Meeting called to order at 7:00 pm. f-tANSRIELD MASSACHUSETTS 2. Sean Burke, Eagle Scout Project at Marie Streese Property: Mr. Burke explained he will be rebuilding the bridge on the Marie Streese property, which is a woodland nature preserve located on Ware Street. He said the current bridge is undersized, rotting, and unsteady and looks temporary; the new bridge will be wider and sturdier. Mr. Burke said he has obtained full approval for the project and will be recruiting family, friends and other troop members to help with this project; he said the materials will cost approximately $150.00. Ms. Gonyer said Mr. Burke has spoken with Colin Cauldwell about the bridge design. she noted the current walkway is old and no longer safe and the new boardwalk will be more permanent. She said Mr. Burke has done a great job with the project and she will continue to work with him. Mr. Roth asked if cedar or pressure -treated lumber would be used for the bridge. Mr. Burke said he will use pressure - treated lumber. Mr. Roth said he was unable to walk out to the river because of the condition of the boardwalk; he noted the area was very overgrown. He said signage should be added to the Conservation trails. 3. Request for Determination of Applicability: Yuriy Onyskiv, 2 Dario Way, Map 4, Parcel 116. The RDA was filed for the construction of a second floor on an existing single-family house within 100 feet of Inland Bank of Greenwood Lake. Ms. Gonyer said she helped the applicant prepare the filing, which is for a second -floor on an existing single-family home. She said she wants to be sure there is a limit of work on the back side of the property to delineate the work area; she said silt fencing would be sufficient. She recommended with the new roof line that all roof runoff be directed to drywells or stone trenches to prevent erosion to the lake from sheet flow off the roof. All disturbed areas should be re -seeded as soon as possible. Mr. Rieth asked about the deck, a portion of which is within the 25 -foot area. Ms. Gonyer said this is an existing deck and no new footings would be allowed; she said her understanding was there would be no expansion of the existing footprint. Mr. Healey said the scope of work mentions there will be some internal foundation work. Ms. Gonyer said she will check on the footings and the reinforcement of the foundation. Mr. Rieth made the motion to issue a Negative Determination for Reason #3, work will not alter the resource area, to Yuriy Onyskiv, 2 Dario Way, Map 4, Parcel 116, for the construction of a second floor on existing single-family house within 100 feet of Inland Bank of Greenwood Lake, plan, "Conservation Plan 2 Dario Way" dated June 21, 2017, revised October 2, 2017, prepared by Hutchins -Trowbridge Associates, Inc., with the following Special Conditions: • The Agent is to inspect the siltation control (per plan) prior to the start of work; • All roof runoff must be directed to drywells or stone trenches to prevent erosion to the lake from sheet flow from the new roof line; • All disturbed areas are to be seeded as soon as possible; • Erosion Control must remain until areas have been stabilized. Mr. Roth seconded the motion. Motion passed 4-0-0. Hearing ended at 7:23 pm. 4. Request to Amend an Order of Conditions: Paul Donovan, 17 Goose Lane. Amend the Order of Conditions under DEP SE 211-0911 to include installation of an in -ground pool Homeowner Paul Donovan was present Ms. Gonyer said Mr. Donovan has been working with the Commission for almost five years. A Notice of Intent was filed for regrading in the back portion of the lawn area with follow up plantings for mitigation without an Order of Conditions. Two growing seasons have passed and all plantings are doing well. All conditions of the Order under DEP SE 211-0911 were satisfied. Mr. Donovan requested an extension of the Order of Conditions in 2016 (extended to November 20, 2019) because he wanted to do amendments to his property, including an in -ground pool with associated apron and patio, regrading and a retaining wall, which would run up to the 25 -foot area. The pool will be located on the right side of the yard. Mr. Healey asked about the proposed retaining wall. Mr. Donovan said he would like approval for the future wall, which would be 2-3 feet high and should be parallel to the 25 -foot zone. Ms. Gonyer said the retaining wall will replace a large boulder wall and recommended the wall be added to the plan. Mr. Roth made the motion to accept