Fireside Realty Trust V - SE211-110 Order of Conditions After inspection of the site and review of the plan, Commissioners agreed to deny.without prejudice File No. SE211-110 due to the following concerns and discrepancies in the plan submitted: 1. The Conservation Commission has determined that on Lot 24 more than 5,000 sq. ft. of wetlands shall be filled. The 4,600 sq. ft. shown on the plan does not accurately 'include the total wetland area (the filling of a brook to be included in the 5,000 sq. ft.). The wetland area on Lots 20 and 16 is not indicated on the plan. 2. Section 10.55 4bl of the Wetland Protection Act Regulations states: "the surface of the replacement area to be created shall be equal to that of the area that will be lost." Due to severe increase in the surface area of the compensatory storage, resulting evaporation and percolation could result in the loss of wetlands downstream. 3. No typical cross-section of the existing ditch is provided. The proposed ditch cross-section conflicts with statements made at hearing, i.e., slopes. When a new plan addressing these concerns is submitted, a new bearing will be required. ELD MONDAY, APRILS23, 190844 COMMISSION MINUTES ETTWO i MOTION: To deny without prejudice File No. SE211-110.
