MANSFIELD CONSERVATION COMMISS MINUTES
MONDAY, JUNE 7, 1982AGE ONE

gSL
Members Present: Chairwom DiaEKC e, Coms. Anthony Durbano,
Ronald nvie, th Johnson
Chairwoman Royle called the meeting to order at 8:00 PM.
Health Agent Walsh:
Spraying Railroad Right of Way with Herbicides: Health Agent
Walsh explained that each of the herbicides to be used has been
approved by the EPA and that if the directions for each substance
are followed carefully, no serious harm should be done. Although
it probably is the policy not to spray over wetland areas, Mr.
Walsh suggested that a reminder that these herbicides should not
be sprayed near brooks, streams, etc., might be in order.
Salt Storage Shed: Health Agent Walsh stated that he is more
concerned with the 99% of the salt which is spread over the roads
of Mansfield as a hazard rather than the 1% of the salt which may
leach out of the salt storage shed. Mr. Walsh informed the Commission
that the Board of Health has written to the State Highway Department
declaring the cones of depression of all our wells as salt sensitive
areas and requesting that the State reconsider its salting policy
on Routes 95, 495, and 140. Health Agent Walsh explained that his
sodium testing of surface puddles in the vicinity of the salt
storage shed was inconclusive. When Chairwoman Royle asked if
the salt storage shed in its present location is a health hazard,
Mr. Walsh stated that he feels it does not pose such a hazard.
Mrs. Jellinek, on behalf of the League of Women Voters, expressed
a continuing concern with the present location of the salt storage
shed and requested that the Commission determine whether or .not
this shed requires a Wetlands Protection Act Hearing. Health
Agent Walsh noted that he had invited DEQE to inspect the salt
storage shed and they did not suggest that it be moved.
East Street Pig Pen: Health Agent Walsh informed the Commissioners
that the unheeded request to remove this pig pen (through which a
stream flows) has been turned over to Town Counsel for legal action.
Upon checking the aquifer map, the Commissioners noted that this
pig pen is probably situated within the Dustin Well aquifer area.
County Street Pollution: Health Agent Walsh informed the Commission
that after discovering an oily substance when conducting a perc
test, DEQE was called in to investigate and, under instructions
from DEQE, Hathaway Patterson is presently conducting a study to
determine the amount of groundwater pollution, with the next step
being to clean the groundwater. When asked whether Hathaway
Patterson would be held responsible for all groundwater pollution
in the area, Mr. Walsh noted that such pollution might not be
completely attributable to Hathaway Patterson since he has been
told that a railroad roundhouse formerly occupied this area. Mr.
Walsh mentioned that Clemmey Tank has also been requested to remove
the scrap metal, etc. dumped in the vicinity.

through this farm to determine the amount of contamination caused
by the horse farm.

5. May 24, 1982 letter from the Corps of Engineers to Leon Grant
stating that Mr. Grant must either remove the fill placed in
the wetlands adjacent to his pond project, in excess of that
which is exempt from the Corps' jurisdiction, or apply for a

"Owners Unknown" Parcel: Chairwoman Royle informed the Commission

6.2 -acre parcel valued at $12,400.

Lincoln Holske - File No. SE211-70: Chairwoman Royle explained the
sequence of events which lead up to a request by Lincoln Holske et
al and subsequently by their attorney, Robert Currivan, that the
Commission sign a statement indicating that the Order of Conditions
issued by the Commission on February 23, 1981 for this project did
not apply to Lots 272, 260, or 288 of this land. In view of the
circumstances (i.e., Chairwoman Royle was not able to gather a
quorum for an emergency meeting; the release requested by Atty.
Currivan merely stated the fact that these particular lots were
not affected by the Commission's Order of Conditions; and a
scheduled sale closing had already been delayed by this legal snafu),
Chairwoman Royle agreed on June 3, 1982 --and only because of the
extraordinary situation --to sign this statement. Coms. Boyden,
Bon -4e, and Durbano also signed this statement.
Patricia M. Langmeyer - Oak Street: Chairwoman Royle stated that
she and Com. Boyden had viewed the site and discussed the project
with Mrs. Langmeyer and felt that a Wetlands Protection Act Hearing
would not be necessary for the proposed work.
