Mansfield Conservation Minutes ;>`_Lr. , 1-
July 24,2017 1 U.
Present: Michael Healey, Chair; Matthew Rieth; Jack Smith; Ryan MAWOIly'Kateln (V'dn"r, -6nservation and
Environmental Planner. r)
1. Conservation meeting called to order at 7:00 pm.
2. Request for Certificate of Compliance: Craig Cygawnoski, RIM Engineering Co., Inc., 39 Lantern Lane, Map
15, Parcel 146.
Craig Cygawnoski, RIM Engineering Co., Inc., and homeowner Michael O'Brien were present.
Ms. Gonyer explained the Order of Conditions under DEP SE 211-0949 was issued in September 2015 for the
construction of a full foundation, addition, garage and deck; as part of the conditions, an existing paved
basketball court, partially located on town -owned land and within the Riverfront of Hodges Brook, was to be
removed and the area stabilized and left to naturalize. An As -Built Plan, "SE 211-0949 Certified Plot Plan of
Land in Mansfield, MA" dated June 19, 2017, was submitted, showing the basketball court has been
removed.
Craig Cygawnoski said the fence and concrete posts surrounding the basketball court were left in place
because it was determined it would cause more damage to pull them out.
Ms. Gonyer recommended a full Certificate of Compliance be issued.
Mr. Maxwell made the motion to issue a full Certificate of Compliance to Michael O'Brien, 39 Lantern Lane,
DEP SE 211-0949. Mr. Rieth seconded the motion.
Motion passed 4-0-0.
Hearing ended at 7:12 pm.
3. Request for Determination of Applicability: Melanie Jacques, 325 Balcom Street, Map 2, Parcel 100.
Application was filed for septic system and roof drainage upgrade within 100 feet of Bordering Vegetated
Wetland.
Craig Cygawnoski, RIM Engineering Co., Inc., said the homeowner is trying to sell the house but failed a Title 5
inspection. He said the existing septic system is located behind the house within 25 feet of the wetland area;
the new system will be moved to the side of the house as close to the road as possible.
Ms. Gonyer said the limit of disturbance in the back yard is the 25 -foot No -Disturb Area and the leach pit will
be moved to the side yard within the existing lawn area. She noted erosion control is shown on the plan
"Upgrade Sewage Disposal Plan for No. 325 Balcom Street in Mansfield, MA" dated June 19, 2017. She said
the upgrade to the septic system is a benefit.
Mr. Cygawnoski said the existing cesspool located at the 25 -foot No -Disturb line will be removed or crushed
in place.
1
Mr. Rieth made the motion to issue a Negative Determination for reason #3, work will not alter Resource
Area, to Melanie Jacques, 325 Balcom Street, Map 2, Parcel 100, for septic system and roof drainage upgrade
within 100 feet of Bordering Vegetated Wetland, in accordance with the plan "Upgrade Sewage Disposal Plan
for NO. 325 Balcom Street in Mansfield, MA" dated June 19, 2017, with the following Special Conditions:
• The Agent is to inspect the siltation control (per plan) prior to the start of work. Silt sock must be
mulch. Silt sock may be 8" diameter (min.);
• All disturbed areas are to be seeded as soon as possible. Erosion Control must remain in place until
all areas have been stabilized.
Mr. Smith seconded the motion.
Motion passed 4-0-0.
Hearing ended at 7:16 pm.
4. Request for Determination of Applicability: Michael A. Trowbridge, 10 Ephriam Drive, Map 43, Parcel 124.
Application was filed for the construction of a front porch and stairs within 100 feet of Bordering Vegetated
Wetland.
Ms. Gonyer said this application was originally reviewed to see if it qualified for an Administrative Review
(AR), but the increase, 288 square feet, was over the 200 square -foot maximum outlined under the AR
procedure. Ms. Gonyer noted the covered porch will require new sono -tubes and all proposed work is
outside the 50 -foot area, on a previously developed lawn area. She said the plan shows erosion control, silt
socks, to be installed.
Mr. Healey asked that there be no stockpiling of materials on site.
Mr. Trowbridge said there is no real need for the silt socks because the area is flat and stable, but they will be
put in place for the purpose of defining the work area.
Mr. Maxwell made the motion to issue a Negative Determination for reason #3, work will not alter Resource
Area, to Michael A. Trowbridge, 10 Ephriam Drive, Map 43, Parcel 124, in accordance with plan
"Conservation Plan 10 Ephriam Drive" dated June 28, 2017, with the following Special Conditions:
• The Agent is to inspect the siltation control (per plan) prior to the start of work. Silt sock must be
mulch. Silt sock may be 8" diameter (min.); silt fence or snow fence may be used on the side limit of
work to delineate the work zone;
• All disturbed areas are to be seeded as soon as possible. Limit of work must remain until areas have
been stabilized.
