Town Planner Maurer advised the Board of the Progress on the Flood Plain Insurance. It is now being made available to people who live in flood prone areas. The Town has to be certified in order to qualify. Town Planner Maurer has drafted a letter for the Selectmen's review. The Town has to indicate by the 31st of December of this year, their intentions to participate in the program and meet certain criteria. The Town meets the criteria except as it relates to the building code. The Building Code Committee has agreed to insert the necessary information initheir draft presented to the Town Meeting. After the Town has been certified on a temporary basis the U. S. Army Corps of Engineers or the U. S. Soil Conservation Service will come and engineer the flood plain areas. After that the Town has to meet certain requirements involving the adoption of some type of flood plain zoning, The Board will look the draft letter over and make a recommendation next week. Motion: That the Board communicate with the Selectmen their endorsement of the concept of the Flood Insurance Program and that they wish to review the information presented for a formal recommendation next week. (Mendes-Chavaree, Grant, MacFarlane, in favor, Nelson present but not voting) 12. Mr. Ralph Seifert and Mr. Walter Millette of Waldor Realty Corp., came before the Board to discuss the performance bond on Mr. Millette's Pine Needle Park. He was advised that Town Counsel reviewed the bond and his recommendation was that from a legal point of view there was no problem with the method but that the Planning Board did no specifically have this method spelled out in the Rules and Regulations and that this was a matter of policy. Town Counsel was also concerned with the fact that the amount of the contract with Bella Construction Company was not equal to the total value of the improvements. Town Counsel was also concerned with the fact that the Town would not have access to the funds if either Bella Construction or Waldor Realty defaulted. It was decided that Mr. Millette would bond the required improvements in his subdivision with the bank pass book method, 13. Board discussed the Board of Appeals hearing of George Wojtkiewicz to convert a two family dwelling to four families. Question was raised as to any conflict of interest Mr. Wojtkiewicz might be in. It was noted that 4 the present zoning by-law was amended to read specifically to prevent this type of conversion from happening in that area, it presently allows for the conversion of a single family dwelling to two families provided that the exterior structure of the dwelling is not changed. It was suggested that Town Planner Meurer look into this matter, so that the Board canmmake an intelligent recommendation. 13. Board discussed the Board of Appeals hearing of John Cotterii to sell and service all -terrain vehicles and accessories on his property in a Residence "A" Zone. It was suggested that Town Planner Maurer look into this matter and present the information to the Board. 14. It was suggested that the Board set up a second meeting a week to review Zoning By -Laws. They will meet on Friday evening, December 3 at 7 PM. 15. Town Planner Maurer advised the Board that he checked with Town Counsel Grady about what would be needed on the Zoning By -Laws for the close of the warrant by the 15th. There could be just a statement of intent that we wanted to have review, but would have to have a full text before the warrant is printed. Town Counsel suggested that an alternative would be to put it off and hold for Special Town Meeting. 16. Town Planner Maurer advised the Board that the Capital Improvement Program Committee held interviews with all departments, except School, Water and Sewer and Fire Departments. The Committee is going to prepare a statement that will be issued to the Planning Board, Selectmen and Finance Committee. There will possibly be a joint meeting of the three. The intent is to have report that would be included in the Finance Committee report. There will be a meeting of the Committee on Thursday eveniing. 17.Board reviewed the proposed draft of the Subdivision Regulations and madd changes as follows: a. Page ZO 5a Motion: That we amend the 500 foot cul-de-sac to 650 feet. (Mendes -Grant, all in favor) b. 5b - Leave out clause from the word "in" to "subdivision" For extension into adjacent property the Planning Board may at its option require a roadway easement from the property line. c. There should be some control, that when a developer sells a lot it Is the responsibility of the person who bought the lot to conform with the elevation of the sidewalk. d. ."Page S Definition of Street - Secondary street is generally over 400 Vehicles per day, it was suggested that a standard be established that would determine the number of vehicles per day that would be generated in a housing development. Possibly 5 vehicle trips per day, 18. Motion: To adjourn (Chavaree®Grant, all in favor) Ii:IOPM
