Acceptance of Fred Basch's resignation asp 2. Discussion of Fulton Pond Gravel Removal New Business: 1. Finance Committee officially acknowledged Fred Basch's resignation with deep regret. Fred has served faithfully on the Committee for the past three years both as a memberrand as Chairman. Fred had the distinction, not born by many individuals of being able to express a point of view in both an articulate and yet reserved manner. His absence will be greatly missed. On a motion by David Clemmey seconded by Chairman John Gilleran the Finance Committee voted unanimously to forward a letter of appreciation to Fred for his outstanding service and contributions rendered while a member of the Finance Committee. The Finance Committee also voted to submit a letter to the Board of Selectmen notifying them of the vacancy and request a joint meeting between the boards to select a new member. 2. Information was received concerning the removal of gravel from Fulton Pond which warranted our discussion of the matter this evening. This information centered on the two basic issues Of: namely - receiving payment for the gravel and secondly the proper procedure for contract extension and town liability. Ron Montaquila started the discussion by noting that the town manager left the FINANCE COMMITTEE, MANSFIELD 7/17/74 -2- file on Fulton Pond for our review per request. Ron also asked a basic question concerning this matter, namely why is it a matter for the Finance Committee to discuss or consider. John Gilleran answered by saying that there are four basic reasons: 1. It was a money article at town meeting. 2. It involves a contract which creates revenue for the town. 3. This contract will initiate another contract for similar conditions at Kingmen's Pond. 4. Finance Committee endorsed the original Fulton Pond Article. After prolonged review of the file and of the information received the following areas of concern were highlighted: I. There was no "notice of assent" received from the Bonding Company agreeing to the extension of the terms of the original contract. 2. Inadequate traffic control which under the terms of the contract were to be born by the contractor. Dennis Hannon noted that it is not the usual practice for a bonding company to give a letter of assent in matters of this nature. Both David Clemmey and Ron Montaquila were opposed to take any further action concerning this matter as a committee. This matter was tabled; since the available information at this time was all heresay and not substantiated in any manner.
