QUALTERS MIDDLE SCHOOL Window Conflict - Issue re: numerous windows installed at QMS that are impeded by columns or partitions, and do not operate per specifications. Representatives from Keyes Assoc. and Cheviot Corporation attended to discuss possible resolution with the MBC. Window discussion was as follows: • Design Deficiency — Rich Feeley questioned Bob Vogel as to why the windows were designed without consideration of partitions and columns. Mr. Vogel stated that Keyes position was to achieve a specific "look" from the exterior. Chairman noted that the ultimate choice of "look" was made by Keyes staff and not the Town. Shop drawings should have noted to verify in field. • Installation/Field Measurements - Chairman asked Cheviot about JTC's contention that Keyes' Architect field measured and instructed Cheviot how to install windows. Larry Wilcox responded that this was not the case. Mr. Wilcox stated that Cheviot Corp. field measured units and performed window installation as shown in shop drawings. Mr. Wilcox added that Cheviot interpreted shop drawings that windows having column conflicts were designed to be that way. Mr. Wilcox stated that Cheviot was at fault with window installation error in the nurse's area. • Materials/Shop Drawings — Chairman stated that window size varies throughout the school building and suggested that a standard production size would have been easier to manufacture than the custom cut windows required. Mr. Wilcox responded that the windows were produced per shop drawings. Rich Feeley asked Larry Wilcox to provide this documentation to the MBC. Maintenance — Concern was raised previously by Walter Parker about the ability to replace broken windows in the future. Mr. Parker reported that Larry Wilcox, visited site and demonstrated for the School Staff, proper procedure to change out windows (impeded with partitions) should it become necessary. Comment was made that to replace windows impeded by columns, the existing unit needs to be destroyed first. • Proposal - Bob Vogel initially proposed that Keyes correct 40 window units (20 locations) where windows are in conflict with partitions in addition to offering a rebate for the balance of window conflicts. MBC immediately rejected Keyes' proposal to the solution as sub- standard and only addresses one quarter of the window issues. Mr. Wilcox agreed with MBC Chairman comment that the Town is entitled to operable windows per contract. Bob Vogel stated that Keyes Assoc. is not financially prepared to cover total cost to correct all window conflicts due to their insurance deductible. Keyes would seek legal action if held solely accountable. Status to Proceed — Rich Feeley stated that the MBC would expect that Keyes be responsible to make a "minimum" of 50% of impeded window units fully operable. Mr. Feeley suggested priority to have lower windows be made fully operable and upper windows fixed in place. Keyes agreed to suggestion to make upper window units at wall conflicts fixed in place. Chairman also reported an issue in junior wing (Rm. 108) near courtyard where window needs to be reset approximately 5 inches. Bob Vogel to follow up. Jim Liddick suggested the MBC meet with Keyes and Cheviot at QMS to draft scope of work, room by room. The date to walk site was set for August 15, 2000 at 7PM. Work is still ongoing. Project Coordinator noted that in reviewing site, a few items need to be added to the punch list. Change Order #20 — Still not signed. Steve Chmura commented that JTC has been unresponsive. MBC questioned status of Letters of Protest on file — Keyes has none. If letters are not filed within 21 days, a subcontractor has no legal recourse to dispute issues. Repair of gym ceiling is only known protest. AC at Admin. — AC unit is still inoperable. Steve Chmura commented that McLaughlin Mechanical is holding Johnson Controls responsible for unit not working properly, noting design deficiency. Town expects Contractor to replace damaged carpet and install the new coil needed. Items should be under warranty. Project Status — Discussion raised status of completion. MBC asked Keyes to issue seven-day notice to JTC to complete interior work with an additional notice to be issued seven days following that. Keyes to request JTC to furnish all information regarding protest items. Elevator #1 - Annual inspection certificate is needed for elevator #1 (Zone 2).
