Adjournment 1 The Mansfield i September 28, PLANNING BOARD MEETING Planning Board met at the Mansfield Town Hall on Monday., 1970. Present: Town Planner Chad Maurer Chairman Mendes$ Clerk Latham$ and Planners: Wellington, Cinellij. Wojtkiewicz. Nelson and MacFarlane. Meeting called to order at 7:30 PM. Minutes were read from the meeting of September 21p 1970- Motion by Planner Nelson seconded by Planner Wellington to accept the minutes with the following amendment: "That Mr. D'Annolfo also agreed to supply the pipe for the drainage easement between .Lots 77 and 78 in the Magna Vista Subdivisi.onll� all in favor. Discussion was held by the Board on draining water into Whiteville Pond from the Magna Vista Subdivision as there was a question as to who owns the pond and how the deeds are written. Board will bring up at Public Hearing. Motion by Planner Latham seconded by Planner Wellington to pay the Warrant in the amount of $$42.75, all in.favor. Discussion was held by the Board on the Magna Vista Subdivision. Planner MacFarlane advised the Board that he had talked with the Nater Supt. from Norton and he had advised him that the water pipes should be installed in a straight line even if it is necessary to blast. Last week when Mr.:DtAnnolfo met with the Board he was ( advised to leave it bent as long as he tied pipes down ;to lot lines.'; Town Planner Maurer advised the Board he had sent a letter to Mr. D'Annolfo asking him to confirm what had been discussed. -Town Planner Maurer advised the Board he had discussed the matter with Town Counsel and went over the Magna Vista Plan with him. Town 'Counsel advised that we do not have to have a Hearing on the old part of the Subdivision: Darby Drive and Lawndale Road as the seven year time period does not apply to Subdivision Control, only to Zoning. Not necessary to have hearing on Laurie Lane. Waive Public Hearing as long as his roadway conforms to the 1961 Plan and that the abutters won't be affected. As far as bonding$_he advised to have him bond whole roads not just piece by piece. We should also require Form A.plan for lot #49 as he is re 'subdividing a lot that is already on file in Taunton. Town Counsel also ad- vised that if they continue;to work without going back and checking with Planning Board$ we can rescind approkal by voting at meeting to do so and filing copy of motion at Registry of Deeds:' Town Planner will request Town Counsel to send letter regarding Public Hearing. rr6 Mr. Edward Proteau met with the Board at 8:00 PM to request they rezondMhis land from Residence A to Business B or C. Discussion was held on the relocation of Route 140 as Mr. Proteau asked to tie his property to the center line of the .relocated Route 140. Board requested that Mr. Proteau wait until plans have been presented on the relocation at the Public Hearing in .October and that they would be in touch with him. -2 - Board reviewed plan for Ralston Purina. Town Planner Maurer advised the Board he had discussed the plan with Engineer Ralph Maloon and that he had put the side dimensions on the plan but the problem was with the lot being non -conforming. Town Planner Maurer advised the Board that Town Counsel said with the exception of the building plan could be signed and that the following notation could be put on it:?!This plan should not be construed as approval under zoning". Motion by Planner wojtkiewicz, seconded by Planner Cinelli to refuse to sign the plan on the basis it would create a non -conforming lot and that the applicants be so notified and Town Clerk. Also to suggest they submit application to Board of Appeals for a variance, all in favor. Motion by Planner Cinelli seconded by Planner Wojtkiewicz to sign a plan for land on Maple and Franklin Street owned by Alma Thibeualt for one and a acres, all in favor. Discussion was held on 1971 Budget. Motion by Planner MacFarlane seconded by Planner Nelson to adjourn to executive session for the purpose of discussing salary items, all in favor. Board adjourned to executive session at 10:00 PM.
