(Sweet - Johnson; all in favor) VOTED Landfill/Composting Facility: James Chaney and James Small of Camp Dresser & McKee described at some length the landfill/composting area proposed to replace the existing waste water treatment plant on Fruit Street. Messrs. Chaney and Small explained that in response to input received at public hearings for this project, it was decided to plan a facility which would incorporate six months/year of composting of sludge and six months/year of landfilling sludge from the waste water treatment plant to be constructed in Norton. Three landfill sites are planned with one being used to capacity before utilizing another. This first landfill will be on line to receive the first sludge from the newly opened Norton plant. While this landfill is being used, old buildings will be torn down and replaced with the new facility. While no construction is planned within 100 feet of Back Bay Brook, an existing building within 100 feet of the brook will be used. In addition, a minimal amount of excavation will be necessary within this area in order to connect an existing pipe with the existing well. Each landfill site will be situated on a synthetic nonpermeable liner and surrounded by perforated pipe which will collect all runoff and direct it back to the waste water treatment plant. Upon reaching capacity (about 18 feet high) the landfills will be covered with a 36 ml. thick nonpermeable bentinite and then loamed and seeded. Messrs. Chaney and Small stated that even when all three landfills are covered, the peak flows at a 100 -year storm will be lower than those presently experienced since effluent infiltration now occurs during such storm conditions. The repre- sentatives of Camp Dresser & McKee expressed their belief that not only will the new system eliminate effluent inflitration but it will also provide a more desirable disposal of sludge than that presently practiced. MOTION: To send a letter to Messrs. Chaney and Small thanking them for their informative presentation and informing them that no Wetlands Protection Act Hearing will be necessary for the work to be performed within 100 feet of the Back Bay Brook, as described by them, since the f pipe they propose to install will not alter or change the present elevation of the land and asking them to notify MANSFIELD CONSERVATION COMMISSION MONDAY, FEBRUARY 8, 1982 MINUTES PAGE TWO the Commission of any major changes in the plans. (Sweet - Johnson; all in favor) VOTED Correspondence: 1. February 1, 1982 letter from Town Counsel Mulcahy forwarding a copy of Attorney O'Brien's proposal for the solution of the Grant Pond situation. It was agreed that Chairwoman Royle would talk with Town Counsel Mulcahy and Judy Pickett, Counsel for the Conservation Law Foundation, about the Commission's discussion concerning: (1) the Commission's inability to issue a Certificate of Compliance on the Order of Conditions for this project; (2) the contention that an extension permit cannot change an Order of Conditions; and (3) the possibility of holding another Wetlands Protection Act Hearing for Grant Pond. Compo Chemical: It was agreed that a letter would be sent to Compo Chemical requesting that the following concerns be addressed at the continuance of their hearing on February 22, 1982: (1) prevention of groundwater pollution; (2) contingency plan for dealing with contaminated water used in fire fighting; (3) method of dealing with spills (grease traps, impervious catch basins?); (4) an inventory of the chemicals used at the plant. A memo will also be sent to Fire Chief Leonard, Board of Health Chairman Tartufo, and Director of Public Health Walsh inviting them either to attend the continuance of Compo's hearing or to provide the Commission with written comments and/or questions to be read at the hearing. Budget: Chairwoman Royle reported on her meeting with the Finance Committee concerning the Commission's budget for next year. While the Commission requested $2,500, Town Manager Maurer is recommending that $1,200 be allocated for Commission fees and expenses. Funding for Conservation Land Acquisition: Chairwoman Royle also reported that Town Manager Maurer has indicated that he is considering a recommendation to Town Meeting that the $11,139.60 reimbursement for land purchased for future well exploration requested by the Commission be transferred from the "Conservation Land -Willow Street" account. It was the consensus that the Commission should oppose such a recommendation. Chairwoman Royle suggested that since this money is actually a Great Woods Study Committee account, it would be advisable to discuss this matter with Marydee Flynn, Chairwoman of the Great Woods Study Committee. MANSFIELD CONSERVATION COMMISSION MONDAY, FEBRUARY 8, 1982 MINUTES PAGE THREE DEQE: Chairwoman Royle passed on the following information supplied by Chris Tilden: 1. Land subject to flooding can fall within the jurisdiction of the Conservation Commission. It was therefore suggested that the Brown Property on Balcom Street might have to be reconsidered. 2. An affirmative determination of the applicability of the Wetlands Protection Act cannot be appealed. MOTION: To send a letter to Messrs. Shepard and Nelson explaining that there can be no appeal of the Commis- sion's decision that a Wetlands Protection Act Hearing will be required for their pond development and reminding them that they are still under a Cease and Desist Order that prohibits any further work until a hearing is held and an Order of Conditions issued. (Johnson - Sweet; all in favor) VOTED Guidelines: Com Johnson urged the Commission to adopt guidelines, including a checklist, for filing a Notice of Intent and for making a presentation at a hearing. It was the consensus that this might enhance the Commission's authority in the interim before a bylaw is adopted. Army Corps of Engineers: Chairwoman Royle informed the Commission that Stephen DiLorenzo of the Army Corps of Engineers has told her that the agricultural exemption issued by the Corps for the Shepard/Nelson pond development was in error and that the Corps is planning to revoke the exemption. Furthermore, the Corps has yet to make a decision concerning Grant Pond and Willis Pond. It was agreed that a letter should be sent to Mr. DiLorenzo (1) confirming this information; (2) requesting an invitation to the Corps meeting concerning Mansfield pond development; and (3) forwarding a copy of the Commission's Order of Conditions and hearing summary for. Willis Pond. Conservation Land: Chairwoman Royle informed the Commission that Russell Christian is planning to donate three-quarters of an acre of land off School Street as Conservation Land. Adjournment: MOTION: To adjourn this meeting at 11:15 PM. (Durbano - Bonvie; all in favor) VOTED Accepted byyf((il(i) Date to Town Clerk 21,-/-f.z-_