the amended plan, "DEP SE 211-0911 Amendment to Existing Order of Conditions at Hse. No. 1 Goose Lane" dated October 16, 2017, prepared by RIM Engineering Co., Inc., with the condition that the area to the south of the pool be left to re -naturalize along with a two -foot buffer strip at the limit of Bordering Vegetated Wetland; the quantity and location of additional plantings will be determined in the field by the Agent. Mr. Rieth seconded the motion. Motion passed 3-1-0 (Mr. Maxwell voted no) 5. Notice of Intent: Joseph Lynch, 44 Cabot Boulevard, Map 44, Parcel 321. DEP SE 211-0970 The Notice of Intent was filed for the construction of a 60,000 square -foot warehouse with associated parking, utilities and drainage within 100 feet of Bordering Vegetated Wetland, Isolated Vegetated Wetland and Inland Bank of pond. Hearing was continued at the September 18, 2017 meeting. Ms. Gonyer said she met in the field with John Rockwood, Eco -Tech, Inc., to review the wetland delineation and the proposed plantings. Because there is a point where the entrance and some of the grading for the driveway would be closest to the wetland, but still outside the 50 -foot buffer, a significant buffer strip was proposed with similar saplings and under -story plantings for mitigation. Ms. Gonyer met with Town Engineer Richard Alves and staff to review the project. A memorandum from Richard Alves dated September 28, 2017 stated he had reviewed the Site Plan for "44 Cabot Boulevard" and Drainage Analysis and the drawings and revisions (revision date September 27, 2017) have satisfied his outstanding comments. Mr. Buckley presented the project to the Planning Board and the Zoning Board of Appeals and any changes have been included in the most recent draft. Mr. Lynch noted the project received approval from the Planning Board and the Zoning Board of Appeals. Mr. Maxwell made the motion to issue an Order of Conditions to Joseph Lynch, 44 Cabot Boulevard, Map 44, Parcel 321, DEP SE 211-0970, with the following Special Conditions: 1. In addition to the silt sock, trenched -in silt fence may be required depending on the specific site conditions. See the Conservation Agent (Agent) for specific erosion control design standards. The Applicant shall notify the Agent when any such devices or measures are installed so that a site visit can be conducted prior to the commencement of work. 4. The Commission reserves the right to require additional mitigation or erosion control devices or measures if mitigation or erosion control devices are not adequately installed or maintained on site. 5. The Applicant shall ensure that all demarcation (i.e. limits of work) and erosion control devices will remain in place and be maintained throughout the construction process and until all disturbed areas are stabilized. Stabilization shall be achieved once a complete vegetative cover is reached. Seeded areas shall be covered with a suitable protective cover to allow the seed to germinated and become established. All side slopes greater than 3:1 (but less than 2:1) are to be covered with jute mesh and seeded. At no point shall erosion occur resulting in sediment entering the wetland areas. If erosion occurs, the Agent is to be contacted to review the extent of the erosion and determine follow-up actions. 6. All roof runoff is to be directed in drywells or equivalent drainage components approved by the Commission. The Commission or its agent shall review the locations of the drywells. 7. For single family lots, this Order is for the structures shown on the plan of record only. Any additional structures including, but not limited to, decks, patios, sheds, pools, walkways and/or any hardscape features must be reviewed by the Commission. If, after their review, the Commission finds that the changes are not significant enough (minor modifications) to warrant an Amended Order or new Notice of Intent, then the revised plans shall be considered the new plan of record. If the changes are significant enough to warrant an Amended Order or new Notice of Intent, then the applicant is required to file accordingly. 14. Signage for industrial, commercial or any large scale project: Prior to receiving a Certificate of Compliance, the Applicant must install permanent "Environmentally Sensitive Area" signs on the subject lot. The Applicant must install 12" x 18" metal signs on a permanent metal post. The quantity and location of the sign are to be designated by Commission or the Agent on a case by case basis.
