Kenneth H. Torman - Fulton Pond: Chairwoman Webb reported that
Kenneth H. Torman, 86 Rumford Avenue, had approached Com. Boyden
about placing a pump in Fulton Pond to provide water for his lawn
sprinkler. Com. Boyden suggested that Mr. Torman obtain any water
he needed from the Pond with buckets rather than with the aid of a
pump. Although Com. Sweet disagreed with this decision, the
instructions to Mr. Torman were backed by the other Commissioners.
Fulton and Kingman Pond Dams: Com. Royle reported that Constable
Lambos telephoned he'r to report problems he has noted at the dams
for both Fulton and Kingman Ponds.
A. Apparently, Constable Lambos stated, when the Fulton Pond
dam was built, not enough concrete was used in the construc-
tion and at present gravel is flowing through the dam.
B. A dead poplar tree near Kingman Pond dam is attracting
many youngsters and it is presenting a hazard to their
safety.
Mrs. MacKay gave Chairwoman Webb a copy of a memo dictated to the
Town Manager by Com. Boyden concerning the dead tree near Kingman
Pond dam.
MOTION: To send a letter to the Town Manager reporting Constable
Lambos' observations at the Fulton Pond dam:and requesting
that appropriate action be taken.

Northeast Corridor Improvement Project• Chairwoman Webb reported
that Robert S. DeSanto of DeLeuw, Cather/Parsons & Associates,
Northeast Corridor Program Managers, has offered to conduct a
walking tour of the area covered by the Federal Railroad Admini-
stration's project. It was the consensus of the Commissioners

t that a Saturday morning would be most convenient for this on-site
inspection which, the Commissioners felt, could take place either
before or after the hearing which is scheduled for Monday, July 28.
Com. Sheehan suggested that the following people be sent copies
of the hearing notice together with information concerning the on-
site inspection:
Anthony G. Stanzione, Town Engineer
W. Chadwick Maurer, Town Planner
Thomas Bonome, Mansfield Department of Public Works
Camp, Dresser & McKee, Inc.
Whitman & Howard
Joseph T. Cronin, Mass. Department of Public Works,
Taunton
David Chareth, Mass. Department of Public Works,
Expediter for Routes 140 and 495
It was also decided that due to the large number of abutters to
this project a special notice to all abutters and interested
citizens inviting them to the hearing should be published in the
MANSFIELD NEWS together with the usual hearing notice.
Ash Gravel Removal Project: The Wetland Protection Act Hearing
for this project was scheduled for Monday, July 28, 1980 at
9:30 PM.
Rewlew Trust - Woodland Park: James Kelly, attorney for Rewlew
Trust, and Nancy Eames came before the Commission at the suggestion
of Ted Kaegael, DEQE. DEQE has granted Rewlew Trust an extension
"limited to the relocation and modifications of the Back Bay Brook
proper, and does not include work related to filling in the area
of the original brook bed or the placement and removal of the
existing stockpiled spoil material. Any other work ... shall require
a new filing." Mr. Kelly contends that the filling of the original
brook bed was part of the original plans filed with the Commission
and the subject of the Superseding Order of Conditions issued by
DEQE after the Commission's Order of Conditions was appealed.
More spoil material was generated than anticipated so that while
grading of all of this excess material would not allow the stated
elevations to be maintained, stockpiling of this material would
allow for its future use on the roads of the sub -division.
The decision most hoped for by Rewlew Trust would be that without
a new Wetland Protection Act Hearing they would be allowed to
fill in the brook bed, push back the material stockpiled near the
brook to prevent pollution, and to stockpile the remaining excess
material in a cul-de-sac on-site where trees have already been
removed. was the consensus of the Commissioners that this

work was probably covered by the original plans submitted for the
hearing and that, therefore, a new hearing should not be required.
It was agreed that DEQE staff members would be consulted concerning
this matter when they are in Mansfield on Thursday, July 24, 1980
on another matter.
Old Colony Motors, Inc. Margot Jellinek, with flood plain map in
hand, stated that the land across the Rumford River from the Town
Hall, for which Old Colony Motors, Inc. has been granted a variance
to use as a lot for cars, is in the flood flow and thus should not
be developed. While the Commissioners could not be sure from the
flood plain map whether or not the land acutally is in the flood
flow, they were most concerned because the land falls within 100
feet of the Rumford River.
MOTION: To send a letter to Messrs. Sarro and Porfido explaining
the Commission's concern in this project and informing
them that they have been placed on the Commission's
agenda for Monday, July 28, 1980 at 7:30 PM. They should
also be requested to bring any drawings they have of
their plans.
(Sheehan - Sweet; all in favor) VOTED
Henley -Lundgren Earth Removal Project: The Commissioners studied
the plans for this project at some length.
MOTION: To send a memo to the Planning Board stating that after
review and discussion, the Commissioners feel that no
Wetland Protection Act Hearing will be required for the
excavation of the buffer zone between the Clemmey-Gray
properties.
