snow plowing over the winter easier. Mr. Cook stated that when the roads are plowed the snow gets pushed behind all the cars and then the snow is shoveled back into the street by residents. Meeting Minutes Board of Selectmen June 20, 2018 Page 2 Mr. Rhein stated thanked everyone who put the plan together and was happy to see progress on this project and once completed it would transform that part of Downtown. Mr. Rhein stated at the last Downtown meeting he was conflicted. He heard the parking concerns and plowing challenges, however the original approval of the space from the Fales Committee was to be green space. He stated there are more residents are coming with the new buildings and hopefully more businesses and asked if there was a way to add a third or quarter of remaining portion of the Fales Site to be green space. Mr. Alves confirmed that a seventeen foot had been added since the original drawings. Mr. Schoonveld thanked everyone and stated that Old Colony was a disaster and he was glad this area was being taken care of. He then asked if the Town was reclaiming all of the Town property in that area. Mr. Alves answered that before any construction was done a registered surveyor would be hired to confirm property lines. He then asked what the expected surface of the bike path was going to be. Mr. Alves answered concrete. Mr. Schoonveld commented that the bike path was going to revitalize Downtown in a big way. Mr. Schoonveld then stated he was concerned about the Grainmill and the agreement from 1981 and asked how many parking spaces were being utilized by those residents. Mr. Jeffrey Gile the property owner came forward and confirmed that the Grainmill was allowed 1.5 spaces per unit which equates to thirty seven spots, however he believed they were using only twenty two. Mr. Schoonveld did not like the idea of building a parking lot for residents. Mr. Wilk stated that there was a use permit for the Grainmill and the Town could not break the law, and by moving the residents to this parking lot it increases parking for the businesses. Mr. Schoonveld asked if there was any land on the Grainmill property that could be converted to parking even if just four of five spaces to reduce the burden to the Town, or could they property pay maintenance fees. Mr. Cook added that a temporary parking lot was necessary during construction for the residents to have a place to park, but it makes sense to build a permanent parking lot. Mr. Aptowitz thanked everyone for their work and stated that he has been on this Board ten or eleven years and have talked about this area for a long time and there was no way to make everyone happy. He commented that there is going to be new construction Downtown with the loss of some parking. He added that the DPW does not have resources or funding to maintain another park. Mr. Aptowitz stated the Board has to make the best decision for the overall Town and he believed more parking was necessary. Mr. DelVecchio stated that he served on the Downtown Committee and there was lots of discussion of parking; however it was his impression that the Fales site was going to be left alone until a further study was conducted and was surprised to see this plan. He asked about the material being used for the parking lot and asked if the parking lot could be easily changed. Mr. Cook answered it was an environmentally green porous asphalt that allows water to drain slowly into the soil and not go into drainage and that this material would not be any more difficult to tear up than another material. Mr. DelVecchio stated he was interested in seeing what develops Downtown. Ms. Katie White of 101 N. Main Street came forward and asked where the snow would go. Mr. Cook answered that it will be plowed into parking spaces and then once the storm ends and streets are clear, crews come in overnight and haul the snow out of the area. Ms. White agreed with Mr. DelVecchio that this plan came as a surprise and on Facebook it was seen as an entire park and thought picnic tables would be a good addition to the current park. Mr. Azinheira answered that they had a short time last year to use the grant money, but when there is more funding the current park area can be changed. Ms. White asked if the development where the Looking Glass is now could be less elaborate. Chairman Trowbridge answered that it is very difficult for the Town to say no to the project when it meets all of the zoning requirements. Mr. Schoonveld asked what the parking requirements were and Chairman Trowbridge answered 1.5 for each residential unit but none were required to retail space. Mr. DeSantis from 62 York Road as well as a member from the Finance and Audit Committee stated he was concerned as a resident that without