(O'Neill -Sweet; all in favor) VOTED Wetland Protection Act Hearing - No File Number Daniel Lenihan - West Street The Wetland Protection Act Hearing on the Notice of Intent dated December 4, 1985 opened at 8:30 p.m. Mr. Lenihan's proposal is to level bank of Greenwood Lake along his property and to lay down approximately 4 tons of sand. Mr. Lenihan has already done this. For the record, on September 23, 1985 a positive determination was made requiring Mr. Lenihan to submit a Notice of Intent for his proposed work. As of November 18, 1985,Mr. Lenihan failed to submit the Notice of Intent. On that date, the Conservation Commission agreed to issue an Enforcement Order against the title of his property. The Enforcement Order stated, "wetland alterations resulting from said activity shall be corrected and the site returned to its original condition." The Enforcement Order was filed at the Registry of Deeds. At tonight's meeting, Chairman Durbano felt the main issue was the isolated cove and the assurance that the flow of water be maintained. Commissioner Mahoney mentioned that the level of the bank has been changed, thus impacting the cove. Mr. Lenihan stated about 4 inches of muck was removed before the sand was put down. The material removed was pushed back on the land with some of it being taken off the site. Commissioner Sweet felt that where the sand goes onto to dry land is definitely above high water mark. Mr. Sweet also felt a reasonable approach to correcting the situation at this time would be to establish a point back to where the original edge was and to grade a line and reestablish the high water shoreline. If was felt Mr. Lenihan could do this work in the late spring or early summer when the water level is high. Chairman Durbano felt the channel between the island and peninsula should be cleared of debris. h';r. Lenihan is to come before the Commission before any work is started. =' he r1nl; closet 8:4 p.m, 1h2 i.;'aer of Uondrtions well be written w'.,en .. file n1:110er is `ceived. +11 zees have 'oeen 3 paid.
