MOTION: To waive the filing of a Notice of Intent by the Town of Mansfield for the development of 'a well at Maple Park. This waiver is authorized under Chapter 131, Section 40 (p. 584, paragraph 5) since the Mansfield Conservation Commission has certified that this is CONSERVATION COMMISSION MINUTES PAGE'2 MONDAY OCTOBER 27 1980 an emergency project to be performed by an, agency of the Commonwealth (Town of Mansfield) for the health and safety of the Commonwealth (residents' of Mansfield). A separate summary is on file; a tape the hearing is also on file at the Town Clerk's 'office'. re Street Drainage: Barbara Jones, 776 Ware Street, gave who were attending the meeting, disputed the 'seven inches' mentioned by Mr. DeCastro but did agree that the land is very flat in that area. They also pointed out that lowering the pond at Mill Street by removing one or two boards at the dam at Canoe River Campgrounds (Joseph Gonsalves) might have an effect on the nearby Dustin Wells. Balcom Street Subdivision: John Risser of Risser Engineering Company, representing the, owner and developer of the subdivision, appeared before the Commission as invited in order to answer questions to enable the Commission to make a determination as to the applicability of the Wetland Protection Act with respect; to this project. While there are no wetlands on the land to be developed, the drainage is to be directed toward a swamp on the adjacent Haynes property. In addition, should the cul de sac shown on the preliminary plan remain as is, the CONSERVATION COMMISSION MINUTES PAGE 3 MONDAY, OCTOBER 27,1980 back lots of the subdivision would fall within 100 feet of a wetland. It was the consensus of the Commissioners present thata Wetland Protection Act Hearing would definitely be necessary to cover the drainage from the subdivision and any work to be carried out within 100 feet of the wetland (i.e., the back lots should the cul de sac remain as presently drawn). A letter shall be sent to Mr. Brown, the owner of the land, with copies to Mr. McLacklan, Mr. Risser, and the Planning Board, confirming this decision. Edward'Stivaletta -'Bristol Arms; Town Engineer, Anthony r Stanzione, has received a request for aCertificate of Compli- ance for this project. Since this is the responsibility of the Conservation Commission, the 'Town Engineer informed the Commission that it is his opinion that the work has been done in conformance with the plan submitted. From the stand- point of the stream, the Town Engineer feels that this project has improved the flowing of this stream by widening and cleaning` it. There was some difference of opinion as to whether or not the Certificate of Compliance could be issued contingent on the replacement of the 'culvert under Erick Road which Mr. Stivaletta has agreed to carry out whenever he next works on Erick Road, MAT T nTT i' T., do..A 1ottAr to Mr qt- iVA l'atta informing him that+betore the commission can consiaer issuing a Certificate of Compliance for this project,' they must receive an as -built plan 'signed by the project engineer certifying that the plan indicates the work as accomplished.` (Royle - Boyden; all in favor) VOTED Correspondence: 1. Copy of Special Permit Decision on the Application of the Ashes from the Planning Board.; 2. Copy of October 21, 1980 letter from DEQE to Rewlew Trust outlining the manner in which they are to spread the spoil material on the Morse property. MOTION: To send a letter to DEQE reiterating the Com- mission's grave concern with this spreading operation because of its detrimental effect on the existing vegetation and suggesting that the stream bed be used as an avenue for removing the stockpiled material' since' it has been agreed that CONSERVATION COMMISSION MINUTES PAGE,'4 MONDAY, OCTOBER 27, 1980 this stream bed will be rescraped because of the amount of sedimentation in it. (Boyden - Meszoely; all in 'favor)VOTED Stream: Cleaning: Com. Meszoely shared with the Commission his view that extensive stream cleaning in Town is not a panacea. He pointed out that a stream flowing slowly has a great deal of benefit for the recharging of our water supply since the water slowly seeps into the ground and replenishes our wells. Water which moves quickly simply runs out of Town. Cabot Pond: Com. Royle reported that she had contacted the Corps of Engineers for an up -date on the status of Cabot Pond vis-a-vis their permit. Stephen DiLorenzo, with whom she spoke, informed Com. Royle that while Messers Chavaree and Willis: had applied for such a permit, they had commenced work before receiving it.; The Corps' greatest concern with the project is the stockpiling of material in the wetland area. 'Mr. DiLorenzo requested that members of the Commission join his on-site inspection of the project on Tuesday, October 28, 1980 at 9:00 AM. Coms. Boyden, Royle, iSheehan, and Sweet will attend.
