A preliminary study is being performed for the results of a two-year and ten-year storm. Mr. Azinheira stated that because of the introduction of a new low point at the entrance of the Town Hall Connector this area is being flooded because the pipes on the main street are being surcharged. Mr. Azinheira stated that the entire line is being surcharged. He stated that they also explored the possibility of installing a back flow preventor and the installation of a higher manhole, which drains into a different location to alleviate any future flooding at the front door. There was discussion regarding the cost MBC Minutes — September 30, 1997 Page 2 of 5 of all options. The minimal cost of just materials for the connector would be at least l $6,000; this "guesstimate" does not include the pipe, structure or back flow preventor. The acting town manager asked about directing the flow towards Union Street. Selectwoman Royle asked who was responsible? The Town Engineer stated that the creation of the new low point caused the problem. Mrs. Royle asked why wasn't this fault ever brought forth before. Chairman Liddick questioned this same thing. Atty. Mangiaratti clarified Mrs. Royle question by stating that the question should have been asked if the Town's system would be adequate to handle the flow of the site. Chairman Liddick stated that the design engineer was obligated to ask the question but not obligated to correct the Town's system. Member Feeley asked if the Town Engineer should have been responsible for researching this. Atty. Mangiaratti stated that the cost of fixing the drainage problem would ultimately be the responsibility of the Town. Mrs. Royle stated that we have considerable changed the contour of the building by lowering the site by at least on level. She asked the architect why he didn't acknowledge the possible problem with a grade reduction. Mr. Hoit stated that he was unable to respond to this question at this time. Chairman Liddick stated that the right questions might or may not have been asked. Mrs. Royle stated that she is upset with the fact that the Town always has to bear the financial burden. She asked if the architect could bear some of the cost. Atty. Mangiaratti stated that the previous drainage just flowed off site. Member Feeley stated that the present inadequacy of the town system has found an outlet in the lower manhole in front of the connector. Atty. Mangiaratti asked if the design team should have caught this system inadequacy. He stated that no matter what — he stated that the town would ultimately be responsible to pay for this value added, however, he feels that we need to f explore the possibility if this would cause additional costs by fixing this now. Atty. Mangiaratti stated that we need to look into the possibility of errors or responsibility of correction. The Town Engineer stated that the proposed solution at the time of installation would be different now. Atty. Mangiaratti stated that we need to review the specification for the civil engineer and ask them to respond. Selectwoman Royle asked what measures could be taken immediately. The Town Engineer suggested that a back flow preventor could be added. The problem with this drain is due to intensity and duration. Member Young asked if there was support in the room to move forward to fix the problem. Atty. Mangiaratti asked if Town staff could do this. Mr. Azinheira asked if the Department of Public Works could price this out. The Town Engineer stated that if he has the time he was capable to design this. Selectman Colella stated that he feels that the MBC and the Town Engineer are not responsible for this problem, he feels that the architect and the design engineer should be responsible and the to correct this. Mr. Colella stated that we shouldn't pay any money or take any measures to fix this. Atty. Mangiaratti asked if he wanted us to research this problem for arbitration. Mr. Hoit was questioned if he had any records pertaining to the permitting process and approval process with the drainage system. Selectman Mahana asked if the Town Engineer could look into developing estimates. The Chairman directed the architect to contact his civil engineer and get back to the committee tomorrow. Atty. Mangiaratti stated that he would await direction. NOTE: The Committee voted to go into executive session to discuss pending litigation MBC Minutes —September 30, 1997 Page 3 of 5 r There was discussion regarding the air conditioning unit at the Town Hall — Sound readings were done September 16"i. There was discussion on the report from Acentech regarding the measured operational noise levels. The acting town manager stated that he did not feel that this was adequate. Member Antoine stated that the chiller unit was adequate for this building. The suggested DEP regulations state that the machine cannot be above lOdB above the ambient level. There was only one time it was more than 1 dB above the regulatory allowed level. There was discussion regarding the type of heating and cooling system. Mrs. Royle stated that we have a level of responsibility to insure the happiness of neighbors. Selectman Mahana stated that he hears a lot of negative comments from the community. Selectman Mahana asked that the MBC give a solution for the problems so that the cost benefits can be weighed and measured. There will be a hearing with the Board of Health within a month for the noise violations with the chiller. Atty. Mangiaratti stated that there needs to be a policy decision. Chairman Liddick stated that he is concerned with the amount of money that was being spent in addition to the contract on an overtime basis. POLICE STATION: Member Feeley gave an update of the hazardous waste clean up for the police station. The estimate clean-up price is approximately $50,000.
