4. VISITORS
Mr. Girard. 15 Surrey Dr.. asked for a variance: from the Well Regulation since: he has one:
distance from the proposed well to his septic system that does not meet the 100'
setback. It is 75'. Agent recom....",ds that the same: procedure be: held for Mr. Girord as
the one: for Mr. Pizura. Black Pond Rd.. where the applicant must file a deed restriction
that says the shallow well will be: used only for watering the lawn and landscaping. Once a

c. Household Hazardous Waste Collection: April 8th, 8:30AM-1:00PM. Mr. Wade,
Branch St. offered to collect the batteries. Agent said "no thank you", with a concern
that they would be stored on his property on Branch St. Board agreed.
d. Embargoed Food at Mansfield Public Schools: A warehouse for the Dept. of
Agriculture, supplier of food for public school, was rodent infested. All the food was
embargoed and later destroyed and shipped to a landfill.
e. 444 Pratt St. House was sold and new owners wants to connect to town sewer, but
cannot at this time, since the new sewerline is not operable due to the newly
discovered contamination at the lift station and highway garage. Agent will allow buyer
to temporarily hook into cesspool until sewer is ready for the connection, and the
money for the betterment and hookup will be held in escrow.
f.Phoenbc Environmental-Great Waves: Forrest Emery, principal, sent a letter to
The Taunton River Watershed Alliance, Inc., (non-profit alliance of concerned
individuals, businesses, etc.), for their opinion on the pool water splash and carry-out
contamination issues. A letter from Mr. Emery was sent to the BOH with a copy of
the Alliance's response. Agent commented that there are other methods of
disinfection, ozone, bromine or chlorine. Also, the chlorinated water can be held in an
r area long enough for the chlorine to dissipate. The Agent and Board will deal with this
when the pool permits are filed with plans of the pools.
g. 258-260 Ware St. Variance: Older duplex. Needs variance from Septic Reg
because their setback from wetlands is 61'. They need 75' according to
BOH reg, State reg is 50'. Agent recommends.
MOTION: To grant variance.
Leonard/Martin. 5-0 PASSED
h. Rubbish Regulation?: Since there have been complaints from residents re:
neighbors junk-filled yards, which in some cases, is just aesthetic, Agent asked if the
Board feels that a rubbish reg is in order. Does the Board again want to enforce?
Removal junk vehicles? How discretionary can the Board actually be? Wood piles,
tires, boats, trailers, for example, are they really health hazards? This could open a
big can of worms and would require lots of brainstorming and thought. Is it really the
responsibility of town departments to order people to clean up their yards and maintain
them to a certain standard? It is also a value judgment, what is dear to one, may not
be to another. Member Martin suggested getting other town's regs that deal with
junk residential yards. Chair thought this could be a town bylaw, rather than a health
reg, since many of these items are not health related. It was agreed that the Health
Dept. should be adopting regulations that protect the community from health threats.

As far as storage of chemicals, it is not against a law to store them. It is a violation, if
they are leaking. Member Martin suggested a regulation that requires them to report
to the Board what chemicals they are storing. Board will discusS again.

i. Wells in Vicinity of 340 S. Main St.: Agent contacted Nancy'Nevins at the IT
Group to discuss his concern with proposed irrigation wells on S. Main St. in the vicinity
of the Textron site. IT Group sent conditions of issuance of a permit to drill a well
that may be imposed on all wells in that area. The conditions are for the resident or
owner of the property and are as follows:
1. Agrees to use the well for irrigation purposes only.
2. Agrees to allow Textron, Inc. (or their agent) to sample the well prior to use
and on a future periodic basis.
3. No cost will be incurred for this sampling.

the well in the form of a Dept. of Environmental Management/Office of Water
Resources Well Completion Report.

work at the recycling park. Board thought it was a great idea and Agent will talk with
DPW Director. (Member Leonard left at 8:27PM).
Member Jones asked about the certification of a septic installer and how the Agent is
handling that portion of the Title V law. Agent responded that he had a stamp made to
be used on all as-built plans. The installer must sign on the line to certify that the system
was installed correctly. The stamp reads, HI certify that the system has been
constructed in compliance with 310 CMR 15.000, the approved design plans and all local
requirements, and that any changes to the design plans have been reflected on as-built
plans which have been submitted to the approving authority by the designer. H
