4. VISITORS
7:05 PM Linda Savini, 60 Pine Street, apologized for not taking advantage of the appeal
period for her failed septic system enforcement order. She is requesting an extension to
upgrade the system. A cesspool exists and it did not legally pass Title 5. It was
inspected by a licensed inspector, who passed it because he was a friend of Mrs. Savini.
An installer, not licensed in Mansfield, made adjustments to the cesspool to allow it to
flow better. This action was illegal because you cannot alter a cesspool. Now it must be
('" replaced with a septic system. The house has been for sale, taken off the market (advice

of real estate agent) because of the holidays. She is willing to put it back on the
market now, because as soon as she has a signed Purchase and Sales Agreement ~d the
money (about $3,000) she will replace the cesspool with a septic system. Of course, if
the house had sold, she would not be requesting an extension and the new system would
have been completed.
Board members asked if a public health hazard exists with this failed cesspool and how
much longer can this situation remain until it becomes a health hazard? Agent responded
that it is not a public health hazard at this time and can remain for a few more months.
This issue is in court because of the illegal actions on the cesspool.
MOTION: Take no action at this time and revisit situation in 60 days.
Martin/ Jones. All in favor. 4-0
At 7:25PM Karen Doucette, Program Director, Norton, Mansfield, Sharon Tobacco
Control Program, reported that there have been three violators selling to minors. The
$100 fine has been received from Citgo, still waiting for the fine from Mansfield Variety
& Deli. Sarro'S Meat Market waS a warning. Sunoco waS sent a follow-up letter because
never responded to merchant training as required by the BOH. Attempting to schedule
training next week.
'l
.'
Health Educator Gretchen Elliott is leaving her position to work closer to her home on the
Cape. Karen would like to rehire the compliance person who waS released when funding
waS reduced. He is interested in the position. A new job description has been written
and given to the Board.
Smoke-free restaurants: Jimmy's Pub will be smoke free January 1st. That leaves six
restaurants that have a smoking area. Member Jones will not support smoke-free bars
because they are a different setting than a restaurant, matter of choice to sit at a bar
and they do not attract children.
Member Madan waS concerned with smoking at private clubs, such as the Elks. It already
states in the reg that a private club hosting a private function can a.lIow smoking, but will
be smoke-free with a public function. Member Madan is requesting that a sign be posted
that makes it clear to patrons that smoking is not allowed at a public fundion.
Chairman Giangarra recommends a hard wall between smoking and non-smoking and a
separate ventilation system. A restaurant can always request a variance.

Board agreed to enforce regulation one month after approval and signature. Again a
restaurant that has to make physical changes can ask for a variance for a period of time.
MOTION: Table votes and review at J anuory meeting with full Board.
Madan/Martin. All in favor. 4-0
John Spiezio, Geno's Restaurant, said that his bar and restaurant are two separate
rooms with separate ventilation. Board said that he should already comply with proposed
reg.
5. HEAL TH AGENT'S REPORT
r
a. Troy, 171 Ware St.: Has been returned to Charlotte Troy. After about fifteen
years, the septic system has been certified, as-builts approved and approved by
DEP. Case is closed. Another issue has arisen. One tenant filed a housing
complaint with minor infractions. They have all been addressed except for the one
that requires a locked door with a buzzer for four or more units per building. Mrs.
Troy is asking for a variance from this housing code. She did not request the
hearing within the allotted time in the enforcement order. It has been granted in
the past at another address. Board agreed to invite her in for a hearing to
address her request.
b. 9-11 Allen St.: Another complaint against landlord, Walter Day. This one is
regarding a wall that was built with rocks and soil. The soil is eroding and may be
causing the rocks to become loose and possibly dangerous. Has been referred to
Building Inspector, who has ordered an engineer's report to ensure that the
structure is safe. Report has not yet been received. This has been taken to
Housing Court.
c. Annual Report: Topic this year is "The Changing Face of Mansfield". Agent will
submit report to Annual Report Committee and email a copy to members.
d. Household Hazardous Waste Day: $15,000 in account. Board agreed to one
full-day collection in the Spring. Agent reported that Q product is on the market
that hardens latex paint. He has contacted True Value and Wallpaper City in
Mansfield and they will be carrying the product. Hopefully this will eliminate the
bulk of latex paint at the Collection.
