Present: Michael Healey, Chair; Christopher Marcheselli; Ryan INA>ZJG IFAaron Roth; Matthew
Rieth; Katelyn Gonyer Conservation and Environmental Planner. 1}q N9MI C
1. Hearing opened at 7:00 pm. MASSACHUSETTS
2. Request for a Partial Certificate of Compliance: Robert Meeks, 10 Buckskin Drive (Williams
Street/Buckskin Drive). DEP SE 211-0747
This request has been withdrawn.
3. Notice of Intent: David Mullins, 19 Sean Drive, Map 12, Parcel 56. DEP SE 211-0972
The Notice of Intent was filed for the installation of an in -ground pool with associated structures
within 100 feet of Bordering Vegetated Wetlands,
Ms. Gonyer said there is a wetland located to the southwest of the property along the driveway
edge and, while on site with the owner of the property, an additional wetland was discovered to the
northwest. She said a Request for Determination of Applicability was originally filed, but because of
the extent of jurisdiction, a Notice of Intent was filed for the pool with associated hardscaping and a
pool house. Ms. Gonyer said the biggest concern is the substantial amount of pavement along the
edge of the wetland; she suggested additional plantings along the paved area to prevent runoff.
She noted there is a potential vernal pool on site, but at this time the boundaries of the vernal pool
have not been determined.
Mr. Maxwell asked about the storage containers on site. Mr. Mullins said they are temporary and
will be removed. Mr. Maxwell noted there are a couple of areas labeled "open storage areas" on
the plan. Ms. Gonyer said, because of the 25 -foot no touch regulation, there will be no structures,
development or activities permitted in these areas.
Ms. Gonyer asked about the pool filtration system. Mr. Dupree said a paper filter is planned. Ms.
Gonyer said all new in -ground pools shall use a cartridge filtration system or a filter system where
all backwater is directed into drywells on the same property. She said at no point should backwater
be directed into wetland resource areas and all pool water is to be de -chlorinated before it is
drained from the pool; all drained water is to be drained over the land/lawn of the same property.
Mr. Maxwell said he does not have a problem with the proposed work but the storage containers
need to be removed and any further encroachment to the resource areas should be limited. He
suggested adding signs as well as trees and plantings along the edge of the driveway. Mr. Healey
agreed there should be plantings along the western side of the driveway to help stabilize the area
but he also asked for bushes and plantings along the 25 -foot no touch zone. Mr. Marcheselli asked
that Ms. Gonyer meet on site with the applicant to determine the location of the plantings.
Mr. Marcheselli made the motion to issue an Order of Conditions to David Mullins, 19 Sean Drive,
Map 12, Parcel 56, DEP SE 211-0972, in accordance with the plan "Proposed House Addition &
1
Pool at Hse. No. 19 Sean Drive in Mansfield, MA" dated November 22, 2017, prepared by Craig
Cygawnoski, RIM Engineering Co., Inc., with the following additional Special Conditions under the
Mansfield Wetland Protection By -Law Chapter 220:
1. No work can be started until the Order of Conditions has been recorded with the Bristol County
Registry of Deeds and the receipt of the Order is returned to the Commission filled in by the
Registry;
2. All work must conform to the plans dated November 22, 2017, referenced as "the plan of record"
in this Order,
3. All limits of work and erosion controls shall be installed prior to any construction, clearing, or
excavation. The erosion controls shall consist of a 8" diameter biodegradable mulch -filled silt
sock with wooden stakes every 10 feet on each sides of sock or equivalent (do not pierce silt
sock with stakes). In addition to the silt sock, trenched -in silt fence may be required depending
on the specific site conditions. See the Conservation Agent (Agent) for specific erosion control
design standards. The Applicant shall notify the Agent when any such devices or measures are
installed so that a site visit can be conducted prior to the commencement of work;
4. The Commission reserves the right to require additional mitigation or erosion control devices or
measures if mitigation or erosion control devices are not adequately installed or maintained on
site;
5. The Applicant shall ensure that all demarcation (i.e. limits of work) and erosion control devices
