12. Board discussed the appeal of Cavallo and Signoriello for rezoning part of
their property to Business C.
Motion: That are send the formal recommendation to the Board of Selectmen
on the Goering petition of Cavallo and Signoriello. Based upon
work that is presently being done towards comprehensive zoning
changes which will be presented to the 1972 Town meeting, this
petition may present a conflict with the proposed recommendations
of those changes. At this time the Board recommends indefinite
postponment of this petition. However, the Board will strongly
consider this petition as part of the overall changes to the Zoning
and may look favorably upon a change of at least some portion of
this property to a Business Zone. (Type for all members to sign,
Carbon copy to Town Clerk.) (Mendes -Grant, all in favor)
13. Board discussed the Board of Appeals petition of Carl Nelson.
Motion: To write a letter o the Board of Appeals g Board
has ,,.d the ar xlication of Carl Melton of 5 Jewell Street submitted
to the Board of Appeals on August 17, 1971. The Planning Board
votedthat a variance of thisapplication 1 grantedfor the
following on
1. Section 3®0-15 of the Zoning By -Laws states that the front yard
line requirement shall not be less than 60 feet from the center line
of an existing way, whereas this building would be 22 feet from the
existing center line.
2. The existing character of the neighborhood is such that all
present and proposed buildings in the area would meet the required
-L;
set back. This building used for residential purposes would have
a set back of 22 feet which would not be consistent with the
character of the neighborhood.
3. The application appears to be incomplete in that the extent of
proposed alterations and number of families to use the building has
been left blank. This information is necessary for the intelligent
judgement of the application.
4. The apparent dilapidated condition of the building might
conceivably necessitate essentially a complete re -construction
which could be done at any location rather than on the existing
foundation,
5. The building has been used in the past to house anneals, there-
fore, the Board of Appeals should not consider the application with-
out a recommendation from the Board of Health and or State Depart-
ment of Public Health.
6. Chapter 40A Section 15 states the followings
"To authorize upon appeal, or upon petition in cases where a parti-
cular use is sought for which no permit is required, with respect to
a particular parcel of land or to an existing building thereon a
variance from the terms of the applicable zoning ordinance or by-
law where, owing to conditions especially affecting such parcel or
such building but not affecting generally the toning district in
which it is located, a literal enforcement of the provisions of the
ordinance or by-law would involve substantial hardship, financial
or otherwise to the appellant, and where desirable relief may be
granted without substantial: detriment to the public gonad and without
nullifying or substantially derogating from the intent or purpose of
such ordinance or by --law, but not otherwise."