Mr. Rieth seconded the motion.
Motion passed 4-0-0.
Hearing ended at 7:23 pm.

S. Notice of Intent: Kevin Dumas, City of Attleboro — Water Department, Blake's Pond Dam at 250 Balcom
Street, Map 3, Parcel 94. DEP SE 211-0968
Application is for the rehabilitation of Blake's Pond Dam within 100 feet of Inland Bank, Bordering Vegetated
Wetland, Land Under Water, Bordering Land Subject to Flooding and 200 -foot Riverfront Area. Hearing was
continued from June 19, 2017.
Derek Schipper, GZA GeoEnvironmental, Inc., representing the City of Attleboro, was present.
Ms. Gonyer said at the June hearing the Commission heard from Mr. Schipper regarding the repair and
rehabilitation of the Blake's Pond Dam. Mr. Schipper reviewed the scope of the work, the installation of
another sheet piling wall in front of the existing dam, as well as the methodology, and construction
sequence. Ms. Gonyer said at that time there were some questions as to how to set the elevation and if it
would be advantageous to raise the top of the dam elevation to the FEMA Flood Plain Zone; because this is a
flood prevention dam, the elevation will be kept at the existing 130.3'.
Ms. Gonyer said the Commission asked for a more detailed Water Control Plan, to be submitted after the
Orders have been issued, but prior to the start of the work. Mr. Schipper said the contractor will be required
to put together a Water Control Plan for the project and the plan will be reviewed by the Office of Dam
Safety. Ms. Gonyer will meet with the contractor for a pre -construction meeting.
Ms. Gonyer said Richard Alves, Town Engineer, reviewed the hydrology and calculations and was fine with
the FEMA Flood elevation, but he did question if the pumps for the dam would be silent because this is a
residential neighborhood; Ms. Gonyer noted this should be specified in the Water Control Plan. Mr. Schipper
said he would anticipate a minimal pumping area with 2 -inch pumps.
Ms. Gonyer questioned the two-month work time frame; she had discussed with Mr. Healey about having
the contractor or a wetland scientist on site to submit weekly updates to the Commission, how often they
would need to be submitted, as well as the number of site visits necessary. Mr. Schipper explained the time
frame includes the setting up of equipment, preparing the site and the installation of erosion controls, so the
actual rehabilitation work could be done in three weeks. Mr. Healey said because of the sensitive nature of
the site, reports should be submitted a minimum of once a week, with reports submitted twice a week and
possibly three times a week during certain phases of the work.
Ms. Gonyer asked that signage be installed for the trails coming from the residential portion of the property.
She said Mr. Schipper was given a draft of the Order for review.
Mr. Healey read into the record the Special Conditions for this project. He also read into the record an e-mail
from Sandy and Bob Hayes, 224 Balcom Street, who expressed their concerns about the wetlands on their
property and wanted to make sure there would be no changes to the flood plain. A letter was sent to Mr.
and Mrs. Hayes from Derek Schipper on behalf of GZA, addressing their concerns.
Ms. Gonyer questioned the erosion controls because the plan shows only the limit of work. Mr. Schipper said
the erosion controls, 12" silt socks, are shown on Sheet C1. Ms. Gonyer said 8" silt socks can be used, staked
outside the sock, as opposed to actually puncturing the silt sock. She asked if there would be any type of
demarcation along the limit of work or would the path just be cleared. Mr. Schipper said they are simply
pruning the brush and removing small saplings to provide access for vehicles.

Mr. Rieth made the motion to issue the Order of Conditions to Kevin Dumas of the City of Attleboro's Water
Department, for the rehabilitation of Blake's Pond Dam at 250 Balcom Street, DEP SE 211-0968, for the
rehabilitation of Blake's Pond Dam with the following Special Conditions under the Mansfield Wetland
Protection By -Law, Chapter 220:
1. No work can be started until the Order of Conditions has been recorded with the Bristol County Registry
of Deeds and the receipt of the Order is returned to the Commission filled in by the Registry.
2. All work must conform to the site plans titled "Proposed Blake's Pond Dam Rehabilitation', prepared by
GZA GeoEnvironmental, Inc., prepared for the City of Attleboro referenced and detailed below:
