5. Attorney Bernard Martin came before the Board representing Nancy B. Skene
applicant of Highland Estates on Elm Street in West Mansfield. He presented
completed plans from the original plan that was filed and turned down. He
also filed the Form B. He was advised that this would be considered as a new
submission. Attorney Martin stated that this is being submitted under Section 81
Chapter 41 as an old submission: "In the event of disapproval, the planning
Board shall state in detail wherein the plan does not conform to the rules and
regulations of the planning board or to the recommendations of the health board
or officer and shall revoke its disapproval and approve a plan which, as
amended, conforms to such rules and regulations or recommendations." He is
filing this with a request that the Board revoke its disapproval or tell the
applicant where the plan does not conform in detail. Motion was read from
the Minutes of June 29: "Send a letter to the applicant rejecting the
application."
Potion: That the material that has been presented by Mr. Martin be further
studied by the Planning Board and the question that it is a new
submission be referred to Town Counsel.
(Mendes-Chavaree, all in favor)
6. Board reviewed Form A plan for Eleanor O'Connell on Essex Street, it was
noted that the plan was presented last week under the name of George Ward
and this was in error. The .other point was concerning the corner rounding.
It does not conform to subdivision Regulations. The plan will be sent back
for address correction on Eleanor O'Connell.
7. It was requested that the Planning Board receive copies of the new street
list.
8. Board reviewed the Form A Plan of 2 lots of Yankee Builders on Essex Street.
The plan will be sent back to see if the applicant will consider shifting
the front two lots so that the road will go down the middle.
9. Board reviewed the Form A Plan for two lots of Casa Realty on Walnut Street.
The plan will be returned to correct the distance on the plan from West
Street to Lot 2.
9. Board reviewed the Form A Plan of E. Paul Zecher for 6 lots on Gilbert Street.
(Planner Chavaree left the room and did not participate in any discussion)
Motion: To sign the plan for E. Paul Zecher (Mendes -Latham, all in favor)
10. Town Planner Maurer advised the Board that he will be meeting with Mrs. Thomas
on Tuesday to work on the draft of Zoning By -Laws and Subdivision Regulations.
There is a preliminary draft of the Capital Improvement program and he will
be talking to the finance committee on Wednesday evening. The Planning
,rBoard will receive copies in the mail before Monday's meeting.
11. The Board was advised that work will start on the Roads in Magna Vista by
Bristol Equipment. They are going to be installing water, putting in house
connections and bringing road and sidewalk up to subgrade. The Board was
advised that the Beverly Builders would like to amend the bond agreement
in order that the checks on file with the Town Treasurer could be released
in part as the work is completed.
-3 -
Motion: Not to amend the agreement which was filed on June 21, 1971 and
and that the funds will remain the same as indicated at that time
and that we still intend that it be completed by November 15, 1971,
12. Board reviewed the hatch Act Application for the Cabot, Cabot b Forbes
Industrial Park. (Planners Chavaree and Grant left the room and did not
participate in any discussion) There will be a public hearing on this
Wednesday on the whole park. The report that the Board received only
talks about the pipe sizes and not about retention of water within the
park. It was noted that all members that could should attend the hearing.
Motion: To write a letter to the Board of Selectmen in reference to the
Cabot, Cabot & Forbes Hatch Act application concerning the fact
that 'the Planning Board only received the report today and the
hearing is day after tomorrow and that the Board is unable to
have any recommendation and that the Board would recommend to
them to request an extension of time from the Department of
Natural Resources in which to act and that that extension of
time be sufficient for us to review the proposed plan and to
meet with the Board of Selectmen before they file their final
submission to the Department of Natural Resources. Advise the
Selectmen that one reason we are asking for an extension is so'
that we can have a consultant do a review of the plan because of
its magnitude. And to send a copy to Department of Natural
Resources. (Mendes -Latham, all in favor)
Motion: That at the earliest possible moment that Town Planner purer
contact the Region and determine whether or not there is any
consultant time left on the engineering contract and see if this
can be referred to them for review. (Mendes -Latham, all in favor)
Motion: That if this cannot be reviewed by the Region that Town Planner
Maurer and Chairman Wellington be authorized to check out and
hire a consultant per diem basis not to exceed $150 a day for
three days. (Mendes -Latham, all in favor)
13. Mr. Douglas King came before the Board with his plan of Canoe River Acres.
The Town Planner is concerned about the wet area on the easterly side of the
project. The Plumbing Inspector has not had a chance to look at the project
but he is concerned with what would happen when they started to fill the
lots. There would be a grading problem created by the grading of the street
because in that south easterly corner there would be a darning effect. The
plan has not been reviewed by all the Town departments. We asked for a
plan to show proposed contours. Mr. King's Engineer stated that the natural
grade of the land does not indicate that they are going to create a daming
effect. He was asked by the Board if he would consider digging some test
holes along the right of way to give us a cross section of what the water
level is. Town Planner Maurer presented an alternative plan for the
development to decide where to draw the line for a definitive submission.
The Department of Natural Resources is going to send another man out to
look at the property and reconsider their release of lots 1-51. It was
decided they would hold up any development beyond the 120 foot contour and
prepare a definitive plan for the first section.

14. Board discussed the possible Planning Board Projects for 1972. There is
$1500 in the Engineering Account which we haven't spent and it might be a
good idea for the Planning Board to consider a specific project for the
year. Possibility of going through the records to find streets that do
not have a plan or deed recorded. Also one project might be to take one
street in Town that needs to be improved, have it engineered so that it
could go into construction and go to the Town meeting next year. Williams
Street was suggested as a possiblity since it is a connecting street. What
was done in the past was have everyone list there projects then combine
those and set up a priority list.
15. Board reviewed the 1972 Planning Board Budget. Town Planner Maurer
advised the Board of the followings Telephone account was increased to
$360 based on the amount of use the phone is getting now. He was asked
to check into a Boston line. Office Expense was $500 this year, only $300 s'
for next year. Hearing and Advertising $400. It was noted that there
will heed to -be advertising for the Zoning By -Laws. Travel increased by
$40. Dues dropped down to $40. Microfilm Reader - do not need to
appropriate any more this year. Regional Expense - possibly lower than
last year. Printing - Zoning By -Laws and Subdivision Regulations. Talked
with the Mansfield Press about the printing of these. Possibly get them`"
done at the Regional School for just the cost of the paper. Equipment
maintenance - $40 considered sufficient for typewriter repair. Also must
consider breakdown of adding machine and other equipment. Board of Survey -
leave at $50. Engineering Account - probably should request another $1,000.
16. Planner Mendes requested that the Planning Board consider meeting every
other week. He felt that the same amount of work could be done. As for
the 'Form A plans they could be reviewed and sent back for corrections so
that the Board only sees a completed plan.
17. Planner Mendes questioned whether or not the Board should have some kind
recommendation on the Mitran appeal since his building is already over
lot covera9e. The Board will discuss this ,'next week.
18. Planner Mendes wondered who had the Department of Community Affairs Zoning
Book. Planner Chavaree has it.
19. Motion: To adjourn (Mendes -Grant, all in favor) 11s25PM
