Meeting called to order at 7:00 pm. 113 2. Discussion: Trevor Humphrey explained he has lived at 124 Dean Street for seven years and came before the Commission to discuss his concerns about impacts to the Rumford River and Kingman Pond as a result of activities that occur from the annual Duck Race; he was concerned about the ducks that travel to Kingman Pond, broken ducks, flooding from Fulton Pond when the boards are pulled, potential wildlife impacts to the fish and turtles, debris and the visible oil field on the pond from the roadway. He said each year he has had to clean up the ducks and debris flushed down stream and noted the situation is getting worse. He suggested using a secondary net and using more environmentally -friendly ducks. Mr. Humphrey said the Rumford River is not ideally suited for the race and said other towns he contacted use waterways used for canoeing. Ms. Gonyer said they do not want to do the event on waterways with less of a flow because this would cause more issues. She explained 30 minutes prior to the start of the race, boards are pulled by DPW staff; the number of boards pulled depends on the flow in the pond at the time of the race. She said the entire event lasts approximately one hour and 10-12 Park and Recreation staff members and volunteers as well as 4 DPW staff members are in attendance before, during and after the race. She noted DPW periodically pulls the boards because the river is meant to be flushed and flooded. Mr. Healey said, as management of the pond, the eco -system needs to be flushed, which could disrupt fish, turtle and other aquatic life. He noted only a small amount of ducks get through the net, considering 5000 ducks are released. Ms. Gonyer said the Parks and Recreation Department, volunteers and DPW staff do a very thorough job of cleaning up the area, leaving the area in better condition than prior to the event. She said she would attend next year's race and urged Mr. Humphrey to participate in the event. 3. Request for Determination of Applicability: Charles H. Curtis, 26 Potash Road, Map 38, Parcel 170. Application is for the installation of retaining wall to level off rear portion of existing lawn within 100 feet of Bordering Vegetated Wetlands. Homeowner Charles Curtis was present. Ms. Gonyer explained the southwest corner of this lot slopes down toward the wetlands located at the back of the property. She said Mr. Curtis would like to install a four -foot retaining wall and regrade the area to bring the area up to the grade of the existing yard. She noted a landscaping plan "Curtis Residence 26 Potash Road Mansfield MA" dated May 15, 2017, revised in the field on August 2, 2017, prepared by Guerrini Landscape Inc., was submitted on August 14, 2017. Mr. Healey asked Mr. Curtis if he knew what caused the depression at the back of the house. Mr. Hobaica said the area was probably a stump dump and suggested test pits be done, but said it might be better for the area to remain as is. Mr. Marcheselli made the motion to issue a Negative Determination for reason #3, work will not alter the resource area, to Charles H. Curtis, 26 Potash Road, Map 38, Parcel 170, with the following Special Conditions: • The Agent is to inspect the siltation control (per plan) prior to the start of work; location of erosion controls to be determined by agent; • Silt sock must be mulch. Erosion controls will be installed as per the plan "Conservation Plan Septic Up -Grade at Hse. No. 153 Brown Avenue in Mansfield, MA" dated August 25, 2017, prepared by RIM Engineering Co., Inc. Mr. Hobaica made the motion to issue a Negative Determination for reason #3, work will not alter the resource area, to Kevin & Annette Dion, 153 Brown Avenue, Map 4, Parcel 104 for Title 5 septic system and drainage upgrade for a residential dwelling within 100 feet of Inland Bank of Greenwood Lake with the following Special Conditions: • The Agent is to inspect the siltation control (per plan) prior to the start of work; • Silt sock must be mulch. DEP SE 211-0970 Application is for the construction of a 60,000 square -foot warehouse with associated parking, utilities and drainage within 100 feet of Bordering Vegetated Wetland, Isolated Vegetated Wetland and Inland Bank of pond. William R. Buckley, Jr., Bay Colony Group, Inc., John P. Rockwood, Eco -Tech, Inc. and Mr. Russell, owner of the property, were present. Mr. Buckley explained this project is for a 60,000 square -foot warehouse/flex building on a partially vacant, 10.2 +/- wooded property, located on the southeast corner of Cabot Boulevard and Hampshire Street. He said the activities within the buffer zone will include a small portion of the proposed building, parking area and the truck area on the right side of the property. Mr. Buckley discussed the stormwater management system, to include underground filtration in front of the building near the west entrance and an above -ground infiltration basin located behind the truck loading area. Mr. Buckley said a buffer zone enhancement area has been developed by Mr. Rockwood. Ms. Gonyer met on site several times and has spoken with Richard Alves, Town Engineer, about the project and she will review the drainage and grade issues with him. She suggested the hearing be continued. Mr. Buckley said he will be going before the Zoning Board of Appeals on September 26, 2017 and the Planning Board on September 27, 2017. He will then modify and re -file the plans and hopefully, receive approval. Mr. Rieth made the motion to continue the hearing for Joseph Lynch, 44 Cabot Boulevard, Map 44, Parcel 321, DEP SE 211-0970, to October 23, 2017. Mr. Marcheselli seconded the motion. Motion passed 6-0-0. Hearing ended at 8:17 pm. 6. Amended Order of Conditions: Ronald & Susan Quintiliani, 41 Lakeview Avenue, Map 4, Parcel 53. Request to amend Order of Conditions under DEP SE 211-0954 to include various landscape changes to Plan of Record. Homeowners Mr. and Mrs. Quintiliani were present Ms. Gonyer explained this is an active Order of Conditions issued on May 10, 2016 to Mr. and Mrs. Quintiliani for the razing of an existing house and the construction of a new single-family house with expanded patio and deck. She said the construction of the house is complete but they are now dealing with final landscaping issues. She met on site at the end of June; minor changes were made in the field with the patio area and the location of a shed, which she discussed with Mr. Healey. Ms. Gonyer reminded the Commission the Order of Conditions stipulated the yard area on the north side of the property was to be terraced to minimize the velocity of sheet runoff to prevent erosion and 3 scouring between 41 Lakeview Avenue and 37 Lakeview Avenue. She noted Mr. Quintiliani decided not to replace the entire retaining wall, only the northerly portion. Ms. Gonyer requested an Amended Order of Conditions be filed because of the side yard area and retaining wall issues; Ms. Gonyer said if the area on the north side between the new house and 37 Lakeview Avenue is terraced, there will be no access to the propane tank and air conditioning unit. Ms. Gonyer said this area is stabilize but is level and there are concerns there might be water issues. Instead of terracing, a depression area will be added between the two houses at the driveway to catch run-off. A knee wall with stone in front will be installed at the rear of the house; Ms. Gonyer believes this will be sufficient. The south side of the wall will be resurfaced and the entire wall will be re -capped. The concrete at the front of the wall will be cleaned up and any cracks in the wall will be repaired; the damage to the wall was caused from trees and stumps and the owner would like to remove the trees to alleviate further damage to the wall once the wall is repaired. She said the patio area will now be cobblestone. All work will be completed within a couple of days and Ms. Gonyer asked to be notified prior to the start of work. Ms. Gonyer said the changes to the plan will not cause more of an impact and the work will be no closer to the resource area. Mr. Marcheselli made the motion to issue the Amended Order of Conditions under DEP SE 211-0954 to Ronald & Susan Quintiliani, 41 Lakeview Avenue, Map 4, Parcel 53 to include the various landscape changes shown on the site sketch "DEP SE 211-0954 Request for an Amended Order of Conditions for Hse. No. 41 Lakeview Avenue in Mansfield, MA dated August 28, 2017, prepared by RIM Engineering Co., Inc.; the landscape site sketch shall be included as part of the Plan of Record.
