at '131 North Main Street in the Town Office Building.
Present: Chairman Jones, Comm. Debbie Button, Comm. Charles Meszoely,
Comm. Paul Boyden, Comm. Pete Mason, Comm. Walter Nelson
Chairman Jones questioned if everybody had had enough time to really
review the situation so that they could send a recommendation to the
Department of Natural Resources or if they would rather Waite and take
a :vote on it at. another date. Commissioner Mason stated that he would
just as soon take the vote on this now.
Comm. Boyden stated that before taking a vote he would like to open
this matter up for further discussion because the excavation of the
pond is a conservation matter. Comm. Boyden stated that he felt that
they could allow him to excavate the area but he would like to know
what the states standards for insurance on the water supply were, as
he felt the future water supply for the Town of Mansfiled would be
coming from that area. Comm. Boyden stated that he is in favor of
the site but he was just wondering about the water supply.
Chairman Jones questioned who would be able to give them the figures
on.the water supoly. Comm. Button stated that it would probably mean
engineering the whole area. It was noted that the area was already
approved for the septic systems.
Gomm. Mason noted that Mr, vonsalves plans !:o build 60 units now and
the other 60 will be constructed sometime in the future, and that upon
questioning how far the sewer was from the river it was noted that
It would be about 300 feet from either the Canoe River or Mill Pond.
Comm. Boyden questioned what the outlay was on this and that he would
still like to check further on the site. Comm. Button questioned what
that would have to do with the hearing. Chairman Jones noted that
the only thing they were to be concerned with was what was in Chapter
131. Comm. Mason stated that you can't consider the insurance value
of it. That is not specific to the Match Acta Is there any involve-
ment to the Hatch Act. Chairman Jones noted that Mr. Gonsalves is
asking their permission to excavate the pond, and that he would be
restoring the dam at the outlet.
Comm. Meszoely stated that he would like to see a certified high water
report to see what the excavation of this dam would be on the water
supply and water shed in that area. Chairman Jones stated that the
State would be doing that with their plans.
Comm. Meszoely stated that Mr. Gonsalves is entitled to the river, but
when you start fooling around with lakes that it is a conservation
matter and that he was not satisfied with this explanation on it.
Comm. Meszoely stated that he was completely unhappy with the site. d
Chairman Jones stated that they were lossing the meaning of the Hatch
Act. This plan is not a horsing project. There is -going to be con-
tamination of the soil. There co,cern is that he is either in violation

Chairman Jones stated that Mr. uonsa7.ves has to comply to the Hatch
Act as far as what he is going to do. He has complied to height
from the water to the bottom of the bridge. He has given the locationlocated
of the bridge. The state has approved the septic system.
It so as not to contaminate the pond. We don't know what impac4- the 3
