Mr. Lynch discussed the possibility of having the School Dept. re -finish gym bleachers and using the amount of credit for the locker room changes. Paul Letendre to verify that specs. include a line item for bleachers and the associated value. Rich Feeley requested that the School Dept. adhere to current protocol and obtain opinion from Mr. Moretti about incurring the additional expense. Linc Lynch and Walter Parker to follow up with Superintendent and respond to Vice Principal and Athletic Dept. QUALTERS MIDDLE SCHOOL Winter Conditions/Masonry - Michael Callahan disputed Keyes' opinion that Means & Methods were available to JTC to proceed with required contract work. Bob Vogel stated the following opinion; • JTC did not explore all possible options to adhere to their schedule. • Based on the schedule provided by JTC at that time, Zone 1 could not be finished in time to start Zone 2. • The 30 -day notice regarding Building Inspector approval was not factored into the start of JTC's schedule. • Notice to proceed was issued to JTC on July 7, 1998. • JTC did not provide an approved schedule to the MBC until Sept. 28, 1998. Chairman commented that per spec. the Contractor is to carry cost of work to be performed under winter conditions. Michael Callahan agreed that JTC was able to proceed with work in other areas. 8:20 PM. Committee adjourned for 5 minute caucus to discuss terms of cost agreement. MBC reconvened at 8:25 PM. Status: Re: COP #111 Winter Conditions Masonry- Cost is $20,000.00 plus 8% mark up. JTC agreed to accept $27,500.00 for winter conditions. Keyes Associates will prepare Change Order Proposal #111R including the required back up for MBC approval. Punch List — Steve Chmura reviewed a lengthy list of incomplete work with Michael Callahan i.e. door at stairwell #1 jammed and does not close, missing traffic pads on roof, master keys unable to open doors, pads at gym w/oak trim to be installed top and bottom, etc. Due to the volume of incomplete contract work, Mr. Chmura noted that Keyes is unable to prepare punch lists of the exterior, gymnasium, and auditorium areas. Bob Vogel questioned Michael Callahan as to when JTC will be ready to have remaining areas punched. Mr. Callahan responded that area should be ready within two weeks. Steve Chmura to forward remaining lists to JTC at that time. Paul Letendre commented that mechanical formal request for re -inspection must be received from all mechanical trades by Thursday's 8:30AM meeting scheduled with TCI so that, Keyes can review. Rejected work —Architect provided a list of rejected work for review. • Expansion joint — Michael commented that existing floor is bellied. Steve Chmura stated that various options to address the problem were discussed with JTC over the summer. Keyes faulted JTC with waiting until the last minute to address issue. Workmanship is unacceptable. Discussion was to bush hammer a three -tile width area. JTC to prepare COP to level slab near expansion joint in cafeteria. David Young expressed concern re: vibrations causing damage to 1'` floor lighting. Paul Letendre to follow up. • Gang Toilet Rooms — Town paid $8,000 to install Ceramic tile at chase wall. Work was not installed as directed. JTC to prepare credit for total footage of rejected work. • Wall at Admin. — Masonry was rejected by MBC. Window does not meet wall. Michael Callahan commented that repair to window was complete. Architect and Project Coordinator both agreed that repair is unacceptable. Rich Feeley suggested that JTC direct sub -contractors to remove and reconstruct masonry wall. Keyes to discuss additional alternatives with JTC. • Heat Trace — Rich Feeley questioned, how Montle Plumbing installed heat trace throughout the length of pipe. Steve Chmura responded that the Contractor ran piping through crawl space instead of first floor ceiling per contract drawings. Michael Callahan to advise Paul Rapoza to install re -circulation pump or remove and re -install plumbing per specifications. • Water Fountain — Rich Feeley questioned status of a credit due to Town for glazed block patch to match. Keyes Assoc. previously requested credit proposal from JTC. Michael Callahan to follow up re: status of credit. MBC agreed to backsplash method using a pre - finished plywood. Sample was to be shown to MBC prior to remaining installation. JTC did not provide sample. Contractor installed an unfinished birch plywood. It was reported that water has permeated through plywood. 'JTC agreed to remove water coolers and replace with pre -finished materials and clear varnish. • Computer Room Cabinets — Spec. calls for base trim. Discussion re: options to repair voids. JTC agreed to repair voids using a 1" oak trim affixed to cabinetry. • Window System Installation — Keyes opinion is that both Architect and Contractor are at fault. Repositioning of window created additional work. Michael Callahan will review drawings. Bob Vogel to continue to explore options to correct issue. • Vestibule doors/Admin — Issue re: door not closing properly. Project Coordinator commented that door had negative pitch back to building. Michael Callahan responded that JTC would repair doors to the owner's satisfaction. • Wall padding at Gymnasium —Installation pending. • Acoustical wall padding at cafeteria — Keyes/Project Coordinator to review Time Extension/Liquidated Damages — Based on the contract deadline of December 17, 1999, the Town is entitled to receive liquidated damages at a rate of $500.00 per day $38,000.00 for 76 days to date). JTC's claim was for additional General Conditions for time extension to contract. Extension of time to contract was not authorized by MBC due to lack of proper back up provided to support the time requested. Keyes Associates noted that per specs., costs incurred by change order were already paid to JTC within the monthly Application for Payments. Both parties agreed to drop claims for additional General Conditions/Liquidated Damages and that no dollars are due to either party. Credits — Chairman reviewed list of credits. MBC to forward list of credits including values for JTC review and respond. Roof penetrations — Contract owns roof penetrations (15) per contract. Paul Letendre commented that the value assigned to penetration work is based on the cost for similar work provided by roofer in a previous COP. Roof Issue/MfIS — Bob Feeley, of Feeley, McAnespie Inc. questioned JTC withholding roof payment from December due to JTC's dispute with the Town re: use of unit pricing. MBC Chairman explained that the bid sheet from Contractor did not include a value for roof work. David Burson stated that if roof work is deleted, the Owner is entitled to the value per unit pricing included in bid. Both Town Counsel and the Attorney General's Office support this determination. MOTION made to authorize the MBC Chairman to accept the current agreement with JTC relating to roof unit pricing, credits, time extension/liquidated damages and winter conditions for up to one week. If JTC does not agree to the terms within this timeframe, the agreement will be void. DY/JL: Passes 5-0. Michael Callahan left the MBC Meeting for a short time and returned at 11:38 PM.
