Paul Tsimortos - Erick Road: Paul Tsimortos appeared before the
Commission to discuss his 63 apartment -condominiums project on
Lot No. 4, Erick Road. Mr. Tsimortos reported that this project
received Board of Health approval in 1976, the building plans have
been preliminarily accepted by the Building Inspector, percolations
were overseen by former Town Engineer Stanzione, and the proposed
drainage system incorporates suggestions made by Mr. Stanzione.
Com. Boyden observed that his view of the site indicated that
filling along the westerly lot line within 50 feet of the wetlands
had occurred in the past and that his suggestion would be that Mr.
Tsimortos be requested to clean up this area, thus repairing the
previous damage. Since Com. Boyden was the only Commissioner to
have made an inspection of the area, however, it was agreed that
Mr. Tsimortos and Ralph Maloon would accompany as many Commissioners
as possible on an on-site inspection. It was requested that a
property line stake be set in order to enable the Commissioners to
locate the proposed work area.

MOTION: To respond to Mr. Tsimortos request for a determination
based on the findings of the Commissioners on their
on-site inspection of the project.

MOTION: To send a memo to the Planning Board stating that,
with Mr. Tsimortos' cognizance and agreement, the
Commission is recommending a closed drainage system be
used throughout this project and that the westerly lot

Com. Webb arrived at this time.
Mrs. Jellinek - Henley -Lundgren Pond: (Com. Boyden excused himself
from this discussion since he had not been involved in this project
due to a possible conflict of interest.) Mrs. Jellinek inquired
whether Henley -Lundgren had received an extension permit for this
project., Upon checking with the file, Chairwoman Royle noted that
since DEQE had issued a Superseding Order of Conditions for this
project, it would have been up to the State to issue such an
extension permit and that she was not able to locate a copy of suc,
an extension permit in the file.
MOTION: To send a letter to DEQE stating that the Commission had
not been able to locate an extension permit for this
project in the file and requesting an update on the status
of this project.

Revaluation: Com. Webb reported that she had received a call from
the Yorks, who previously donated Conservation land to the town,
who are concerned about their ability to afi.ord the taxes on their
revalued undeveloped land. Com. Webb went on to say that this is
not a unique case and that the possibility of large tracts of
undeveloped land being broken up or sold to developers is a very
real concern for the Commission and the Town.
MOTION: To send a letter to Judith Pickett, Counsel, Conservation
Law Foundation, requesting information on the alternatives
available for these people (i.e., description of a conservati
restriction, method of taxing agricultural land, any legal
recourse to this philosophy of taxing property, etc.

elevation less than this would expose an inordinate
amount of slope. A revised plan shall be submitted to
the Commission before work begins reflecting these
changes.
2. The largest culvert shall
the course of the project
