Motion to approve the Consent Agent: Healey/Wall. Motion passed 3-0-0.
7:09 pm visitor: Barry Cole, Elizabeth Clemmey, and Jack Cooney - proposed Plastic Waste Reduction Article:
Barry Cole explained he is part of an executive committee called Team Up Mansfield and he gave a summary of the
Article 45 Citizen Petition — Article III Chapter 180-16 Plastic Waste Reduction, also known as the elimination of
single -use plastic bags, which has been placed on the annual town meeting warrant. The petition, if passed, would
eliminate the thin-film plastic bags less than 4 mil- thick in size, which are provided by retailers in Mansfield to
customers at the point of sale. Mr. Cole noted produce, newspaper, garbage and dog waste bags were
intentionally excluded from the restriction; he said non -retail businesses are also not included in the restriction;
however, the group will be encouraging all businesses to find ways to reduce and eliminate plastic bags. He said
the article does cover, but does not restrict, paper bags; he noted all paper bags must be 100% recyclable.
Mr. Cole said for stores 3,500 square feet or larger, the proposed by-law will take effect November 1, 2018 or six
(6) months after the passage or approval by the Attorney General; for stores less than 3,500 square feet the
proposed by-law will take effect one (1) year after approval, May 1, 2019.
Mr. Cole said Team Up Mansfield has been working with some of the local groups, Keep Mansfield Beautiful, COA
and the Food Pantry, soliciting for both recyclable bags and donations; he noted Keep Mansfield Beautiful has
already committed to donating reusable bags. He said the proposed by-law is modeled after other town and is
very similar to the article passed in the Town of Wellesley. He said there are over 60 cities and towns in
Massachusetts who have effectively passed or successfully implemented the program.
Elizabeth Clemmey said there is a state committee to do this for the entire state but it will probably take a couple
of years to pass.
Mr. Coie said the way the article is proposed the Board of Health will be enforcing the proposed by-law and will
have the option to grant a six (6) month extension for compliance if the law causes undue hardship to a business,
or if a business needs more time to draw down an inventory of bags. He said businesses not in compliance would
receive a written warning notice and then fines.
Mr. Cole said there have been studies done that show the harm done to both marine and terrestrial animals and
the pollution and clogging of storm drains in cities and towns.
Mr. Healey said he is in favor of the article but said one of his concerns is the sanitation of the reusable bags; he
said perishable products leaking into the bags create a potential hazard. Ms. Clemmey said plastic is still allowed
for meat products. She said the issue of sanitation has been studied by the Mass Green Network and it is a non -
issue
Ms. Clemmey said Wellesley was given high praise for having one of the most comprehensive plans. Mr. Cole said
some towns have implemented a fee for paper bags, but Team Up Mansfield has chosen not to add a fee to the
article. Mr. Coie said one of the things they might consider if the article passes would be to help with an
educational and outreach program. Ms. Clemmey suggested a public service announcement on Cable Access.
Mr. Coie said they will be presenting the proposal to the Chamber of Commerce and they will be doing more
outreach between now and town meeting on May 15`'. Mr. McClean said the board fully supports the article. Ms.
Wall asked what the rate of decrease of the use of plastic bags and buying of reusable bags is for towns who have
implemented the ban. Mr. Cole said, based on the average consumption in this country, 20,000 single -use bags
that are used for 12 minutes are discarded in Mansfield every day. He said it takes enough fuel to produce 12
plastic bags as it does to drive a car for one month.
3. Correspondence:
4. Agent's Report:
• Body Art Regulation revisions: Mr. Healey asked if the board would have to have a public
hearing to pass the changes to the regulations; he said he did not think a public hearing was
needed if you are making changes to existing regulations. Ms. Donovan Palmer said if it is a new
regulation a hearing would be necessary but, if it is a change to an existing regulation, after the
changes have been approved by the board, it would only have to be posted in the newspapers.
Mr. Healey said he would like to move forward so the existing establishments can have the
updated regulations but would like Ms. Donovan -Palmer to get clarification on whether a public
hearing is necessary or not. Mr. Healey said he will not be present for the May meeting but he is
in favor of the regulation.
• Fat/Oil Grease draft regulations: Ms. Donovan -Palmer and Mr. Healey have drafted a regulation
for fat, oil and grease. Ms. Donovan -Palmer contacted Lee Azinheira, DPW Director, and she
and Mr. Healey will meet with Mr. Azinheira to discuss the regulations.
• Proposed fee increases: Ms. Donovan -Palmer presented a spreadsheet showing Mansfield's fees
as they compare with the surrounding towns. Mr. McClean said the fees are low and the board
should consider bringing the fees in line with the other towns.
After a discussion, Mr. McClean asked Ms. Donavan -Palmer to put together a proposed schedule
of fees with a complete list of establishments and fees for review at the next meeting.
• Lead in School faucets: Ms. Donovan -Palmer talked with the head nurse at the schools and
worked with her to put together a statement, which was sent to the Town Manager and the
Superintendent of Schools, who will forward the statement to the Sun Chronicle. She believes
the schools have taken the appropriate steps to eliminate the lead in the drinking fountains; she
said most of the problems are with the fixtures, which will be replaced and then re -testing will
be done.
Mr. Healey asked if the lead found was above an acceptable level. Ms. Donovan -Palmer said for
the initial draw the level was above but then they did 30 second draws and the level decreased
drastically. She said they have put signs on the sinks to identify them as hand -washing only and
the water bubblers were taken out of service; she said the re -fill stations are not a problem
because they are new. Ms. Donovan -Palmer explained the Department of Public Health states
that water containing lead and copper is not harmful if used for handwashing only.
Mr. McClean said he was concerned students would fill their water bottles from the
handwashing sinks. He said he appreciates the situation and the short term plan to take the
bubblers out of service, with signs for the sinks, but said he would feel more comfortable if
there was a long-term plan. Ms. Donovan -Palmer said she will follow up with the schools and
keep the board informed.
• Power Outages: Ms. Donovan -Palmer asked that the board members contact her if there are
food establishments operating during a power outage.
• Household Hazardous Waste Day will be held on Saturday April 14`h at the Xfinity Center from
8:00 AM — 1:00 PM. A press release will be sent for publication in the Mansfield News and the
Sun Chronicle and will also be put out on social media sites.
5. Old Business:
6. New Business:
7. Adjournment:
