PAY K, 1960
Members Present: Chairwoman Webb (arrived at 8:00 PM), Paul
Boyden ,(left at 4:30 PM), Dianne Royle, Fredezict:
Rys, .lane Sheehan, Stuart Sweet
in the ;absence of Chairwoman Webb, Com. Boyden called the meeting
to order.
Relocation of Route 140: 'Com. Rys reported that he had spoken
with Dave Chareth of the Massachusetts Department of Public Worths
who told him that the State had withdrawn its appeal of. the
Commission's Order of Conditions after receiving Town Manager
Metropulos' letter assuming responsibility for installing the
culvert under Willow Street.
Little League Fields:_ Walter Day and Richard Ryan presented a
planifor the building to be erected at the Little League comples:
and gave the Commission a progress report on the project.
Mr. Ryan explained that while negotiations have ceased with the
group who initially volunteered to clear the fields, they have
made arrangements with the 483rd Engineering Battalion of New
Bedford to do this work as well as to prefabricate the roof: of
the building. While they have not yet received official approval
of this, project from the Engineers, they expect to within the
next week or so.
The plans for the six ball fields are the same. The proposed
building would be a 20 foot by 40 foot poured concrete structure
with a trussed wood roof. The structure, which is as nearly
fireproof as possible, is subdivided into a 20 foot by 20 foot
concession stand with a 1.0 foot by 20 foot first aid room and a
10 foot by 20 foot garage for storing the tractor for mowing the4
15.6 acres of grass :in the complex. This reinforced concrete
building, which will have 'a four -foot foundation, will be enclosed
by a 10 -foot Anchor' fence.' The plans call for four ;steel doors --
one entrance for the tractor, a side entrance, a rear entrance,
and an interior connecting door. The exterior of the structure
will be painted beige to blend with the wood -look asphalt roof
shingles.
At the present time, the feasibility of running electrical and
water service to the building is being explored. Com. Rys
suggested that any electrical wires should probably be underground.
Mr. Day noted that since there already are Electric Department
lc holes on the site, it would probably be easier to use these poles
for bringing the service to the building. 1i1,y)

When the berm between the. Bonvie subdivision and the Little League
complex was mentioned, Mr. Day stated that ;they plan to leave the
berm intact. Mr. Day, in response to Com. Rys's request that
the Commission be shown the proposed layout before wcrk actually
begins, stated that they would have to stake out the locations
three or four days before the Engineers arrived and that would
be a good time for the Commissioners to view the site. When
Com. Boyden suggested that any superfluous materialgenerated
be given to the Town for ,its use, Mr. 'Day very strongly main-
tained that while the plans do not call for any excess material,
the Little League should definitely share in any profit from
any such Material.
When asked for schedule of the project, Messrs. Day and Ryan
stated that work should begin in either June or July. They
could guarantee that four Fields will be completed by September
with the hope that: the remaining two would be completed early
next spring if they could not be finished this year. Given
this schedule, the Little. League hopes for Commission approval
as soon as possible.
Corres2)ondc2nce: Chairwoman Webb read the following correspondence:
1. Copy of May 8, 1980 Letter from Com. Amidon of the DPU to Com.
Cortese of DEQE withdrawing the DPU's appeal of the Commission'
Order of Conditions for the Relocation of Route 140.
2. May 19,1980 letter from Margot Jellinek expressing her opinion
that plans for the airport's proposal should include 100 -year
storm calculations rather than the two- and five-year storm
calculations used.
3. Copy of May '13, 1980 letter from Rebecca 'White to DEQE
enclosing a, locus map as well as a plan of land since there
is no plan of project; because she 'merely plans to pull stumps,
grade and seed the land for the purpose of planting it for
agricultural use. Com. Boyden mentioned that ;before the
meeting began, Rebecca White had come to the Town Hall to
request that she be put on the agenda to discuss her letter-
of intent. She is scheduled for ,7:45 PM_on Monday, June 2, 1980,
Com,. Sheehan made a motion that a copy of the Commission's
letter to Rebecca White requesting further information on
her Notice of Intent be sent to DEQE with the explanation
tial she has been scheduled fora discussion of her Notice
of intent at the Commission's next scheduled meeting on
Juuc 2, 1980. Second by Com. Royle; all in favor.