businesses the taxes go up. He stated businesses have choices and have other Towns they can go to. He added that parking is an essential part of whether a business can sustain. Mr. Doug Annino of 151 Tremont Street stated this project was a "win-win" and the area currently was underutilized and an eye sore. He thought Mr. Alves did a great job of combining different needs and created a plan Meeting Minutes Board of Selectmen June 20, 2018 Page 3 that works well. He believes that it will add to Mansfield and make the community better as well as helping the parking problems and keeping businesses happy. Mr,. Jeffrey Gile owner of the Grainmill stated he would love to see another tennis court or frog pond but the Town has grown and there is a parking problem. He explained the challenges of snow removal in the winter months and was happy that Mansfield has a beautiful Downtown and wants to see it stay that way. Mr. Tom DelMare of 28 Court Street stated he was on the Fales Committee and everyone is excited about the project to some degree because overall it will make the area look great. He then stated that as far as the other part of the Fales site he understood the need for parking, but personally thought the need for parking was overstated. He agreed with Selectmen Rhein and hoped that more green space could be included in this plan as well as seating. Ms. Dana Hourigan of 15 Evans Circle and asked to withdraw her former letter submitted and read a new letter in support of using the remaining Fales property as green space to move Mansfield forward. Mr. Allen Bryer of 187 Copeland Drive came forward and asked if the plan was drawn to scale. Mr. Alves answered it was. He then asked what the funding sources were. Mr. Azinheira answered that $100,000 was approved by Light Commissioners for Electrical work, and $500,000 from the road bond which was funded at Town Meeting. Mr. Wilk added that originally they were going to redo Old Colony Way, so it made sense to have a long term solution and complete the area. Mr. Rhein was unsure how the parking at the Fales site helped with snow removal. Mr. Cook explained how it gives an opportunity to have a snow removal plan for the area and hopes to have snow dumped in back part of parking lot. Mr. Rhein stated he was not sure if this was going to make everyone happy and would like to reconsider the plan to have twenty parking spots and extend the green space because currently the park was like a postage stamp. Mr. Schoonveld agreed that Old Colony way needs to be redone and there is no disagreement on getting that done. He stated that adding some more green was a good idea and that this could be temporary and changed back to green space in the future if there were positive things that happen in regards to parking. He then asked if it was possible to move a row of spots towards Shawmut Avenue to add more green space. Mr. Azinheira answered that it may be possible to gain some feet of green space if the drainage can be reconfigured. Mr. Aptowitz stated that the Board should sign off on this and move forward knowing. Mr. DelVecchio stated the Board should get this right and that Mr. Alves did great work, but perfection was needed without knowing what perfection was. He then commented that he was unsure if this would effectively resolve the parking issues in the Downtown. He stated the thought that it was going to remain green space until the Board knew what was happening Downtown, but liked flexibility in the plan. Chairman Trowbridge stated that last year the Board didn't know of the two big projects Downtown but they were going to make parking more of a problem. He stated he liked this layout and asked if Mr. Alves could try to gain a few more feet for green space. He was happy to see that this is something to give to the businesses of Downtown and was a "win-win" for everyone and stated that the Board is trying to make everything accessible for everyone and was in favor of the proposal. He stated that he was not in favor of assigning spaces to the Grainmill and stated that he disagreed with Mr. Schoonveld because he remembers what the Grainmill was and stated it was a good deal to have that building turned into apartments instead of being torn down years ago. Motion: To approve the plan presented with the proviso that Engineering Department maximize additional space for a park in the Fales location and authorize cutting down the trees. (DelVecchio/Aptowitz) Roll Call Vote Mr. Rhein -Yes Mr. Schoonveld-Yes Mr. Aptowitz-Yes Meeting Minutes Board of Selectmen June 20, 2018 Page 4 Mr. DelVecchio-Yes Chairman Trowbridge -Yes Passes 5:0 6. Discussion and Consideration to Grant Permission to Cut Street for Utility Services at North Main and Dane Streets Chairman