a. Hearing - 43 Brown Ave
The Health Agent stated the problems with the septic system at 43 Brown Ave. were due to a poor
inspection report, sloppiness, and a misunderstanding of how a septic system works. Scott met with the
inspection company and suggested owners of the company contact the owners of the property. The
Brenneis' stated that the inspection company has never contacted them. The tank is in backward and the
field is clogged. The Bresseis' had 45 days to submit a plan, 75 days to submit a contract with a licensed
installer, and 120 days to complete the upgrade of the system. The plan was submitted on December 24,
2003. Scott spoke with the Engineer to revise the plan. He feels the plan is not designed to their best
interest. The system is in working condition and they have exercised good faith. He recommends giving
the couple a timeframe to complete the project.
Chris Brenneis stated 4 days after they purchased the house, the septic backed up. He never received
a Title V inspection report. They are both students, working and in a bad financial situation right now. They
would like more time to pursue legal action against the inspectors.
Ray Martin asked how long they thought they would need. Chris and Kathleen agreed 6mo would be
sufficient. Ray also mentioned if they needed an extension they can request another hearing before the
Board.
J-
MOTION: to grant a continuance of a six (6) month completion date to upgrade the septic
