6. Mr. James Freeman came before the Board with a preliminary subdivision plan
for land located on Willow Street for his client Mr. Charles Boutis. The
plan does comply essentially with all rules and regulations except for the
length of the street. He has shown a street 550 feet long. He also noted
that the approved subdivision (New Mansfield Estates) on South Main Street
which abuts this land is placing their drainage so that it may drain onto
their property. He suggested it was possible to connect the two roads and
alter the drainage system. He was advised to discuss this with the
developer of the South Main Street property.
7. Mr. Walter Millette and Mr. Ralph Seifert came before the Board with a
plan for a bond on Mr. Millette°s Pine Needle Park Subdivision. He proposes
to complete 3,000 feet of road under one contract. He wants to present
a bond for the full amount of the 3,000 feet of road. A performance bond
from Bella Construction to take the road from present grade to its finish.
Bonding representative Reliance prepared to issue 100% performance bond.
It was suggested that Town Counsel go over the contract that has been
drawn and the bond agreement that if the contract price is $£30,000 then
an escalation figure be put into the bond. He will submit this to the
Planning Board and the Board will clear it with Town Counsel.

9. Mrs. Margot Jellinek discussed with the Board the Fulton Pond specifications,
10. Board discussed the applicationr, Pond gravel removal,
Motion:That - _ letter to the Conservation Commission }p
to the Town Manager, Board of Selecemen and Department of Natural
Resources indicating that it has been called to the
Board's
attention that specifications for Fulton Pond excavation,
revised date October 21, 1971, appear to have several discrepancies:
A. Item A-2 - According to the figures, the tops of boulders would
be left eleven feet higher than the proposed bottom of the pond, with
no reference given to the angle of slope that should be left around
the boulders.
B. Item 3 states that a lump sum price be given for excavation to
135 feet. The proposed plans show finished elevation at 133 feet.
C. The Board's understanding of the original engineer's proposal
was that material not suitable for gravel would be used for finishing
the bottom of the pond as a sealant.
The Board is of the opinion that no Hatch Act hearing was held
or application filed for the removal of the gravel within the pond.
A Hatch Act hearing was held by the Board of Selectmen on June 2,
1971 for the channel relocation, Project Number M®224. As of this
date the Department has not issued an order of conditions on that
application. Furthermore, the original application was only
concerned with the Channel and did not include the dredging of the
pond.
Proper procedure for application for gravel removal permit has
not been followed • to this date.

tion next meeting. (Mendes -Grant, all in favor)
lk. Board reviewed a letter from Town Manager Camp.
Motion: To reply to Mr. Camp's letter as follows:
1. The Planning Board still wishes to maintain their own
Engineering account #200-9. At present this account has a
balance of $1,251.70 and the Board does not anticipate requesting
an additional amount at this time. The Board utilizes this
account for special engineering studies and not for specific
projects as they believe that engineering costs for specific projects
should be part of the •total cost for the project.
2. The Board feels that street improvements (as well as water and
sewer) should be outlined on a long range basis and a program
established for the annual maintenance and or reconstruction on a
specific time table. This work would be carried out in conjunction
with the Capital Improvement Program. Each street improvement
project in your list could be incorporated into the total program.
However, projects should be listed on a priority basis.

15. The Board had to re-sign a letter to the Board of Selectmen concerning
Cavallo & Signoriello zoning application.
16. The Board discussed the report for the Annual report. The report has to
be submitted by December 10. It was noted that it should be more extensive
than it has been in the past. The Master Plan should be incorporated as part
of the Planning Board report and should be completely explanatory. Town
Planner Maurer will have a rough outline for the Board next week.
17. Mftlov. 7hatr,we invite the Town Hall consultants to attend a meeting on
November 22 to discuss Title 7 program with the Board. (Mendes-
Chavaree, all in favor)

concerning solid waste and sewerage.
19. Planner Mendes informed the Board of a meeting on November 20 of the
Federation of Planning Boards in Middleboro in the Department€,of Community
Affairs Zoning proposals.
20. Planner Mendes questioned Town Planner Maurer on any progress made on
getting a certificate on the flood insurance program.
21. Planner Mendes discussed the solid waste study being conducted by the
Region:
Motion: That we send a letter to the District indicating that the Planning
Board looks favorably upon having the solid waste study completed
and is willing to provide in-kind services of the Town Planner
and amount of time should be equitable to that of the other
communities in the district and send a copy to the Board of
Selectmen with a cover letter that they do likewise in regard to
the Town Manager and administrative Highway Superintendent.

22. Motion: That we send a telegram to Chairman of Senate Ways and Means and
a letter of similar content to Senator Quinlan telling them that
the Mansfield Planning Board is strongly opposed to the passage
of house bill number 5950 since it would involve the assessment
of local communities without local input.
(Mendes-Chavaree, all in favor)
23. Planner Nelson discussed with the Board the recommendation they made to the
Board of Appeals on his variance application. He wished to take exception
to the letter in that it was in bad taste and should have used true facts.
24. Motion: To adjourn to executive session. (Mendes-Chavaree, all in favor)