will remain in place and be maintained throughout the construction process and until all
disturbed areas are stabilized. Stabilization shall be achieved once a complete vegetative cover
is reached. Seeded areas shall be covered with a suitable protective cover to allow the seed to
germinated and become established. All side slopes greater than 3:1 (but less than 2:1) are to
be covered with jute mesh and seeded. At no point shall erosion occur resulting in sediment
entering the wetland areas. If erosion occurs, the Agent is to be contacted to review the extent
of the erosion and determine follow-up actions;
6. All roof runoff is to be directed in drywells or equivalent drainage components approved by the
Commission. The Commission or its agent shall review the locations of the drywells;
7. A construction sequence is to be submitted to the Commission prior to the start of work;
8. The Conservation Commission or its agent is to be notified of the starting date of the work prior
to its commencement;
9. Prior to the commencement of work, a pre -construction meet shall be held with the Agent, the
Engineer and/or Representative, and the General Contractor to review the Order of Conditions,
scope of work and construction sequencing;
10. The Applicant shall be responsible to ensure that all contractors on site during the construction
have received and reviewed the Order of Conditions and all plans of record;
11. Wetland flagging must remain in place until the project has been completed and the Certificate
of Compliance issued;

Attorney Armstrong explained the Applicant is proposing to expand the existing building to create
an art center, which will include an art gallery, theater, dressing rooms, and office space.
Mr. DeVellis said the Notice of Intent was filed because the proposed work will be within 100 feet of
Bordering Vegetated Wetland and the 200 -foot Riverfront Area. He provided an overview of the
project, including an existing conditions survey, materials, drainage plan and landscaping. He
noted an Alternative Analysis was provided with the filing. He said the proposal has already been
presented to the Planning and Engineering Departments.
Mr. DeVellis said the walking trails have been pulled away from the wetland area and moved toward
the development area; excavated boulders have been placed in this area to prevent people from
driving onto the trails.
Mr. Roth asked how the trails will be maintained. Mr. DeVellis said the walking trails are of no
interest to MMAS and there would be no real maintenance involved. Ms. Gonyer said an RDA was
filed in June 2013 to clear and widen the trails and help limit the erosion. Ms. Gonyer would like to
see an annual management plan for the trails and the kayak portage area.
Mike Anadola said he was concerned about the trails and asked if the trails would be left as they
presently exist or would they be cleaned up and additional trails developed. Ms. Gonyer explained
they will not be adding new trails.
Ms. Gonyer said the project has gone through many revisions with Mr. DeVellis and internally with
staff. She noted the plans have been changed to reflect the concerns of Richard Alves, Town
Engineer. In a letter dated November 15, 2017, Mr. DeVellis responded to the Engineering
Department's review comments of November 8, 2017.
Mr. Maxwell asked if there would be a guardrail or fence along the steepest slope by the parking
area. Mr. DeVellis said a guardrail will be installed.
Mr. Healey read into the record an email from John and Libby Cacaccio, 15 Reservoir Street,
expressing their strong objection to the proposed redevelopment of the property located at 888
South Main Street. Mr. Healey addressed the noise, traffic and parking concerns but said these
issues are not within Conservation jurisdiction. Mr. and Mrs. Cacaccio were concerned about the
displacement of geese and swans that live and breed in and around the property at 888 South Main
Street. Ms. Gonyer said this project would not be a threat to wildlife habitat.
Mr. Roth made the motion to issue an Order of Conditions to MMAS, Inc., 888 South Main Street,
Map 16, Parcel 14, DEP SE 211-0971, with the following additional Special Conditions under the
Mansfield Wetland Protection By -Law Chapter 220:

Registry of Deeds and the receipt of the Order is returned to the Commission filled in by the
Registry;
2. All work must conform to the plans dated 12-11-17, referenced as "the plan of record" in this
Order as listed below:
