Motion by Planner Latham seconded by Planner Wojtkiewicz, to sign the Warrant in the amount of ,'}$92.28, all in favor. At 8:00 PM Robert Rizzo met with the Board to discuss his preliminary plan for Wayside Estates. Discussion was held on changing the loca- tion of the road as it would create a bad intersection, drainage and the use of eight inch transite pipe. There was a question by the Board on the right-of-way that exists and is not shown on the plan. Discussion was also held on abbuttors, street names and catch basins. Fire hydrants and water lines should also be indicated on the plan, and markers on stone bounds. Mr. Rizzo told the Board he would like to build a three family apartment in the development but it is in an Agriculture Zone. He told the Board he had discussed it with the Building Inspector and there is a question as to what requirements he should follow. Under Agriculture he could have any use permitted in Residence A and B. Under Residence B #6 it states "Multiple residence in accordance with Section SF2. Under this section he feels he can meet the requirements but not under Multiple Dwelling Complex. In order to come under Section 5F1 you have to have a Multiple Dwelling Complex which is two or more buildings on the same lot, not having enough frontage. Mr. Rizzo felt that by building one dwelling on one lot on an accepted street he could come under Section SF2. Planner Nelson told Mr. Rizzo that perhaps he had found a loop hole but it wasn't our intent when Zoning By-law was written to have three family homes on 30,000 square feet. Town Planner will check with Town Counsel. -2 - At 8;30 PM, Mike Jemminis, Engineer for Magna Vista met with the Board. He advised them that the recowmnended changes on the plan had been made and presented to them a plan for the recreation area. On item one, water main in Darby Drive area, he will show:on the plan the whole length of the water mainas it ties to'the side lines. Mr,. Jemminis asked the Board if it would be possible to tie all points in once it had been completed Board agreed to have all points tied in when it has beem'completed. On item two Mr. Jemminis advised the Board as soon as he can :get delivery on pipe the drainage pipe on Lots #54 and #53 will be extended to reach the pond. Chairman Mendes advised Mr. Jemminis that 'there doesn1t seem to be any record as to how long the pipe is suppose to be and should be shown on the plan. `It would be possible for him to change it on the linen as long as he puts on a revision with the date andwhatwas changed. Item #3 drainage pipe °-between lots #2a and #29 could 'create a;problem. After reviewing the topo'between the two lots it was decided that the pipe should be extended 75-80 feet and drained directly into the swamp. Item four location of: hydrants. First location was alright., Board,;noted that distance to next hydrant was only 300 feet. Hydrants locations were checked by, the board. Item fives all three streets are to be finished before any ;building permits are issued, unless the streets are bonded. Item 'six, construction has stopped. Item seven, recreation area plan." Town Planner Maurer told the Board he felt that when a new road was built it should be up graded and the design standards should be good. He presented to the Board suggested alternatives. Discussion was held by the Board on the area. According to the Town Manager the reason for the road the way it is is to save the trees.
