Conservation Commission under Section 40 of Chap- ter 131 of the Massachusetts General Laws including any and all conditions imposed by the Massachusetts Department of Natural Resources. Any amendments to that plan would be approved jointly by the Mansfield Conservation Commission, the Massachusetts Department t of Natural Resources and the Mansfield Planning Board. (3)_ ''.Phe design of the outfall system should be such that the elevation of the skating pond not be lower than 137 feet above mean sea level. (4) That stumps, logs and scrub growth in the skating pond be removed prior to completion of construction of the drain- age system, (s) ^'hat an impervious layer of clay be placed at the outfall side of the skating pond at the easterly end thereof to prevent leakage. (o) That. due to the fact that the drainage system on the Town of Mansfield property is on the downstream side, the Coarumission will require the construction of all of the elements on Town property prior to receiving channelled surface water from the Developer's property in order to prevent :interim damage to Town of Mansfield property prior to the completion of the drainage work on Town of Mansfield property, (7} That Aany construction to the drainage system on Town of Mansfield property shall be in compliance with Section 40 of Chapter 1.31 of the Massachusetts General Laws. (o) That prior to..construction ::on Town property; the ,.Developer would: be responsible for the staking out of the enact (9) That no portion of the performance bond held by the Planning Board covering drainage work on Town of Mansfield property he released until such time as the Commission has been properly notified of the intent to release and has reviewed the site and formally votes to release the bond.
