Callahan & Sons Richard Coughlin, Coughlin Consultant Services Commercial Painting Representative _ Meeting commenced at 7:15 PM. MANSFIELD HIGH SCHOOL Painting Dispute — Previous discussion with the MBC was that JTC would solicit services of an outside consultant who would mediate the dispute over interpretation of who owns painting of lockers and glazed block. Scope of mediator's responsibility would include review of documentation, meeting with all parties to hear opposing views and possible involvement in negotiation of a resolution. If mediator was mutually agreed upon, cost for services provided by the mediator would be split between JTC and Owner. JTC independently secured mediation services from Richard Coughlin, Consultant Services. MBC was surprised to receive a "final" written opinion regarding the paint dispute provided by Mr. Coughlin earlier this week. Based on discussion, Rich Feeley commented that the investigative process performed by Mr. Coughlin was incomplete and that the opinion given appears bias. It was determined that the mediator did not review all pertinent documentation regarding the paint issue. The Mediator admitted that he did not meet with anyone from Wallace Floyd Design Group or the Owner for their input prior to making his final determination supporting the painter's claim. Claim 11 Painting of Lockers: • Required Site Visit - General Conditions section of contract mandates that all subcontractors visit site prior to bid. Commercial Painting representative admitted no one from their company visited site as required. • Painting Method — Terminology in the Mediator's report states it is "customary" to call for electrostatic method painting of lockers. David Young suggested it is the Consultant and Contractor's "presumption" that the Town wanted electrostatic paint. Because this method is not specified in specs., the Contractor assumed that painting of lockers is not owned. Rich Feeley commented that proper investigation, of the required work, was not performed by the painting Sub -contractor and that the Contractor should have issued a Request for Information. Commercial Painting Representative confirmed that no RFI's were issued. • Chairman questioned Painter as to why pricing was lowered in re -bid. Commercial Painting Rep. responded that pricing was modified based upon "new quantities". Commercial had seen tally of original bid. Commercial Painting Rep. said they had verbally communicated with WFDG and were told to "Bid it as you see it". Claim 2 Painting of CMU Block: • Site Visit - All subs were invited to view site prior to bidding. Paint Subcontractor chose not to visit site as recommended in specifications. Finish Schedule - Mediator's report noted wording in finish schedule was changed supporting paint was not required. Sue Michael Brown noted that Addendum #7 supercedes finish schedule stating that "all" surfaces are to be painted. Credit due for Painting Glazed CMU - Since glazed CMU is not usually painted the Subcontractor has not performed this work. JTC has not yet provided credit in the amount of $35K. Cost estimate is based on quantity of glazed block not painted. Commercial representative hopes to recoup 85% of cost for glazed block ($28K plus JTC 15% mark up). MBC rejected this offer. MBC held brief discussion with mediator. (JTC was asked to leave the room at this time.) Members expressed concern that the mediator is not receptive to reach middle ground between both parties (JTC and Owner) and that several other factors should be taken into consideration. Mr. Coughlin refused re -consideration of opinions given in his original report. Mr. Coughlin advised the MBC of various scenarios to resolve issue in binding arbitration and Superior Court. Mr. Coughlin left meeting at 9 PM. General Meeting resumed with J.T. Callahan, Commercial Painting, Wallace Floyd Design Group and Municipal Building Committee. Negotiation Summary: Commercial Painting made an agreement with MBC to electrostatic paint all outside visible faces of lockers for a fee of $29K, with no additional mark up to JTC. In addition the cost proposal for painting glazed block is now void. WFDG to issue change order by Monday (11-27-00) to be included in JTC/Change Order #17. Chairman requested that Commercial provide release of liens as required. WFDG and JTC to include cost of this item in next JTC/Application for Payment. Direct Payment Requests — Rich Feeley stated that JTC needs to immediately respond to all outstanding direct payment requests. Pavin —Original date (11-18-00) for paving work was not met by JTC. JTC noted that paving is re -scheduled to Friday, November 24, 2000. MBC expressed concern regarding quality of paving in freezing temperatures. David Young advised JTC that contract documents specify 50 degrees ambient temperatures to proceed with paving. Committee asked JTC to proceed with the following paving work this Friday (11-24-00) and delay final paving until Spring, 2001. 0 Feather area of pavement in rear of MHS gym where asphalt was cut. • Clarify handicap ramp requirements at QMS gym entrance with Architect and revise pitch as necessary to meet occupancy permit requirements. Keyes needs to issue sketch to JTC. • Install necessary pavement to raise level where catch basins are located. Handicap Access - Phil Ricci requested clarification of modifications made by local Building Inspector to adjust the pitch at the rear door entry to meet handicap access requirements. Phil Ricci is still waiting for Keyes Assoc. to provide a sketch previously requested by JTC. New sketch from Keyes is to show a change in pitch from 1 and 12 pitch, to 1 and 20 pitch (one and twelve pitch would require additional cost for installation of handrails.) MBC raised concern about paving the full width of entry, that cars could drive and/or park right up to the door. David Young suggested that if the full width of entry is paved, then bollards would need to be installed at entry way.- Also need to strip area for fire lane. Installation of Guardrail —Work is incomplete. David Young reported that the guardrail at rear of NMS near gym is still not installed. Michael Callahan to follow up.
