Commissioner O'Neill voiced concern regarding two special
conditions listed in the Superseding Order of Conditions for
Matthew Estates, which the Conservation Commission denied in
May. The two conditions are: No. 3 "The water -oil separator
on Lots 7 and 8 shall be inspected and cleaned a minimum of twice
a year. Prior to the commencement of the project, the applicant
shall secure a maintenance contract with a licensed hazardous
waste hauler capable of providing this service. A copy of the
agreement shall be sent to the DEQE and to the Town of Mansfield's
Highway Department and Conservation Commission." No. 6 "The use
of de-icing chemicals (other than sand) shall not be permitted
on any portion of the roadway known as Jacob Drive." Commissioner
O'Neill felt Order No. 6 could not be enforced, and the State was
not taking into consideration the drainage from the subdivision
going into the Wading River. He made the following motion, which
was later withdrawn:
MOTION: To file a notice of a claim for an
Adjudicatory Hearing on the decision
made by DEQE relative to the Javitch
property, for Superseding Orders
No. 3 and No. 6 (File No. SE211-126).

Superseding Order of Conditions - SE211-126
Ann Louise Javitch - Matthew Estates
Commissioner O'Neill remade his motion to file for an Adjudicatory
Hearing for File No. SE211-126; it was opposed by Commissioner
Mahoney, Commissioner Ouellette abstained, and Chairman Durbano
opposed the motion. The possibility of drainage filtering through
a detention area was mentioned. Chairman Durbano stated that a
detention area would not filter out salt or other water-soluble
materials. Chairman Durbano also mentioned that once the Order
of Conditions have been complied with and the road is turned
over to the town, it becomes the responsibility of the town.
Mr. Maloon mentioned that an adjusted plan has been sent to the
state. The plan includes an oil/water separator. Commissioner
O'Neill felt it important to notify the Board of Selectmen of
the Superseding Order of Conditions, in particular: the use of
oil/water separators and the use of de-icing materials on the
road. Commissioner Mahoney revised Commissioner O'Neill's
motion to the following:
MOTION: We agree to sponsor a warrant for the
Town Meeting for an oil/water separator
