QUALTERS MIDDLE SCHOOL Proposed Delay Claim — Michael Callahan, J.T. Callahan expressed his position regarding his proposed $20,000 delay claim. Mr. Callahan claimed that a delay caused by the Town, in starting the QMS project, is now causing masonry work to be pushed into winter conditions. Discussion opened by MBC re: various issues: • Notice to Proceed was given July 7, 1998 - Mr. Callahan agreed with Rich Feeley that site work was started at this time. • Building Permit issued July 28, 1998 — Rich Feeley noted that the Building Inspector is allowed up to 30 days by law, to award a permit. J.T. Callahan should have factored this time into their schedule. J.T. Callahan's permit was issued within the 30 -day period, which provided J.T. Callahan an opportunity to start work earlier than expected. • Approved Schedule — The final construction schedule approved by Keyes, was submitted by J.T. Callahan, on Sept. 29, 1998 to the MBC. Schedule is indicated in file as 3`d revision. • Re: Work in Zone 1 and Zone 2, Mr. Callahan was asked why work was not started earlier — No specific answer given. Committee members noted discrepancy in start dates- Zone I & 2. • Chris Sullivan, QMS Project Coordinator, noted General Conditions of contract indicate J.T. Callahan owns winter conditions during November through March 1999. • Rich Feeley ask Michael Callahan how he arrived at $20,000 for claim. Mr. Callahan stated the $20,000 calculation was a "Pie in the sky number". The Town Manager, MBC, Architect and Project Coordinator all agreed that based on the approved schedule and discussion, J.T. Callahan has no basis for claim. Michael Callahan disagreed and plans to continue pursuing the issue. Chris Sullivan, QMS Project Coordinator will continue to track dates/schedule for the Town. School Construction Updates- The Town Manager clarified miscellaneous issues regarding the QMS project with Project Coordinator. John D'Agostino asked that the chairman, or representative from the MBC, start attending one Board of Selectman meeting per month to provide updates re: school construction activity.
