MANSFIELD CONSERVATION COMMISSION MINUTES MONDAY, SEPTEMBER 269 1983 PAGE TWO Correspondence 1, September 9 letter from James C. Colman, Office of Incident Response, DEQE, to the Commission regarding our letter to Commissioner Cortese on the Hathaway and Patterson situation. Commissioners Durbano, Johnson and Webb made an inspection of the Hathaway and Patterson site on September 19. Chairwoman Royle and Karl Drown, Health Agent, also made an inspection of the site on September 21. Mr. Haynes was ordered by the Commission to remove unsuitable materials (barrels, steel, rubber tires, etc.) from the wetland area. Upon the inspection by members, it was found that this material bad only been bulldozed around, barrels and steel had been buried, trees had been cut down within 100 feet of the wetland and that a definite chemical odor emitted from the ground. It was also noted by Mrs. Royle that the water in the wetland had an oil film on it, and that the recovery unit was not working. Chairwoman Royle received a call from Chris Tilden, DEQE Hazardous Waste Division on September 22. They discussed the wetland violation and the recovery system. Mr. Tilden told Mrs. Royle that they will "shift gears for cleanup." He mentioned the possibility of removing the soil, at which time the cleanup may be considered under the Superfund. After considerable discussion of this situation, it was agreed by the Commission to send a letter to Town Counsel with advice on court action to have Hatheway and Patterson remove the unsuitable materials from the wetland area. It was also agreed to send a copy of this letter to the Board of Health suggestiig that they pursue the pollution problem. These letters will be accompanied by background correspondence from our files. MOTION: To send a letter to Town Counsel with advice on court action to remove the unsuitable materials in the wetland area on the Hatheway and Patterson property, with a copy to the Board of Health suggesting that they may pursue it and that they may have more statutory clout. Telephone Calls Chairwoman Royle received a telephone call from a surveyor who wishes to install a private well for home use within 100 feet of a wetland. This well has to be at least 100 feet from the septic system. The wetland is not on the house lot, however, it is still within 100 feet of the wetland. The surveyor suggested he could put the well elsewhere, but preferred to put it where he now plans. Mrs. Royle raised the question to the Commission if the surveyor would need to have a hearing to put in this well. Commissioner Johnson felt the well would not drain the wetland very much. He also felt there would be no disturbance to the wetland due to construction of the well. No decision on this question was made. Chairwoman Royle agreed to wait for further information from the surveyor as to his final decision of where the well will be dug on the lot.
