File No. SE211-79.

DPW, the contractor, and the Town have supplied Mrs. Kriemendahl
with pumps to temporarily alleviate her problem and that the Town
DPW lowered the overflowing stream, which had been about one foot
higher that the pipe feeding it. The Town Manager emphasized the
fact that while the Town lent assistance in this emergency, this
is a situation which must be dealt with by the State. Com.
Bonvie voiced his strong feeling that the State DPW should
immediately repair the sand bag dam and that J. T. Cronin of the
Taunton office of the DPW should be urged to do this as soon as
possible. It was agreed that Com. Bonvie should contact the Mass.
DPW to apprise them of the Commission's concern and to request
immediate action and subsequently send a letter to Mr. Cronin
confirming his conversation.
Correspondence(Cont'd :
3. December 15, 1981 memo from Town Planning Director Folkman
forwarding a copy of the Henley -Lundgren as -built plans.
The Commissioners studied the as -built plans and judged them
to be reasonably close to plans originally submitted. Chair-
woman Royle requested that if another set of plans is available,
it be sent to DEQE stating that the Commission found them to
be in order and requesting a copy of any Certificate of
Compliance issued.
4. December 28, 1981 letter from Town Counsel Mulcahy asking
to meet with the Commission to discuss Grant Pond and Kelton
Potter -East Street.
Chairwoman Royle stated that she had spoken with Town Counsel
and had suggested January 11, 1982 at 8:00 for such a meeting.
The Commissioners agreed to send a letter to Town Counsel
confirming this date and time.
Messrs. Shepard and Nelson --Pond Development: Elwood Shepard and
Carl Nelson together with their attroney, Frederick T. Iddings, Jr.
of Foxboro, appeared before the Commission to describe their
proposed pond project, which will actually be a six -acre addition
to Cabot Pond. Since they have received an agricultural exemption
from the Army Corps of Engineers, they were hoping to receive a
similar exemption from the Commission. They were given a "Request
for a Determination..." form to be filled out and Mr. Nelson
indicated that he would return the completed form to the Commission
at the next meeting. While the Commissioners' first reaction was
that based on Chapter 131, Section 40, an agricultural exemption
is not in order for this project, they decided to send a letter to
Town Counsel requesting his legal opinion on the matter.

vation Law Foundation, briefly outlining the Grant Pond dispute
and requesting her legal opinion as to whether it is within the
realm of the Conservation Commission to prohibit an applicant
from removing and selling gravel while he is in violation of a
buffer zone. Chairwoman Royle also reported that Town Manager
Maurer informed her that a request should be made to the Selectmen
for any funds for legal consultants with regard to this matter.

Arthur Stockus of Whitman & Howard, who made the presentation,
was accompanied by Town Manager Maurer. Mr. Stockus explained
that this West Church Street project is part of the Town -wide
renovations to the water system.
The 12" water main is to be placed four feet lower than and
7 - 10 feet off the face of the existing culvert, which is not
to be disturbed in any way. Although existing vegetation will
be disturbed, riprap will be permanently placed on the bottom
and banks of the stream to control erosion. Above the high water
mark, loaming and seeding will take place.
While the exact methods of construction cannot be dictated to the
contractor, use of a net downstream is one of the most probable
mahods of siltation control.
Com. Sweet voiced his concern with the decaying condition of this
culvert as well as the bridge over it. Mr. Stockus assured the
Commission that since there is not money available to replace this
bridge, the contractor will of necessity take adequate measures to
protect these structures during construction.
The hearing closed at 8:20 PM.
