servation Commission that was borrowed by the Board of Selectmen

missioners were better prepared.
2. December 17, 1982 Memo from the Town Manager with a copy of a letter from
Bristol County Mosquito Control regarding proposed changes to the Pesticide
Board's regulations requesting the Commission's comments for the Board of Se-
lectmen's next meeting. Since the Conservation Commission's next meeting was
not scheduled until January 10, 1983, a letter was sent to the Board of Select-
men on December 22, 1982, requesting a delay in our response until such time
as the Commissioners could meet to discuss the issues.
3. Draft of a December 21, 1982 Memo from Health Agent. Drown to the Board of
Selectmen stating that the regulation changes for the Bristol County Mosquito
Control Project should remain unchanged.
4. January 5. 1983 letter from the Board of Health stating that their position
was the same as their Health Agent's regarding the Mosquito Control Project.
Following are the comments of the Commissioners regarding this project:

mously on both changes.

Edward Tartufo - 9 Brookside Roads Mr. Tartufo came before the Commission to
question what steps he would need to take to pipe a section of his property in
order to drain the water from a 10' deep ditch in his back yard. His property
basks up to a drainage ditch.
MOTION: That a Wetlands Protection Act Hearing be held for the installation
of this drainage pipe.

W. Chadwick Maurer Jr.s Mr. Maurer met with the Commissioners to discuss two
items; 1. The Town Gravel Pit and 2. The Budget.
1. The Town Gravel Pit: In response to a letter from the Conservation Com-
mission questioning the cutting of trees near the Town gravel pit and the
steepness of the slopes in the pit, Mr. Maurer stated that the trees are being
cut within the 100' boundary established by the Selectmen for Town -owned land.
He also stated that the steep slopes in the gravel pit will be taken care of.
2. The Budget: The Town Manager informed the Commission that the repayment
of the Conservation Commission's $11,139.60 loaned two years ago to the Board
of Selectmen for well exploration was not likely due to the status of the Town
Budget. The proposal for repayment of this loan would most likely come from
the Water Department whose financial status is tight, thus the unlikelihood of
reimbursement. Chairwoman Royle expressed her displeasure over the fact that
Conservation has such a low priority, as evidenced in its placement in the order
of Warrant Articles; all this despite the fact that the Town has received
$100,0..1 iu Self -Help Funds following Conservation Land purchases.
Mrs. Jellinek - Michael Angela Subdivisions Mrs. Jellinek came before the Comes
mission with copies of the Notice of Intent, Environmental Notification Form,
and Drainage Calculations for the proposed subdivision on Summer Street in
Foxboro. A copy of a letter from the Dept, of Soil Conservation was shown,
stating that the soils in this area are rated as having severe limitations for
septic systems and may lead to introduction of waste in the groundwater. Dave
Risch contacted Chairwoman Royle to inform her that a Wetlands Protection Act
Hearing will be held on Tuesday, January 18, 1983 at BsOOPM in Foxboro for this.
Mansfield Conservation Commissioners will attend this clearing, along with Mrs.
Jellinek.
**Commissioner Ronald Bonvie leaves the meeting at this time,
Mr, Kelton Potter - Back Bay Brook Relocation: Mr. Potter informed the Commis-
sion of the sale of his 48 acre parcel of property off Branch Street and the
30' easement between lots G and H to Bonwood Corporation. He questioned the
legalities of an Order. of Conditions when property is sold; as it pertains to
the Order of Conditions given by the Conservation Commission for the relocation
of the brook on this property. The Commission informed Mr. Potter that the
Oder of Conditions follows the Deed and as Bonwood Corp, is the present owner
of the Deed, they are therefore responsible for the fulfillment of the Orders,
Nr. Potter questioned whether a copy of the Order of Conditions should be given
to Bonwood-or if it is automatically deeded along with the property, Chairwoman
Royle stated that she would ask if Bonwood Corp. needed a copy of the Orders,
The Commissioners agreed that Mr. Potter should send a letter to the Commission
requesting a One -Year Extension of the Order of Conditions for Back Bay Brook
Relocation, File No, SE211-65,
** Commissioner Bonvie returns to the meeting,
Chairwoman Royle informed the Commissioners that she went to Court for the Curven
Piggery on Fast Street and it is being continued to January 26, 1983, Town
Counsel Dwyer is setting up a time for January 15th for an on-site inspection
of the piggery before going to Court again.
