POLICE STATION PROJECT:.
There was discussion regarding the letter from A. Bacchiocchi listing the items that are
remaining for closeout at the Police Station projects.
The certificates of liens will be submitted with the final closeout. The as-builts and O &
M manuals are being completed and should be submitted next week.
Member Feeley asked about any other items that were outstanding. Mr. Hoit presented
change order number 9 and they discussed the credit for HVAC.
1. Install acoustical ceiling at stairwell job — OK
2. Cut, patch caulk 10 vertical joints - $1,088 — (Member Feeley was
surprised at the price.)
3. Provide electrical services to photo/crime lab (CNM feels that this is
not part of the scope of their work)
Mr. Hoit gave an overview of the items that were resolved without charge to the project.
Some of the items included installation of fans, electrical works at entrances, installing
motorized dampers as well as additional electrical conduit work. CNM also did
additional work in the cell area. Mr. Hoit felt that the contractor gave a good product.
Member Feeley stated that it was his opinion that the building was gorgeous. He also
stated that the MBC budget was over budget.
BBC and the MBC began discussions regarding closeout of the project. Chairman
Liddick asked the architect to write a letter to BBC regarding the credit from CAM.
Member Feeley discussed BBC letters regarding liquidated damages and delay claims.
Chairman Liddick stated that he is not disputing the work on Change Order 7 & 8, rather
the late notice on the timing on the dollar amounts. Mr. Gary Brait stated that he had
submitted these items to Strekalovsky and Hoit in October. Member Feeley stated that
many items were added at job site meetings in the best interest of getting the job done. It
was the consensus that all the parties involved did not follow proper procedures.
Chairman Liddick asked Gary Brait what was the date of completion for the project. The
date is 2/10/98. Mr. Brait brought forward a letter to the committee regarding liquidated

damages. There was discussion regarding the progress schedule dated August 16th.
i,.. Chairman Liddick stated that he has not seen how the number of days were determined
and verified in the schedule. He stated that the committee needed a revised schedule
that would prove why BBC felt justified with a 77 -day delay claim. The Chair stated that
he had asked BBC for a date for a delay date in November.
BBC left the room to discuss their position in the other room.
The committee discussed the masonry bid delay process with the architect.
BBC returned to the room.
Chairman Liddick discussed options to handle the closeout procedures for the project.
Mr. Gary Brait stated that he was the lowest of 14 bidders and that the job went over by
77 days due to the delay in awarding the masonry bid as a result of this BBC has incurred
actual costs in association with this. Member Feeley stated that he was shocked that BBC
wanted to go forward with the delay claims. Mr. Gary Brait asked Member Feeley if he
thought that BBC was legally delayed. Member Feeley stated that he thought they were
legally delayed but he also felt that the subs had not held up their end of the job which
resulted in the job being delayed at the end of the project.
Member Feeley stated that we need a letter generated from S & H stated that MBC
questioned the delay claim of $125,000 because of lack of evidence and to establish
liquidated damages started from December 1 through February 10th
MOTION: To ask Roger to speak with BBC regarding closeout offers and if
the conversation is not productive then the letters (RE: delay claim
and liquidated damages) should be sent. (RF/WM 4-0-0)
Member Feeley asked the architect if there was resolution of the cameras. Mr. Hoit
stated that he was working with Bennett regarding different lenses. It was never Mr.
Hoit's intention that there would be any blind spots in the cells.
MOTION: To adjourn at 11:30pm (RF/DY) 5-0-0
Respectfully submitted,
Richard Feeley — Clerk
