Sheehan, Stuart Sweet Acting Chairman Boyden suggested that because of Mr. Maurer's busy schedule for the evening he be first on the agenda. Well Sites: Chad Maurer, Planning Director, presented the Town's final plan for developing two wells within Conservation Land. The land the Town must own in order to meet the requirement of owning all the land within a circular area with a radius of 400 feet around each well is divided into ten parcels. Six of these parcels, amounting to about 15 acres, belong to the Conservation Commission. iAfter discussion among the Commissioners when Mr. Maurer was called away about the futility of voting down the Town's requests and the necessity of making reasonable suggestions to insure minimal damage to the land, Com. Rys made a motion that 'before the Commission takes any action, a field')trip to the well sites should be made with Mr. Maurer. Second by Com. Sheehan, all in favor.' Mr. Maurer, who returned to the meeting at 10:20 PM to answer questions, told the Commissioners that another 50 -foot road, in addition to the Shell Oil easement in the same area, would indeed be necessary. He did say, however, that if the Commission so requested this road could probably be gravelled instead of paved'. Mr. Maurer also stated that a footpath overlooking the Canoe' -River 'about which Com. Meszoely was particularly concerned would also be disturbed to some extent. At this point, Mr. Maurer made arrangementsto conduct two walking tours of the well sites: one on Friday, March 21, at 4:00 PM for Coms. Royle and Sheehan and another for Coms. Boyden, Meszoely, Rys, and Sweet on Sunday,, March 23, at 8:00 AM. Kalnins Pro ep rty: Com. Rys. offered to conduct a tour of the Kalnins Property --the proposed: Conservation' Commission land acquisition' --on Saturday, March 22, at 9:00 AM. Com. Royle will attend. Correspondence 1. Com. Sweet made a motion that these statements be sent to Town Counsel Mulcahy for his opinion on their full legal implications. No Second. Com. Royle moved that a letter be sent to Patricia Lewis of the Executive Office of Environmental: Affairs, Office of the General Counsel, enclosing these two statements and withdrawing our appeal for an adjudicatory hearing for DEQE's Order of Conditions on ;the Henley -Lundgren project. Com. Sheehan seconded the motion since the language in the authorization statements was the very, language suggested by Ms. Lewis. All in favor. 2. Letter of March 12, 1980 to Leon Grant from Bertram M. Cook, Inspector of Buildings, citing two failures by Mr. Grant to comply with the Order of Conditions for the removal of earthen material in conjunction with the removal of material for agricultural purposes.' Com. Boyden, suggested that this letter should be incorporated into the Commissioxts Order of Conditions for Mr. Grant's pond development'. 3. Bill for secretarialservices from Patricia E. Mackay in the amount of '$100. Motion to pay this bill Com. Sweet, second Com. Sheehan, all in favor. 4. March 17, 1980 letter from Bertram M. Letter of Intent for the restoration of Cabot Pond., After the Commissioners reviewed the materials sent by Messrs. Chavaree and Willis, the Wetland Protection Act Hearing was set for Wednesday, April 2, 1980 at 8:00 PM. Minutes: Acting Chairman Boyden suggested that in the interests of saving ,;time it might be wiser to make copies of the Minutes for :March 10 and ,March 12 as well as the summary of the Leon Grant Wetland Protection Act Hearing for the Commissioners to take home with them. Proposed Town Meeting Article Prohibiting `Pond Development: At 9:00 the Commission joined the Planning Board to attend a present CONSERVATION COMMISSION MINUTES PAGE 3 March 19, 1980. given by Grace Genatossio of the League of Women Voters supporting the proposed Town Meeting Article prohibiting the development of new ponds. After Mrs.'Genatossio finished, the meeting was opened to questions from the floor. The Commission resumed its regular meeting at 10:15 PM. Constable Dick Lambos: Com. Royle reported on a telephone conver- sation she had with Constable Lambos covering several topics: 1. Maple Park Camping for Lions Club Crazy Race: Constable Lambos feels that the parking lot adjacent to the; swimming area is the only possible site for overnight camping at Maple Park but also pointed out that in May the parking lot might be quite muddy. He also suggested that the area could not accommodate more than 100 campers. He suggested the airport as an alternate site. Coin. Meszoely made a motion that the Commission send a letter to the Lions Club stating that we would allow 100 people to camp overnight only in the parking ;lot adjacent to the swimming area at Maple Park with the following stipulations: 1. Not more than 100 people will be allowed to camp at Maple Park with such camping limited to the parking area. 2. No open fires will be allowed. 3 The Lions Club will provide and remove trash receptacles. 4. Portable sanitation facilities will be provided by the Lions Club. 5. No vehicles will be allowed in the camping area or in Maple Park proper. 6. The Town By-laws regarding the consumption of alcoholic beverages on Town property should be applied. 7. Adequate police protection should be provided. F 8. No trees or live vegetation should be damaged. CONSERVATION COMMISSION MINUTES Page 4 March 19, 1980 ( with copies of this letter being sent to the Selectmen, the Police Department, Fire Department, and Recreation Commission. Second by Com. Rys, all in favor. 2.Tree Planting at Maple Park: Dick Lambos told Com. Royle that he and the Girl Scouts are planning to 'plant' 100 'pine seedlings in Maple Park. 3. Damage to Conservation Land: Constable Lambos stated that he would like to fell a tree to use as a road block to prevent 'four-wheel drive vehicles from entering Conservation Land off Maple Street. Apparently damage has been done in this area by ;this traffic. At this point it was suggested that Com. Royle invite Constable -'.Lambos to attend Sunday morning's walking tour with the Commissioners so that he would be informed of the area the Town wants for its well sites (and therefore wouldn't plant any trees there) and so that he could point out the trouble spot off Maple Street (and the Commissioners could decide on the best course of action). Maple 'Park: ;Com. Royle reported that in a conversation she had with Recreation Commission members it was mentioned that the Conservation Commission does not have :control over the parking lot and the swimming area of Maple Park but that these two specific areas are under the control of the Board of Selectmen who turn this control over to the Recreation Commission during the swimming season. Coin. Meszoely moved that Com. Royle look into these allegations and ascertain who, indeed, controls Maple Park. Second by Com. Rys,, all in favor. Seedlings: Town Clerk Arthur Remillard has asked the Commission for about one dozen seedlings to be planted behind the Town Hall. It was agreed that Mr. Remillard would be contacted when the seedlings are picked up.` Leon Grant's Order of Conditions: Acting Chairman, Boyden observed ,that it would be possible for the Commission to default in this matter and that the State would then have to write the Order of Conditions. Com. Sheehan stated that she felt it was important to keep ;local control in these matters while Com. Meszoely pointed out that the State has the experts in the fikid and the Commission does not. Com. Boyden then suggested that each Commissioner write up his own critique on Mr. Grant's pond in order to make the writing of the Order of Conditions a smoother running fob. It was also suggested that this be adopted as the F CONSERVATION COMMISSION MINUTES Page 5 March 19, '1980 usual procedure for writing all Orders of Conditions. At 11:00 PM Com. Meszoely, moved that the meeting be adjourned,'' second by Com. Sweet, all in favor.