Trowbridge left the room for this agenda item. Mr. Nick Riccio was present and stated the road was paved about two and a half years ago and was under a five year moratorium. Mr. Riccio stated he purchased the property through the tax title auction and would be building four single family homes. He was present tonight asking the Board for permission to cut the roadway sooner. He stated that by right he could wait a few years and make eight cuts into the roadway, but the plan he is proposing is less invasive and makes cuts in one area and uses an infrared patch and flowable fill. He would be placing money in escrow for the Town to use their own contractor. Mr. Azinheira stated that he could not allow a trench, and it would be in the best interest of the Town to our own contractor because there is better control and would be a complete mill and overlay from curb to curb. Mr. Rhein and Mr. DelVecchio had no questions. Mr. Schoonveld asked if the amount in escrow would be enough to cover the cost. Mr. Azinheira stated the applicant would have to post a bond that would more than cover the cost. Mr. Schoonveld asked how the Board approved this according to an established agreement. Mr. Azinheira stated the approval would be that the applicant would pay for milling and overlay of the area that was approximately shown but would be determined after the road is cut with the condition to meet the requirements. Mr. Aptowitz asked how many homes. Mr. Riccio answered there would be four single family homes. Motion: To grant permission to the applicant to cut the street for utility services at North Main and Dane Streets on the condition that the applicant will pay for the full mill and overlay as required by the Director of the DPW. (Schoonveld/DelVecchio) Passes 4:0:1 Roll Call Vote: Mr. Schoonveld-Aye Mr. Rhein -Aye Mr. Aptowitz-Aye Mr. DelVecchio-Aye Chairman Trowbridge -Abstain 7. Presentation of Deputy Chief Position by Chief Sellon Chief Sellon thanked the Board and stated the position was part of a much larger reorganization of the department. He stated this position exists within the surrounding communities and mirrors the Fire departments hierarchy and that the Deputy Chief position would be a non-union. Chief Sellon explained that the department is not currently a credited organization; however the department just had its first pre -certification meeting and is on track to be certified within the state of Massachusetts in the next two to four months. He stated this will help effectiveness and standardize practices. Chief Sellon stated that a lieutenant retired last year so this position will not increase the budget because the salaries are similar. Mr. DelVecchio asked if there would then be one less lieutenant in the organization and Chief Sellon answered that there would be three lieutenants in the organizational chart, but the Town would not fund one of the positions and stated that in the future he anticipates the organization growing. Mr. DelVecchio asked if accreditation was worth it on a cost basis and Chief Sellon answered it was and especially the self-assessment portion. Chief Sellon the average cost is about $70,000, but from a liability protection standpoint it can provide savings. Mr. Aptowitz asked if the Deputy Chief would be working day hours and Chief Sellon confirmed. Mr. Schoonveld commented that he appreciated the department going after accreditation and asked how long before the federal accreditation. Chief Sellon stated probably twelve to eighteen months after achieving the state level certification. Mr. Schoonveld asked what other towns were accredited. Chief Sellon answered Canton and a few other Towns were. Mr. Schoonveld asked if the position would be an employee at will or under a contract and Chief Sellon answered it would fall under Meeting Minutes Board of Selectmen June 20, 2018 Page 5 civil service. Mr. Schoonveld commented that he thought three years of experience was "light" and Chief Sellon replied he compared with other job descriptions and that was common and expects that the person would have upwards of fifteen years. Mr. Schoonveld asked if this person will be responsible for making sure the department stays accredited and Chief Sellon confirmed they would. Mr. Rhein asked if this was a new position and Chief Sellon answered that it was a new position taking the place of an open lieutenant position that he is not filling. Mr. Rhein asked what the expected salary was and Chief Sellon estimated a salary of $110,000. Chairman Trowbridge stated that his big concern was that Chief Sellon was the only non-union position and stated that there needs to be another non-union person. Motion: To approve the Police Department Deputy Chief Job Description as presented.
