Upon being notified that it was an Live session he wanted to be re o/rded as being o posed. &Lisj'01" t reviewed the issues ✓being raised about the claim for additional fill by Consigli and their that the DPW has not lived up to their obligations in the process. D. Clifford stated he es all work done by the town was correct and he stands behind it my Consigli and Greg Burns of Consigli Construction (Consigli) joined the discussion at p.m. D. Young had all in attendance introduce themselves and who they represented. He then asked A. Consigli to state their claims. They believe there are two main issues: 1) the town owns the fill and compaction of the material in the layer of loam stripped from the site and 2) the town (subcontractor Dorrance Excavating) over excavated the site while stripping and grubbing the site. D. Young asked them to point out in the specifications or on the drawings where they believe it states the first claim.: G. Burns said he was unprepared to do so but would in the future. He is adamant that they carried only 3,000 cubic yards(cy) of fill in the main project and about 3,000 cy more in Alternate 1 which is work the town is performing. No documentation was provided. D. Clifford defended his contract work in regard to stripping and grubbing the site. He stated his estimates originally were for 10,000 cy to do the whole project and bring the site up to finished grade. His current work includes no fill. Some heated discussions took place regarding dewatering techniques utilized by various parties and who owned what. Questions about whether a dry surface was required prior to Consigli starting. D. Clifford made it clear that he only owned enough dewatering to remove the stumps and topsoil. L. Carpenter stated that the MBC has always had the intent to not have the town do any compacting ,of soils for which the contractor would then be required to do compaction on top of it. The ability to define liability would be to great if that occurred. R. Holt stated clearly his position that the work at the site has been done in accordance with standard practice and that a geotechnical engineer certified the conditions of the site prior to the placement of any fill. A certified testing lab is nowperforming compaction testing. A. Consigli finally agreed the work at the site is acceptable. G. Burns stated that if they pursue their claim for payment of fill it will also include down time, additional dewatering, and other related items. A. Consigli thought an amount of about 1,400 cy was acceptable for the town to pay for at $12.50 per cy. D. Young stated nothing could be agreed to until some documentation to substantiatetheir claims was provided. R. Hoit suggested that Consigli meet with L. Azinheira and L. Bartolini and himself to review available survey data. All agreed this would be beneficial and those parties should agree on the quantities ( fill for topsoil layer and over excavation). The values will be presented at the next MBC meeting. MOTION (Antoine/Carpenter) at 8:30 p.m:' To close executive session and return to open session.
