Jim Liddick reiterated that both Paul Letendre and Steve Chmura should be prepared at Tuesday's meeting (2-29-00) with back up to support the proposed credit values. Committee agreed that credits could be negotiated with JTC if necessary. Rejected Work —Committee members were in agreement that the Contractor is expected to complete all rejected work. Steve Chmura reviewed a list of rejected work with the members present. • Expansion joint/Cafeteria —Floor joint is not level. Bathrooms — Discussion re: Use of a one -foot accent strip to repair jagged edge of tile installed in gang bathrooms. Keyes to determine if all bathroom tile work is complete. Heat Trace — TCI noted that Montle Plumbing deviated from contract drawings with regard to location of installation of piping. Heat Trace does not function as designed. Keyes to issue notice to Montle Plumbing that work is rejected due to improper installation. Montle Plumbing to also be advised to correct issue by either relocating pipe as designed or by adding a re -circulation pump at no cost to Owner. • Computer room cabinets re: tile work. Workmanship is unacceptable. Window System Installation - Bob Vogel commented re: a conversation with Cheviot. Parts are currently on order to disable window units that are completely obstructed and replace them with fixed windows. Issue with some classrooms have windows with significant column blocks is still being addressed by Mr. Vogel. Chairman questioned Mr. Vogel as to what directive Ron Ashton gave to JTC re: Shop Drawings. Mr. Vogel responded that Ron Ashton's notes re: Shop Drawings, indicate that the Contractor is to coordinate all locations of windows. • Door to right of Administration Area — Fix is unacceptable. Keyes Associates has directed JTC to raise door frame. • Padding at gym to be raised. Work rejected. • Ceiling/Cafeteria —Acoustic panels don't match at differing ceiling heights. Work rejected. • Acoustical Tile -Question raised as to whether acoustical tile was removed by JTC. Per contract, Contractor is required to patch to match ACT. Major issues for discussion MBC Meeting of 2-29-00: • Roof Unit Pricing — Committee agreed along with confirmation from legal counsel that the unit pricing issue re: MHS roof is a non-negotiable issue. Winter Conditions Claim — Discussion was that JTC did not start Zone 2 when they could have. JTC was allowed access to several areas in advance of their schedule, which would have alleviated delays. Based on the original schedule JTC must have been aware of some work planned during the winter months and must have carried some winter conditions in their bid. Discussion was to negotiate winter conditions claim to gain further action with regard to credits and incomplete/rejected work. Chairman Feeley expressed opinion that JTC has not offered enough strong support to their claim for winter conditions to date. • Liquidated Damages - Bob Vogel confirmed that per contract, the Contractor is not entitled to compensation for General Conditions for an extension of time beyond the contract. Cost of General Conditions is already included. • Construction Schedule - JTC is currently 73 days past contract deadline as of today. Potential liquidated damages to Town at 73 days (as of today) times $500.00 per day equals $36,000.00 to date. Manpower — David Young asked that Paul Letendre prepare a list of documented manpower on site from December 1999. Average manpower on site is 11 since 12-1-99. Plan of Action — Committee discussed agenda items to be included at the MBC meeting schedule for Tuesday, February 29, 2000. Tentative agenda is as follows: TOOPM MANSFIELD HIGH SCHOOL Sue Michael Brown/David Burson, Wallace Floyd Design Group Question as to whether roof issue will be discussed before or after discussions with JTC.
