The second Order informs Mr. Grant that he must submit a Notice of Intent for this project within 21 days. That Order was issued on September 11, 1985. 3• Memo from Board of Selectmen regarding a Joint Board Meeting on industrial zoning, scheduled for October 9 @ 8:00 p.m. 4. Copy of Certificate of Compliance issued to The Bonwood Company from the Department of Environmental Quality Engineering (DEQE) for File No. SE211-57• Raymond Goddard Mr. Goddard voiced concern regarding the two Enforcement Orders issued to Leon Grant. Mr. Goddard submitted a Request for a Determination of Applicability to the Conservation Commission regarding wetland violations on Mr. Grant's property. The Commission did not make a Determination, under advisement of Town Counsel Dwyer, because Mr. Grant would not allow the Conservation Commission to inspect the property. The DEQE made the Determination and sent copies of the Enforcement Orders to Mr. Goddard. MANSFIELD CONSERVATION COMMISSION MONDAY, SEPTEMBER 16, 1985 MINUTES PAGE TWO On the first Order, the DEQE gave Mr. Grant until June 1, 1986 to remove the stockpiled material away from the pond, and until February 27, 1986 to remove the pile of felled trees. Mr. Goddard feels this an excess of time allowed to Mr. Grant. He stated he would like to appeal this decision and would like the support of'the Commission in his appeal• After a brief discussion, the Commission agreed to support Mr. Goddard.. The following motion was made: MOTION: To support Mr. Goddard's appeal. (Mahoney -Sweet; O'Neill abstained) VOTED The Conservation Commission will send a letter to the DEQE stating the above. Joseph Zeneski - DPW Director The Conservation Commission was requested to look into the work being done on the regional interceptor on Cobb Street, At the meeting of September 9, Mr. Karl Clemmey complained the town was encroaching on his property in their excavation for the interceptor, and that trees have been cut, with stumps left, and water was pumped onto his land. He wanted the Commission to issue a Cease and Desist Order for what he felt was a violation. He also wanted to know why he was not notified of the proposed work. Mr. Zeneski stated to the Commission the! -work was within the public right-of-way, thus it was not necessary to notify abutters. Mr. Zeneski also mentioned to the Commission that a temporary culvert was installed pumping water to the Back Bay Brook. The Commission was not aware of this culvert. Mr. Zeneski mentioned the water level was low and felt no problems would occur. Chairman Durbano felt the culvert was too high and would cause water to backup on the northerly side of the road. Mr. Zeneski stated the culvert would be removed shortly and the area graded, and the water drained into the storm drainage system. Mr. Zeneski was asked by the Commission to remove the culvert and stabilize area, and to remove the wells not required. Mr. Zeneski is also to remove stockpiled material and clean up area. Mr. Zeneski will send a letter to the contractor. Mr. Clemmey voiced his dissatisfaction and felt the town was wrong and what they did was illegal. Chairman Durbano mentioned to Mr. Zeneski that the culvert near 1264 East Street was heavily clogged causing water backup. He asked that the DPW Director looked into the matter. He felt everyone was in agreement with this decision. However, when the Determination was made, members voted to issue a positive determination thereby ordering Mr. Vadala to submit a Notice of Intent for his proposed work. Chairman Durbano felt Mr. Vadala's previous work altered an Area Subject to Protection Under the Act, but he is now restoring the area. Commissioner Ouellette asked the Chairman how the Commission would enforce the grading and sloping conditions as were discussed on site. The Chairman felt it could be defined on the Determination form. He also felt Mr. Vadala was not altering a wetland. Commissioners Mahoney, O'Neill and Ouellette felt that if a negative determina- tion was made by the Commission, the conditions defined could not be enforced, therefore, the following motion was made: MOTION: To issue a positive determination No. 3• (O'Neill -Mahoney; Sweet abstained) VOTED Order of Conditions - SE211-131 Home Developers, Inc. - Maple Street 1.