4. Copy of DEQE's May 12, 1980 letter to Rewlew Trust stating
that: their on-site inspections of Woodland Park have revealed
that work is not 'being executed in accordance with the approved
plans. 'DEQE gives the developers 60 days in which.to comply,
with the plan or the approval of the project will be withdrawn.
5, DEQE's May 12, 1980 designation of the proposed airport
project as File No. SE211-59.
Wind Chime Acres: Chairwoman Webb informed the Commissioners
that s-ee had been told that the Planning Board has asked for
and received a 31 -day extension from Mr. Bonvie during which
time they hope to hire a hydrologist to do more testing of the
area and, at the same time., Town Engineer Stanzione will supply
the Board with figures to ,support his earlier input concerning
this subdivision, After a brief discussion of the advisability
of the Commission also asking for an extension, Com. Boyden made a
mdln that the Commission immediately commence discussion of the
Orders of Condition for Wind Chime Acres and 'consider the
possibility of an extension afterwards. Second by Com. 'Sheehan
all in favor.
At this point, Margot Jellinek stated that Com. Boyden should
remove himself from the discussion because of a conflict of inter-
est due to his pond developing in Norton. Chairwoman Webb explained
that Town Counsel_ Mulcahy has stated that conflict of interest only
applies when 'there is the possibility of financial gain. 'Since'
this is not the :case, 'Com. Boyden should be included .in the
discussion. For the record, Com. Boyden noted that he ;is not at
the moment digging a pond.. Com. Rys made a motion that Mrs.
Jellinek's feelings be duly noted and the discussion resumed.
Second by Com. Sweet; all in favor.
`there followed much discussion among the Commissioners with
Ronald S. Bonvie, Dr. Jerome Carr, and Ralph Maloon supplying
requested information. Some of the main concerns expressed by
commissioners were:
1. A performance standard Ehould be exacted from the developer.
2. An ovcrali dropping of the water table beyond the subdivision
would not be a good thing.
3. Use of the rational method of figuring runoff instead of the
preferred modified soil cover concept method for an area this
large. (Dr. Carr explained that these figures were used in
the calculations but that the rational figures were supplied
because. the Planning Board requires it.)
"W1-JN3EhVA!1uN COMMISSION MINUTES PACE 4
MAY , i980
4. Any special requirements since this is a discharge area located
close to a recharge area.
5. Water_ quality testing should be an on-going requirement,
perhapsatthe spots where the streams enter and leave the
subdivision. (Dr... Carr suggested that ammonia and, nitrate
testing would be useful.)
6. The disposal of solid waste and building materials during
construction should be regulated.'
7. The following concerns were also discussed regarding the
-lots which abut the pond:
A. No filling of land beyond the 122' contour.
B. Into aquatic plants introduced into the pond without permission
from the. Commission.
C_ Maintenance of the as-builL slope of the pond.
D. No grass clippings, fertilizers, pesticides, or roac sa,
used or stored within 50 feet of the pond.
E. No motorized (or 'gasoline powered) boats on the pond to
prevent pollution. (Dr. Carr 'suggested that this might
have to be done via the Planning Board and a Town Meeting
vote.)
There was also some dialogue between the Commissioners, who had
been under the impression that the volume of water emanating
from the area would be the same before and after the subdivision,
and Dr. Carr and Ralph Maloon, who explained that while the volume
of runoff would increase the rate at which this water is run off
would remain the same.
At this point, Gilbert Powers, 5 Rustic Drive, informed the
Commission that he had found that the ditch, which is an integral
part of the pond plan, is a distance of about 22 feet from his
back property line. Mr. Powers cited Paragraph 3 of Section e,
Pond Restoration, on Page 28 of the Zoning Regulations reprinted.
in October 1979, which states that the edge of a. body of water
cannot be any closer than 50 of the property line.
Chairwoman Webb then asked Mr. Bonvie if he would be willing to
extend the date on which his Order of Conditions is due in li.ght
of the additional information just received and the need for

further input, perhaps from the hydrologist hired by the Planning
Board as well as the numbers from the Town Engineer. -Mr. Bonvie
stated that he would not grant such an extension 'since he would
prefer ;to have in hand the plan as approved by the Conservation
Commission before the Planning Board extension expires.
Com. Rys then made a motion that discussion of the Wind Chime
Acres Order of Conditions be suspended until Thursday evening,
May 22, 1980 at 7:30 PM. Second by Com. Sweet; all in favor.
Com. Sheehan made a motion that a letter be sent to the Planning
Board explaining the new information supplied by Mr. Powers and
requesting their comments on this matter before the meeting on
Thursday evening, with a copy being sent to Town Counsel Mulcahy
requesting his comments as well. Second by Com. Sweet; all in
favor,. Because of the time element involved, Com. Royle agreed
to deliver thin inter to Mr. Mulcahy personally and get -'his
comments on the matter orally.
Com. Rys made a motion for adjournment at 10:50 PM. Second by
Com. Sweet; all in favor.'
